{"id":128479,"date":"2026-07-18T16:01:52","date_gmt":"2026-07-18T15:01:52","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=128479"},"modified":"2026-07-18T16:01:52","modified_gmt":"2026-07-18T15:01:52","slug":"businesswoman-seeks-committal-of-efcc-chairman-to-prison-over-alleged-disobedience-of-court-order","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/businesswoman-seeks-committal-of-efcc-chairman-to-prison-over-alleged-disobedience-of-court-order\/","title":{"rendered":"Businesswoman Seeks Committal of EFCC Chairman to Prison Over Alleged Disobedience of Court Order"},"content":{"rendered":"<div id=\"1\" class=\"spacer overlay\" style=\"text-align: justify;\"><strong>By John Azu<\/strong><\/div>\n<div id=\"m#msg-f:1871006633434649790\" class=\"mail-message expanded\">\n<div id=\"m#msg-f:1871006633434649790-content\" class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">\n<p style=\"text-align: justify;\">A businesswoman, Hadiza Usman, has approached a Federal High Court in Abuja seeking an order committing the Chairman of the Economic and Financial Crimes Commission (EFCC), Ola Olukoyede, to prison for alleged disobedience of a subsisting court judgment.<\/p>\n<p style=\"text-align: justify;\">The application, filed through her counsel, Nkem Okoro, is brought pursuant to Order 35 Rule 28 of the Federal High Court (Civil Procedure) Rules, 2019.<\/p>\n<p style=\"text-align: justify;\">Usman is asking the court to commit the EFCC chairman to prison until the commission complies with the judgment delivered on April 20 in her fundamental rights enforcement suit.<\/p>\n<p style=\"text-align: justify;\">The dispute arose from a series of business transactions between Usman and one of her customers, Dr. Halima Alfa, involving jewellery, gold wristwatches, clothing and monetary loans.<\/p>\n<p style=\"text-align: justify;\">According to court documents, the disagreement led to the invasion of Usman&#8217;s residence by EFCC operatives, the seizure of items allegedly worth N800 million, her detention and subsequent prosecution despite what she claims was a subsisting court order.<\/p>\n<p style=\"text-align: justify;\">In an affidavit deposed to by Susan Nwaze, counsel to the applicant, Usman contended that the Federal High Court had, in its April 20 judgment, held that the matter was purely civil in nature and fell outside the investigative mandate of the anti-graft agency.<\/p>\n<p style=\"text-align: justify;\">Quoting from the judgment, the affidavit stated:<\/p>\n<blockquote><p>&#8220;From the totality of evidence in the instant case, this is not the type of case the EFCC should get involved in. The applicant and the 2nd respondent both agree that they have been involved in business transactions of buying gold, wristwatches, clothes and loaning each other monies, which did not, in my considered view, involve any kind of financial crime or fraud or criminality. In the circumstances, there is therefore no basis for the involvement of the 1st respondent (EFCC) in this matter.&#8221;<\/p><\/blockquote>\n<p style=\"text-align: justify;\">Usman further alleged that although the court directed the EFCC to issue her a public apology, the commission has failed to comply with that aspect of the judgment.<\/p>\n<p style=\"text-align: justify;\">Instead, she claimed, the EFCC retained her international passport and proceeded to arraign her before the High Court of the Federal Capital Territory, presided over by Justice S. U. Bature.<\/p>\n<p style=\"text-align: justify;\">According to the affidavit, the prosecution is based on &#8220;an issue that is purely civil-related.&#8221;<\/p>\n<p style=\"text-align: justify;\">The court is expected to fix a date for the hearing of the committal application.
