{"id":121703,"date":"2025-08-28T20:28:33","date_gmt":"2025-08-28T19:28:33","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=121703"},"modified":"2025-08-28T20:28:33","modified_gmt":"2025-08-28T19:28:33","slug":"electoral-act-atiku-seeks-legal-backing-for-electronic-result-transmission","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/electoral-act-atiku-seeks-legal-backing-for-electronic-result-transmission\/","title":{"rendered":"Electoral Act: Atiku seeks legal backing for electronic result transmission"},"content":{"rendered":"<div id=\"m#msg-f:1841724030304534718\" class=\"mail-message expanded\">\n<div id=\"m#msg-f:1841724030304534718-header\" class=\"mail-message-header spacer\" style=\"text-align: justify;\">By Myke Agunwa<\/div>\n<div id=\"m#msg-f:1841724030304534718-content\" class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Former Vice President Atiku Abubakar has called for far-reaching electoral and judicial reforms, including compulsory electronic collation and transmission of election results to ensure electoral integrity, public confidence, and judicial independence.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Wazirin Adamawa commended the enthusiasm of Nigerians in the ongoing Continuous Voters Registration (CVR) exercise, saying that it is indicative of the commitment of citizens to take their destinies in their hands by choosing their leaders in the next election cycle.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He equally advocated that citizens should have a say in the selection of whoeverbecomes the Chairman of the Independent National Electoral Commission (INEC).<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Atiku lamented that over time, the quality of elections has continued to depreciate, with voter turnout at an all-time low during the 2023 elections. \u201cOf the total 93.47 million registered voters, only 24.9 million persons voted in the last presidential and National Assembly elections. This represents a meagre 26.72 per cent voter turnout, the lowest since the return to democracy in 1999,\u201d he lamented.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">According to him, something needs to be done to check this slide if citizens will continue to have an appetite for the democratic processes and the prospects that it holds.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThe issues of BVAS, electronic transmission, and all other associated issues need to be addressed to the extent that they&#8217;re constitutionally provided for in order not to leave it to the whims and caprices of judges,&#8221; he said.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He referenced the warning by Prof. Chidi Odinkalu in his book, &#8220;The Selectorate: When Judges Topple The People,&#8221; saying, judges, &#8220;once constrained arbiters of electoral disputes, have become increasingly unconstrained in determining who holds power \u2014 shifting legitimacy from voters to the courts. In some cases, this influence has extended beyond the courtroom, creating a system where a small, connected elite decides leadership under the cover of legal process.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThe envisaged electoral and judicial reforms will return the power to the people to choose their leaders and not a conclave of interested parties.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Some of the demands put forward by the former number two citizen to ensure that faith is restored in the electoral system include:<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThere should be an amendment in the 2022 Electoral Act, providing for: first, mandatory use of BVAS for accreditation of voters and upload of election results from all the polling units and collation centres across Nigeria without any provision for discretion to the Independent National Electoral Commission (INEC) for manual accreditation of voters.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cSecond, mandatory electronic transmission of election results from the polling units to the iREV without any provision for discretion to the Independent National Electoral Commission for manual transmission of election results.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThird, collation of results at the Ward Collation Centers on the basis of the results already electronically transmitted to the iREV from the polling units without any provision for manual collation of results at the Ward Centres.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cFourth, collation of results at the Local Government or Area Council Collation Centers on the basis of the results already electronically transmitted to the iREV from the Ward Collation Centers without any provision for manual collation of results at the Local Government or Area Council Centers.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cFifth, collation of results at the State Collation Centers on the basis of the results already electronically transmitted to the iREV from the Local Government Collation Centers without any provision for manual collation of results at the State Center.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cSixth, collation of results at the National Collation Center on the basis of the results already electronically transmitted to the iREV from the State Collation Centers without any provision for manual collation of results at the National Council Center.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cSeventh, at no point shall manual accreditation of voters, transmission of results, and collation of results be allowed.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cEight, the position of the Chairman of INEC, Resident Electoral Commissioners, and the National Electoral Commissioners shall be subjected to a democratic voting by the people.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cNinth, INEC to prove substantial compliance with the provisions of the Electoral Act and the Constitution in the conduct of the election in an election petition and not the petitioner\u201d.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Atiku argued that voter registration will be meaningless without these
