{"id":101126,"date":"2022-11-08T15:37:52","date_gmt":"2022-11-08T14:37:52","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=101126"},"modified":"2022-11-08T15:37:52","modified_gmt":"2022-11-08T14:37:52","slug":"court-convicts-efcc-chairman-abdulrasheed-bawa-for-contempt","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/court-convicts-efcc-chairman-abdulrasheed-bawa-for-contempt\/","title":{"rendered":"Court Convicts EFCC Chairman, Abdulrasheed Bawa For Contempt"},"content":{"rendered":"<div style=\"text-align: justify;\">A High Court of the Federal Capital Territory (FCT) in Maitama has convicted the Chairman of the Economic and Financial Crimes Commission (EFCC) Abdulrasheed Bawa for contempt of court in relation to his agency\u2019s failure to comply with an earlier order of the court.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Justice Chizoba Oji, in a ruling, held that \u201cthe Chairman Economic and Financial Crimes Commission is in contempt of the orders of this honourable court made on November 21st 2018 directing the Economic and Financial Crimes Commission, Abuja to return to the applicant his Range Rover (Super charge) and the sum of N40, 000,000.00 (Forty Million Naira).<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Justice Orji rejected the arguments put forward by the lawyer to the EFCC, Francis Jirbo, to justify his client\u2019s action.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The ruling delivered on October 28, a certified true copy (CTC) of which The Nation sighted in Abuja on Tuesday, was on a motion on notice marked: FCT\/HC\/M\/52\/2021 filed by Air Vice Marshal (AVM) Rufus Adeniyi Ojuawo, a one-time Director of Operations at the Nigerian Air Force (NAF).<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Ojuawo had, in the motion filed by his lawyer, R.N. Ojabo, in a suit marked: FCT\/HC\/CR\/184\/2016 complained that the EFCC declined to comply with the order, for the release of his seized property, made by the court in a judgment delivered on November 21, 2018.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The EFCC had arraigned Ojuawo on a two-count charge before Justice Muawiyah Baba Idris of the High Court of the FCT in Nyanya in 2016.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Idris held that for the charge to succeed, the prosecution must prove that the defendant corruptly accepted the gift; that he accepted or obtained the gift for himself or for any other person.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The judge added that the prosecution also ought to prove that the defendant accepted the gift in the course of, or for discharging his official duty, and that the gift was an inducement or reward.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He held that the burden was on the prosecution to prove all ingredients of the charge preferred against the defendant beyond reasonable doubt as required under Section 131(1) of the Evidence Act, 2011.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cIn conclusion, I hold that the prosecution has failed to prove the two counts charge of corrupt gratification under S17 (1)(a) and (c) of the Corrupt Practices and Other Related Offences Act, 2000.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThe defendant is discharged and acquitted on counts one and two of the charge.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cConsequently, the complainant (EFCC) is ordered to refund the defendant his N40,000,000 wrongly paid into ONSA recovery account and to return to the defendant his Range Rover Sport (Supercharged) forthwith,\u201d Justice Idris said.<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>A High Court of the Federal Capital Territory (FCT) in Maitama has convicted the Chairman of the Economic and Financial Crimes Commission (EFCC) Abdulrasheed Bawa for contempt of court in&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":101127,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[17],"tags":[],"class_list":["post-101126","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-exclusive"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
