{"id":104120,"date":"2023-04-06T21:44:50","date_gmt":"2023-04-06T20:44:50","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=104120"},"modified":"2023-04-06T21:44:50","modified_gmt":"2023-04-06T20:44:50","slug":"court-vacates-order-freezing-abia-govt-bank-accounts","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/court-vacates-order-freezing-abia-govt-bank-accounts\/","title":{"rendered":"Court vacates order freezing Abia Govt bank accounts"},"content":{"rendered":"<div id=\"m#msg-f:1762451252770421433\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\" style=\"text-align: justify;\">A High Court of the Federal Capital Territory, (FCT), has vacated the ex-parte order granted freezing all bank accounts belonging to the Abia State government.<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \" style=\"text-align: justify;\">\n<div class=\"clear\">\n<div dir=\"auto\">\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">Justice Bello Kawu made the order vacating the initial order after listening to arguments by the Attorney General and Commissioner for Justice, Abia State, Chief Uche Ihediwa, SAN who led a team of lawyers for the state government.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The Attorney General had filed two applications for the consideration of the\u00a0 Court.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The state legal team urged the Court to vacate the order because it was made pursuant to a defective affidavit.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The team further stated that the affidavit in support of the ex-parte application which was sworn to at the Federal High Court registry and was used to file a matter at the FCT High Court.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">The Abia Attorney General explained that the issue of filing the application at the Federal High Court registry and filing the application at the FCT High Court makes the entire process look shady and funny.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">According to the Attorney General; &#8220;In law, that is a fundamental defect and the Court agreed that such defect was of such a nature that it affected the entire proceedings. They didn&#8217;t also obtain the leave of the Court to use the affidavit.<\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\">&#8220;Of course, the life span of an ex parte order in law is 7 days.
