{"id":127924,"date":"2026-06-25T06:22:48","date_gmt":"2026-06-25T05:22:48","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=127924"},"modified":"2026-06-25T06:22:48","modified_gmt":"2026-06-25T05:22:48","slug":"abia-court-halts-criminal-trial-of-us-returnee-investor-over-poultry-farm-dispute","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/abia-court-halts-criminal-trial-of-us-returnee-investor-over-poultry-farm-dispute\/","title":{"rendered":"Abia Court Halts Criminal Trial of US Returnee Investor Over Poultry Farm Dispute"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>By John Azu<\/strong><\/p>\n<p style=\"text-align: justify;\">An Abia State High Court sitting in Umuahia has restrained a Chief Magistrate Court from proceeding with criminal charges filed against a United States-based retiree and investor, Dr. Elelenta Nwambuisi Elele, pending the determination of a substantive suit challenging the legality of the prosecution.<\/p>\n<p style=\"text-align: justify;\">Justice Chido Nwakanma, in an order dated June 11, 2026, directed Chief Magistrate Juliet Res-Chikezie and the Customary Court sitting in Okpuala, Abia State, to suspend proceedings in Charge No. CC\/13\/MISC\/2026 and Charge No. MIN\/20C\/2026 instituted against Dr. Elele.<\/p>\n<p style=\"text-align: justify;\">The court ordered that all actions in the matter be stayed\u00a0<em>&#8220;pending the hearing and determination of the substantive application.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">Certified true copies of the order were obtained on June 24.<\/p>\n<p style=\"text-align: justify;\">Justice Nwakanma also granted leave for the court processes and the interim order to be served on all respondents through substituted means.<\/p>\n<p style=\"text-align: justify;\">The dispute arose from criminal charges brought against Dr. Elele and Melody Farms Limited over allegations that a poultry farm operated by the company posed environmental and health risks to residents of Ovu Nwambuisi community in Isiala Ngwa South Local Government Area of the state.<\/p>\n<p style=\"text-align: justify;\">Dr. Elele, a retired US Navy civil servant and shareholder in Melody Farms Limited, had returned to Nigeria with his pharmacist wife to establish the agribusiness venture, which he said was aimed at supporting the state&#8217;s drive for increased investment and economic development.<\/p>\n<p style=\"text-align: justify;\">Through his counsel, Barrister Nkemakolam Okoro, the investor approached the High Court challenging the legality of the prosecution and naming as respondents the Isiala Ngwa North Local Government Health Authority, Isiala Ngwa South Local Government Health Authority, Chief Magistrate Juliet Res-Chikezie, the Customary Court of Abia State sitting at Okpuala, Isiahia Eketa, Cyril Ishmael, and Kingsley A. Ishmael, who is listed as prosecutor in the matter.<\/p>\n<p style=\"text-align: justify;\">In the originating summons filed under the Abia State High Court Rules and relevant constitutional provisions, Dr. Elele is asking the court to determine whether the criminal proceedings were validly commenced.<\/p>\n<p style=\"text-align: justify;\">Among other grounds, he contends that the charges were not personally served on him and that there was no court order authorising substituted service as required under the Administration of Criminal Justice Law of Abia State.<\/p>\n<p style=\"text-align: justify;\">He further argues that he is being prosecuted personally for the alleged acts of a registered limited liability company, contrary to established principles of company law.<\/p>\n<p style=\"text-align: justify;\">According to the suit, Melody Farms Limited is a separate legal entity duly incorporated by the Corporate Affairs Commission and cannot be equated with its shareholders or directors.<\/p>\n<p style=\"text-align: justify;\">The applicant also challenges the legal basis of the prosecution, arguing that the Aba Urban Council Building Bye-Laws of 1974, under which part of the charges were allegedly initiated, are not applicable to Isiala Ngwa South Local Government Area.<\/p>\n<p style=\"text-align: justify;\">Dr. Elele further maintains that the poultry farm obtained an Environmental Impact Assessment (EIA) certificate from the Abia State Ministry of Environment before commencing operations and therefore cannot lawfully be shut down on environmental grounds by lower regulatory authorities.<\/p>\n<p style=\"text-align: justify;\">Among the reliefs sought, the investor is asking the court for:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;An order of this honourable court quashing Charge No: CC\/13\/MISC\/2026 before the Customary Court of Abia State, Isialangwa South, between the Medical Officer of Health, V Dr Elelenta Nwambuisi Elele, the principal charge, having been filed under a non-existing law.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">He is also seeking,<em>&#8220;A declaration that by the issuance of the Environmental Impact Assessment Report\/Certificate by the Ministry of Environment, Abia State, pursuant to section 4(1) of the Abia State Basic Environmental Law, the 1st Applicant\u2019s poultry farm is certified, and poses no health, nuisance or environmental risk or challenge to anyone whatsoever, including the Respondents, to warrant the issuance of invitations and abatement notices against the person of the 2nd Applicant, as against the 1st Applicant.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">The applicant further wants the court to declare that efforts by the local government health authorities to close the farm despite the environmental certification amount to illegality and abuse of office.<\/p>\n<p style=\"text-align: justify;\">He is equally seeking a declaration that the poultry farm, being situated in a rural community, falls outside the scope of certain public health regulations cited against it.<\/p>\n<p style=\"text-align: justify;\">In addition, he is asking the court to affirm the separate legal identity of Melody Farms Limited, stating:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;A declaration of this honourable court that the 1st Applicant, being a limited liability company, the owner and operator of the poultry farm in issue in this matter, is separate and distinct from the 2nd Applicant, and is therefore solely responsible for every regulatory approval as it pertains to its farm.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">The case has been adjourned until July 7, 2026, for further proceedings.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>By John Azu An Abia State High Court sitting in Umuahia has restrained a Chief Magistrate Court from proceeding with criminal charges filed against a United States-based retiree and investor,&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":101432,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-127924","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
