style=\"text-align: justify;\">An operative of the Economic and Financial Crimes Commission (EFCC), Mr Emmanuel Adide, has told a Lagos State High Court sitting at Tafawa Balewa Square that the Commission was not approached by a Nigerian-American engineer, Anthony Ugbebor, to recover the sum of N152 million allegedly paid for the development of two luxury flats by Oak Homes Limited.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Testifying under cross-examination, Adide maintained that the EFCC is not a debt recovery agency.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He gave the evidence in a suit instituted by property developer Olukayode Olusanya and his firm, Oak Homes Limited (Suit No: LD\/4471LM\/2023), against Ugbebor, the first defendant, over alleged trespass on two second-floor apartments at No. 14A Musa Yar\u2019Adua Street, Victoria Island, Lagos.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">According to the EFCC operative, when the claimant agreed to refund the money, there was no discussion or mutual understanding that the flats would be sold to facilitate the repayment.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Responding to questions on whether the Commission directed the claimant to refund the money, Adide explained that the discussions in question formed part of the EFCC\u2019s internal processes.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He added that it was unclear at the time whether disposal of the flats would be necessary to effect the refund, noting that compelling the sale of property in such circumstances would amount to improper practice.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Adide further explained that once allegations of fraud are made, the EFCC\u2019s standard procedure is to investigate the complaint and, where appropriate, recover funds linked to criminal conduct in the course of its operations.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He told the court that the petition submitted to the EFCC alleged possible criminal breach of trust and obtaining money by false pretence, thereby justifying the Commission\u2019s intervention.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">However, he said the investigation later established that the dispute was civil in nature.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cAs a result, the claimant was contacted and asked to retrieve the bank draft earlier submitted to the EFCC,\u201d he said.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The witness confirmed that Olusanya, the Managing Director of Oak Homes Limited, was detained when he first visited the EFCC headquarters in Abuja.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He also confirmed that Olusanya never denied the existence of a transaction between himself and Ugbebor.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cHe did not deny it, my lord,\u201d Adide said.<\/div>\n<div style=\"text-align: justify;\">When asked whether the refund arrangement was reached while Olusanya was in detention, the witness answered in the negative, stating that Olusanya was already on bail at the time the refund was made.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He said the claimant refunded the money in instalments but could not recall the exact number of tranches.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cAs a result, the claimant was contacted and asked to retrieve the bank draft earlier submitted to the EFCC,\u201d he repeated.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Adide further confirmed that Olusanya submitted three bank drafts to the EFCC, totalling N102 million.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Earlier in the proceedings, counsel to Ugbebor, I.B. Mamood, informed the court that the defence would not be calling any further witnesses.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">\u201cUpon careful review of our case, we have resolved not to call additional witnesses. We are therefore closing our case,\u201d he said.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Following this development, the EFCC, listed as the second defendant, opened its defence.<\/div>\n<div style=\"text-align: justify;\">Its counsel, M.A. Shehu, called Adide as a witness and adopted his witness statement on oath.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The Commission also tendered several documents, including the petition, extra-judicial statements and a letter.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Justice George admitted the documents in evidence and marked them as Exhibits 2DW1, 2DW2 and 2DW3, respectively.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">The court also admitted Adide\u2019s witness statement on oath dated January 17, 2024, as part of the evidence.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">During cross-examination by lead counsel to the first defendant, Nasiru Salau, Adide confirmed that there was no written request from Ugbebor asking the EFCC to recover the money.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">After the testimony, Justice George adjourned the matter until March 23, 2026, for the adoption of final written addresses.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">At the previous sitting, Ugbebor had opened his defence and told the court that he paid for the two luxury flats with his \u201clife savings\u201d totalling $400,000.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">He said he paid N152 million, representing 80 per cent of the total purchase price of N190 million, but that the developer later denied having any record of the transaction.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Ugbebor further testified that on October 11, 2022, he sent a representative to inspect the flats, only for Oak Homes Limited to allegedly state that there was \u201cno record\u201d of his purchase despite the payments.<\/div>\n<div style=\"text-align: justify;\"><\/div>\n<div style=\"text-align: justify;\">Under cross-examination by counsel Agboola, Ugbebor confirmed that he petitioned the EFCC in Abuja after suspecting fraudulent conduct.<\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>By Bayo Davids An operative of the Economic and Financial Crimes Commission (EFCC), Mr Emmanuel Adide, has told a Lagos State High Court sitting at Tafawa Balewa Square that the&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":125158,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"no","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-125156","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
