{"id":127655,"date":"2026-06-16T19:55:59","date_gmt":"2026-06-16T18:55:59","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=127655"},"modified":"2026-06-16T19:55:59","modified_gmt":"2026-06-16T18:55:59","slug":"adc-crisis-judge-refuses-to-recuse-self-from-bala-gombes-suit-fines-mark-aregbesola-n500000-each","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/adc-crisis-judge-refuses-to-recuse-self-from-bala-gombes-suit-fines-mark-aregbesola-n500000-each\/","title":{"rendered":"ADC Crisis: Judge Refuses to Recuse Self from Bala-Gombe&#8217;s Suit, Fines Mark, Aregbesola N500,000 Each"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>By John Azu<\/strong><\/p>\n<p style=\"text-align: justify;\">Justice Peter Lifu of the Federal High Court, Abuja, on Tuesday declined requests by the national chairman and national secretary of the African Democratic Congress (ADC), Senator David Mark and Rauf Aregbesola, to recuse himself from a suit challenging the party&#8217;s leadership.<\/p>\n<p style=\"text-align: justify;\">In a ruling, Justice Lifu dismissed the applications filed by Mark and Aregbesola, describing them as baseless and lacking merit.<\/p>\n<p style=\"text-align: justify;\">The judge held that allegations of bias, prejudice and likelihood of partiality made against him were not supported by any credible or verifiable evidence.<\/p>\n<p style=\"text-align: justify;\">He subsequently awarded costs of N500,000 each against Mark and Aregbesola in favour of the plaintiff, Nafiu Bala-Gombe.<\/p>\n<p style=\"text-align: justify;\">Justice Lifu said the applications were designed to frustrate the speedy hearing of the case, adding that he would not yield to what he described as attempts at intimidation and blackmail.<\/p>\n<p style=\"text-align: justify;\">&#8220;No responsible court of records will dance to the whims and caprices of a litigant. No court must fall to cheap blackmail and intimidation,&#8221; the judge said.<\/p>\n<p style=\"text-align: justify;\">&#8220;As for me, I can never be intimidated or harassed. A judge must be bold, courageous and firm. This is what I stand for. Court exists to do justice and not to do the bidding of any party.&#8221;<\/p>\n<p style=\"text-align: justify;\">The ruling followed objections raised by counsel to the defendants over the status of the suit in light of Justice Lifu&#8217;s judgment delivered a day earlier ordering the deregistration of the ADC and four other political parties.<\/p>\n<p style=\"text-align: justify;\">Counsel to Mark, Dr. Suleiman Usman (SAN); counsel to Aregbesola, Realwan Okpanachi; and Kalu Agu, who appeared for Nkemakolam Ukandu, argued that the court could not continue proceedings involving a political party whose deregistration had already been ordered.<\/p>\n<p style=\"text-align: justify;\">The lawyers urged the court to clarify the legal status of the suit in view of the previous judgment.<\/p>\n<p style=\"text-align: justify;\">Responding, Justice Lifu advised counsel to obtain the Certified True Copy (CTC) of the judgment and study the reasoning behind the decision, maintaining that the two matters were distinct and unrelated.<\/p>\n<p style=\"text-align: justify;\">The suit, marked FHC\/ABJ\/CS\/1819\/2025, was filed by Bala-Gombe, a national officer of the ADC, who is challenging the legality of the party&#8217;s convention and the legitimacy of the officials elected at the exercise.<\/p>\n<p style=\"text-align: justify;\">Among those affected by the suit are Mark and Aregbesola, who recently emerged as national chairman and national secretary of the party following a leadership realignment aimed at strengthening the ADC ahead of the 2027 general elections.<\/p>\n<p style=\"text-align: justify;\">The defendants had asked Justice Lifu to withdraw from the case on grounds of alleged bias, but the court rejected the request and ordered proceedings to continue.<\/p>\n<p style=\"text-align: justify;\">Justice Lifu subsequently adjourned the matter until June 23 for further hearing.<\/p>\n<p style=\"text-align: justify;\">The latest ruling is expected to deepen the controversy surrounding the ADC, which is simultaneously battling legal challenges over its leadership structure and a separate court order directing its deregistration.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>By John Azu Justice Peter Lifu of the Federal High Court, Abuja, on Tuesday declined requests by the national chairman and national secretary of the African Democratic Congress (ADC), Senator&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":122206,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-127655","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
