{"id":128379,"date":"2026-07-15T18:20:44","date_gmt":"2026-07-15T17:20:44","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=128379"},"modified":"2026-07-15T18:20:44","modified_gmt":"2026-07-15T17:20:44","slug":"appeal-court-judgment-on-adc-convention-sparks-divergent-legal-interpretations","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/appeal-court-judgment-on-adc-convention-sparks-divergent-legal-interpretations\/","title":{"rendered":"Appeal Court Judgment on ADC Convention Sparks Divergent Legal Interpretations"},"content":{"rendered":"<p style=\"text-align: justify;\"><em>By John Azu<\/em><\/p>\n<p style=\"text-align: justify;\">Lawyers have offered differing interpretations of the recent Court of Appeal judgment in Abuja nullifying the April 14 national convention of the African Democratic Congress (ADC), which produced the party&#8217;s National Executive Committee led by former Senate President David Mark.<\/p>\n<p style=\"text-align: justify;\">The three-member panel of justices upheld the decision of the Federal High Court in Abuja restraining the Independent National Electoral Commission (INEC) from recognising or participating in the party&#8217;s state congresses, having found that they were conducted in violation of an earlier court order that prohibited the exercise while the tenure of the duly elected state executives was still subsisting.<\/p>\n<p style=\"text-align: justify;\">The judgment, delivered on Monday, has generated intense debate within political and legal circles over its implications for the ADC&#8217;s participation in the 2027 general elections.<\/p>\n<h3 style=\"text-align: justify;\">Atiku, Abdullahi insist candidates remain unaffected<\/h3>\n<p style=\"text-align: justify;\">Reacting to the judgment, the ADC&#8217;s presidential candidate, Atiku Abubakar, assured party members that the ruling did not invalidate the party&#8217;s presidential primary or other primary elections.<\/p>\n<p style=\"text-align: justify;\">In a statement issued by his Senior Special Assistant on Public Communication, Phrank Shaibu, Atiku urged party faithful to ignore what he described as a coordinated campaign of misinformation.<\/p>\n<blockquote><p>&#8220;The judgment currently being celebrated by some political actors does not amount to a judicial nullification of the ADC&#8217;s primary elections. There is a clear legal distinction between party congresses used to elect executives and statutory primary elections conducted for the nomination of candidates.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Similarly, the party&#8217;s National Publicity Secretary, Bolaji Abdullahi, maintained in a post on X that the ruling had no impact on the emergence of the party&#8217;s candidates.<\/p>\n<blockquote><p>&#8220;The judgement has no effect whatsoever on the direct primaries through which the party&#8217;s candidates have emerged at all levels.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Abdullahi added that the party had already initiated an appeal against the judgment, insisting it was &#8220;legally unsustainable.&#8221;<\/p>\n<h3 style=\"text-align: justify;\">Lawyers warn of possible consequences<\/h3>\n<p style=\"text-align: justify;\">Some legal practitioners, however, warned that unless the judgment is overturned by the Supreme Court, it could have far-reaching consequences for the party&#8217;s participation in the 2027 elections.<\/p>\n<p style=\"text-align: justify;\">Wayne Chikezie Elijah Esq argued that where a court invalidates a political party&#8217;s convention\u2014the foundation upon which subsequent electoral processes are built\u2014it raises serious legal concerns.<\/p>\n<blockquote><p>&#8220;Election process is not just one process; it is a series of events. So, everything done by the ADC amounts to a nullity. So, as it is now, the ADC has no candidates, whether presidential, governorship, House of Reps, all of them. So, they need to go back to the drawing board and revalidate.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">He added:<\/p>\n<blockquote><p>&#8220;If the deadline has passed by that time, it simply means that the ADC is out of the way for next year&#8217;s elections.<\/p><\/blockquote>\n<blockquote><p>&#8220;They have a right to appeal, but I had prophesied that ADC and NDC won&#8217;t be part of next year&#8217;s election.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Hamid Ajibola Jimoh Esq shared a similar view, saying the party should focus on complying with the judgment instead of offering interpretations that contradict the court&#8217;s decision.<\/p>\n<blockquote><p>&#8220;Where the Court of Appeal decision has nullified all the political offices, it means that ADC has no candidate for the 2027 elections.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Offering a different perspective, Ebuka Nwaeze Esq said the legal effect of the judgment would ultimately depend on the outcome of any further appeal.<\/p>\n<p style=\"text-align: justify;\">According to him, if the majority decision of the Court of Appeal is affirmed by the Supreme Court, it should apply to all organs of the party and decisions taken by its National Executive Committee.