{"id":124189,"date":"2025-12-03T19:59:14","date_gmt":"2025-12-03T18:59:14","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=124189"},"modified":"2025-12-03T19:59:14","modified_gmt":"2025-12-03T18:59:14","slug":"senate-seeks-overhaul-of-legal-profession-proposes-mandatory-two-year-pupillage","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/senate-seeks-overhaul-of-legal-profession-proposes-mandatory-two-year-pupillage\/","title":{"rendered":"Senate Seeks Overhaul of Legal Profession, Proposes Mandatory Two-Year Pupillage\u00a0"},"content":{"rendered":"<div style=\"text-align: justify;\">By Lizzy Chirkpi<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Nigerian Senate on Wednesday advanced a major reform of the country\u2019s legal profession, passing into second reading a bill seeking a two-year compulsory pupillage for newly called lawyers, alongside sweeping structural changes to the regulatory framework guiding legal practice.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The bill, which seeks to amend the Legal Practitioners Act (LPA) 2004, also proposes for the first time to formally strengthen the Body of Benchers by granting it corporate legal personality, financial autonomy, and clear rule-making and oversight powers.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Debated extensively at plenary and led by the Leader of the Senate, Senator Opeyemi Bamidele, the legislation aims to modernise Nigeria\u2019s legal profession in line with global best practices observed in countries such as the United Kingdom, Canada, South Africa, and Kenya.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Presiding over the session, Deputy Senate President Barau I. Jibrin endorsed the chamber\u2019s resolve to undertake \u201cholistic reform\u201d of the legal profession. The bill was subsequently referred to the Senate Committee on Judiciary, Human Rights and Legal Matters, with a mandate to conduct a public hearing and report back within two weeks.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">In leading the debate, Bamidele highlighted the urgency of reform, stressing that the current LPA though last updated in 2004 was enacted nearly six decades ago and no longer meets the demands of today\u2019s legal environment.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThe Legal Practitioners Act, 2004, currently in operation, is almost six decades old in context and structure, as it was designed for a legal environment that no longer exists,\u201d he said.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He noted that legal practice has drastically evolved, shaped by technological innovations, digital court processes, complex commercial transactions, cross-border legal issues, and heightened expectations for ethical conduct.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cAccordingly, it is necessary to ensure that our regulatory framework must evolve to meet these new realities,\u201d he added.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Bamidele outlined key reforms proposed in the bill, including overhauling the disciplinary system for lawyers. He emphasised persistent gaps in the current framework, especially the slow and ineffective manner in which professional misconduct is handled.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The bill seeks to restructure the Legal Practitioners Disciplinary Committee (LPDC) by establishing multiple panels across the country, granting clearer powers to sanction erring lawyers including suspension, striking-off, restitution, compensation, and formal apologies and mandating the publication of disciplinary outcomes.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Another structural change is the creation of a new Ethics, Adherence and Enforcement Committee, empowered to inspect law offices, demand documents, investigate public complaints, enforce compliance, and prosecute cases before the LPDC.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cThese innovative initiatives are the major milestones of this Bill, geared toward promoting discipline and restoration of public confidence in the profession,\u201d Bamidele explained.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">A major highlight of the proposed reforms is the introduction of a two-year compulsory pupillage for all newly called lawyers except under approved special conditions alongside mandatory Continuing Professional Development (CPD) as a requirement for renewing practising licences.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Another key proposal is the criminalisation of unauthorised legal practice.\u201cThe bill clearly defines the practice of law and criminalises unauthorized practice, which is essential for the protection of citizens from fraud and abuse,\u201d Bamidele stated.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The legislation also seeks to regulate foreign lawyers, reform the conferment of the rank of Senior Advocate of Nigeria (SAN), and introduce stronger client-protection and financial-safeguard measures.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u2018The Profession Must Reflect the Digital Age\u2019 \u2014 Monguno<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Supporting the bill, Senate Chief Whip, Senator Tahir Monguno, reflected on his over 35 years in legal practice and underscored the need for laws that align with modern realities.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He described the bill as \u201cvery apt and germane,\u201d noting that, \u201cWe are in the digital age, and our legal profession must reflect these realities.\u201d<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Senate\u2019s progression of the bill marks a significant step toward reshaping Nigeria\u2019s legal landscape, pending public consultations and further legislative action.<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>By Lizzy Chirkpi The Nigerian Senate on Wednesday advanced a major reform of the country\u2019s legal profession, passing into second reading a bill seeking a two-year compulsory pupillage for newly&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":89909,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-124189","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
