{"id":114383,"date":"2024-09-24T04:29:48","date_gmt":"2024-09-24T03:29:48","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=114383"},"modified":"2024-09-24T04:29:48","modified_gmt":"2024-09-24T03:29:48","slug":"court-dismisses-suit-seeking-gandujes-sack-as-apc-chair","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/court-dismisses-suit-seeking-gandujes-sack-as-apc-chair\/","title":{"rendered":"Court dismisses suit seeking Ganduje\u2019s sack as APC chair\u00a0"},"content":{"rendered":"<div id=\"m#msg-f:1811023120944316170\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\" style=\"text-align: justify;\">A Federal High Court, Abuja, on Monday, dismissed the suit seeking the removal of Dr Abdullahi Ganduje as the All Progressives Congress (APC)\u2019d National Chairman.<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \" style=\"text-align: justify;\">\n<div class=\"clear\">\n<div dir=\"auto\">\nJustice Inyang Ekwo, in a judgment, dismissed the suit on the ground that the plaintiff, the North Central APC Forum led by Alhaji Saleh Zazzaga, had no locus to.have instituted the suit.<\/p>\n<p>Justice Ekwo, who held that no credible evidence was presented before the court to show that the group was registered with the Corporate Affairs Commission (CAC), said the name was not known to law.<\/p>\n<p>The judge further held that the group is not a juristic person as the issue brought before the court bordered on the internal affairs of the APC.<\/p>\n<p>He said that the party\u2019s national chairman could only be appointed or removed through a national convention.<\/p>\n<p>However, the group\u2019s lawyer, Ayuba Abdul, in a chat with newsmen, vowed to appeal the judgment.<\/p>\n<p>Also speaking, Zazzaga corroborated Abdul\u2019s position.<\/p>\n<p>\u201cI am not surprised the way the judgment has gone. However, we will appeal the decision,\u201d he said.<\/p>\n<div dir=\"auto\">\nThe plaintiff; the North Central APC Forum, had filed the suit to queried the propriety of Ganduje\u2019s appointment as the Chairman of the APC when he is not from the North Central geo-political zone.<\/p>\n<p>In the suit marked: FHC\/ABJ\/CS\/599\/2024, the plaintiff listed Ganduje, the APC and the Independent National Electoral Commission (INEC) as 1st to 3rd defendants respectively.<\/p>\n<p>The plaintiff asked the court to, among others, restrain Ganduje from further parading himself as the chairman of the APC.<\/p>\n<p>It also prayed the court to issue an order directing INEC not to accord recognition to all actions taken by the APC, including congresses, primaries and nominations, since Ganduje became APC Chairman on August 3, 2023.<\/p>\n<p>The plaintiff is contending among others, that Ganduje is occupying the office of the APC chairman illegally, not being from a state in the North Central geo-political zone.<\/p>\n<p>It argued that the National Executive Committee (NEC) of the APC breached the party\u2019s constitution when it appointed Ganduje, from Kano State in the North West geo- political zone to replace Sen.
