{"id":116617,"date":"2025-03-01T09:30:49","date_gmt":"2025-03-01T08:30:49","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=116617"},"modified":"2025-03-01T09:30:49","modified_gmt":"2025-03-01T08:30:49","slug":"breaking-supreme-court-bars-cbn-from-releasing-funds-to-rivers","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/breaking-supreme-court-bars-cbn-from-releasing-funds-to-rivers\/","title":{"rendered":"BREAKING: Supreme Court bars CBN from releasing funds to Rivers"},"content":{"rendered":"<div dir=\"auto\">The Supreme Court has directed the Central Bank of Nigeria (CBN) to halt the disbursement of funds to the Rivers State Government until a duly constituted House of Assembly is in place.<\/p>\n<p>Additionally, the apex court ordered the House of Assembly, led by Martin Amaewhule, to reconvene immediately with all duly elected members.<\/p>\n<p>The court faulted the Abuja Division of the Court of Appeal for vacating the initial order that stopped the release of funds to Rivers State from the consolidated revenue following the failure of Governor Siminalaye Fubara\u2019s refusal to re-present the 2024 Appropriation Bill of the state before the Hon. Martins Amaewhule-led faction of the Rivers State House of Assembly.<\/p>\n<p>It held that contrary to the verdict of the appellate court, the Federal High Court in Abuja had the requisite jurisdiction to entertain the suit the Amaewhule-led 27 lawmakers filed to challenge the continued withdrawal and expenditure of funds belonging to the state without the approval of the State Assembly.<\/p>\n<p>A five-member panel of the apex court, in its lead judgement that was delivered by Justice Emmanuel Agim, held that the appellate court misapprehended the core issue in dispute when it pegged it on the consolidated revenue of Rivers State alone.<\/p>\n<p>\u201cThis wrong view influenced it to hold that the subject matter was not within the power of the Federal High Court,\u201d the Supreme Court noted, stressing that what was at the center of the case was the refusal of governor Fubara to obey a subsisting court order mandating him to present the Appropriation Bill to the valid Assembly.<\/p>\n<p>It agreed with the high court that the 27 lawmakers that allegedly defected from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC, are still valid members of the Rivers Assembly, pending the final determination of their status.<\/p>\n<p>The Supreme Court dismissed Governor Fubara\u2019s claim that given the defection of the lawmakers, he had to invoke the doctrine of necessity by presenting the Appropriation Bill to the only five remaining members of the Assembly.<\/p>\n<p>According to the court, the doctrine of necessity could not be invoked to justify an illegal action.<\/p>\n<p>The apex court fined Fubara N5 million, saying he destroyed the government because of his fear of being impeached.<\/p>\n<div class=\"yj6qo\"><\/div>\n<div class=\"adL\"><\/div>\n<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has directed the Central Bank of Nigeria (CBN) to halt the disbursement of funds to the Rivers State Government until a duly constituted House of Assembly is&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":116618,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-116617","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