<\/p>\n<p style=\"text-align: justify;\">However, he noted that the dissenting judgment raised a significant jurisdictional issue.<\/p>\n<blockquote><p>&#8220;What did INEC do wrong? Was the main cause of action against INEC? If a faction of a political party is fighting another for leadership, it is unjusticeable.&#8221;<\/p><\/blockquote>\n<h3 style=\"text-align: justify;\">Court&#8217;s findings<\/h3>\n<p style=\"text-align: justify;\">In the lead judgment delivered by Justice Okon Abang, the Court of Appeal held that the ADC&#8217;s state congresses and national convention were conducted in violation of a subsisting interim injunction issued on April 14. The court also imposed a \u20a610 million cost against the party&#8217;s National Executive Committee.<\/p>\n<p style=\"text-align: justify;\">Justice Abang warned that failure by the courts to intervene in such circumstances could result in &#8220;absolute chaos.&#8221;<\/p>\n<p style=\"text-align: justify;\">The appellate court affirmed the April 29 judgment of Justice Joyce Abdulmalik of the Federal High Court, Abuja, which restrained the David Mark-led National Executive Committee from interfering with the tenure and functions of elected state executives whose tenure was still subsisting under Article 19(7) and (8) of the ADC Constitution.<\/p>\n<p style=\"text-align: justify;\">The suit was instituted by the ADC Chairman in Abia State, Norman Obinna, alongside six other state chairmen, against David Mark, Patricia Akwashiki, Bolaji Abdullahi, Rauf Aregbesola, Oserheimen Osunbor and INEC.<\/p>\n<p style=\"text-align: justify;\">The respondents had argued that the action amounted to forum shopping, contending that issues relating to the Abia State leadership of the party had already been determined by an Abia State High Court sitting in Umuahia in December 2025.<\/p>\n<p style=\"text-align: justify;\">They also challenged the jurisdiction of the Federal High Court, maintaining that the dispute was an internal party affair and that the party&#8217;s internal dispute resolution mechanism had not been exhausted before the suit was filed.<\/p>\n<p style=\"text-align: justify;\">Justice Abang rejected those arguments, holding that the case went beyond the internal affairs of the party because it involved INEC&#8217;s constitutional responsibilities under Section 223(1)(a) of the Constitution regarding the regulation of political parties.<\/p>\n<p style=\"text-align: justify;\">According to the justice, the issues were similar to those resolved by the Supreme Court in\u00a0<em>PDP v. Nwachukwu<\/em>\u00a0and\u00a0<em>PDP v. Sule Lamido<\/em>, where the apex court held that breaches of a party&#8217;s constitution in the conduct of its convention were justiciable.<\/p>\n<blockquote><p>&#8220;My lord, the internal mechanism for the resolution of disputes by a political party can only be invoked and activated when the said matter constitutes an internal affair of the political party,&#8221; he said.<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Justice Abang further held that the National Executive Committee could not challenge the report of the party&#8217;s mediation committee, which had extended the tenure of the state executives, having failed to appeal the findings that endorsed the report.<\/p>\n<blockquote><p>&#8220;My lord, having not appealed against the findings that endorsed the mediation report, which had extended the tenure of the state executive committee members beyond four years, from May 2022 beyond 2026, the appellant (ADC executives) cannot contest or challenge the validity of that report,&#8221; he said.<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Justice Donatus Okorowo concurred with the lead judgment.<\/p>\n<p style=\"text-align: justify;\">In his dissenting opinion, however, Justice Abba Mohammed held that the Federal High Court lacked jurisdiction to entertain the suit, notwithstanding the inclusion of INEC as a defendant.<\/p>\n<p style=\"text-align: justify;\">According to him, the principal dispute related to the internal leadership of the party and ought to have been determined by a State High Court.<\/p>\n<blockquote><p>&#8220;The law, as severally pronounced by the Supreme Court, is that it is the principal reliefs that invokes the jurisdiction of the court,&#8221; he said.<\/p><\/blockquote>\n<p style=\"text-align: justify;\">He added:<\/p>\n<blockquote>\n<p style=\"text-align: justify;\">&#8220;Where a court has no jurisdiction to determine the principal relief, it cannot have jurisdiction over ancillary and consequential claims, especially where, as in this case, the ancillary and consequential claims are inextricably tied to the principal claim.&#8221;<\/p>\n<\/blockquote>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>By John Azu Lawyers have offered differing interpretations of the recent Court of Appeal judgment in Abuja nullifying the April 14 national convention of the African Democratic Congress (ADC), which&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":112201,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"no","_lmt_disable":"","footnotes":""},"categories":[5],"tags":[],"class_list":["post-128379","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
