The House of Representatives Ad-Hoc Committee investigating the alleged establishment and operations of the Presidential Foreign Investment Promotion Council (PFIPC) has issued a final ultimatum to Ministries, Departments and Agencies (MDAs) that have failed to honour its invitations, warning that continued non-compliance will attract constitutional and legal sanctions.<\/p>\n

The warning comes as the House intensifies its investigation into the circumstances surrounding the alleged establishment of the PFIPC, with lawmakers seeking to determine whether the organisation was lawfully constituted and whether any public institution facilitated its activities outside the framework of the law.<\/p>\n

In a statement issued on Tuesday, Chairman of the committee, Yusuf Gagdi, expressed disappointment over the failure of some government agencies to appear before the panel, describing the development as a direct challenge to the constitutional oversight powers of the National Assembly.<\/p>\n

He said the refusal of the affected agencies to honour the committee’s invitations was undermining an investigation instituted in the public interest to establish the facts surrounding the controversial council.<\/p>\n

According to the statement,\u00a0“The Committee views this conduct as a serious affront to the constitutional oversight powers of the House of Representatives and an unacceptable disregard for the authority of the Parliament, which represents the sovereign will of the Nigerian people.”<\/strong><\/p>\n

The committee reminded the defaulting agencies that its invitations were issued pursuant to Sections 88 and 89 of the 1999 Constitution (as amended), which empower the National Assembly to investigate matters relating to public administration and ensure accountability in the management of public institutions.<\/p>\n

It stressed that compliance with legislative summons is a constitutional obligation.<\/p>\n

“It must be clearly understood that invitations issued by a duly constituted Committee of the House of Representatives are not matters of discretion. They are issued pursuant to the constitutional powers vested in the National Assembly under Sections 88 and 89 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended). Compliance is therefore a legal obligation, not an act of courtesy,”<\/strong>\u00a0the statement said.<\/p>\n

The committee directed all defaulting MDAs to appear before it on Thursday with the relevant officials and documents earlier requested.<\/p>\n

It described the scheduled hearing as the final opportunity for the agencies to comply voluntarily with the committee’s directives.<\/p>\n

“Accordingly, the Committee hereby issues this as the final notice to all defaulting Ministries, Departments and Agencies. They are directed to appear before the Committee on Thursday with all relevant officers and documents requested in the Committee’s correspondence.<\/strong><\/p>\n

“Let there be no misunderstanding: Thursday is the final opportunity for every defaulting agency to comply voluntarily with the lawful directives of this Committee.”<\/strong><\/p>\n

The panel warned that any agency that fails to appear without lawful justification would compel the House to invoke its constitutional and statutory powers to enforce compliance.<\/p>\n

It added that it would not hesitate to recommend sanctions against any institution or public official found to have deliberately obstructed or frustrated the investigation.<\/p>\n

“Any Ministry, Department or Agency that fails to appear without lawful justification will leave the Committee with no alternative but to invoke every constitutional and statutory power available to the House of Representatives to compel compliance and ensure accountability.<\/strong><\/p>\n

“The Committee will not hesitate to recommend and pursue every sanction permitted by law against any person or institution that deliberately obstructs or frustrates this investigation.”<\/strong><\/p>\n

Gagdi maintained that the investigation was not intended to witch-hunt any individual or institution but to establish the facts surrounding the PFIPC and uphold the integrity of public administration.<\/p>\n

He said,\u00a0“This investigation is in the national interest. It is not targeted at any individual or institution but is aimed at establishing the facts, protecting the integrity of public administration, safeguarding the rule of law, and ensuring that no public office or institution operates outside the framework of the Constitution and the laws of the Federal Republic of Nigeria.”<\/strong><\/p>\n

The committee also reaffirmed its commitment to conducting the investigation professionally, fairly and transparently.<\/p>\n

According to the statement,\u00a0“The Committee remains committed to conducting this assignment professionally, fairly, transparently and without fear or favour. However, no agency of government, regardless of its status or perceived influence, will be permitted to undermine the constitutional authority of the House of Representatives or frustrate the discharge of its legislative responsibilities.”<\/strong><\/p>\n

The panel urged all affected institutions to treat the directive with the seriousness it deserves and appear before it as scheduled.<\/p>\n

The ad hoc committee was constituted by the House to investigate the activities of the Presidential Foreign Investment Promotion Council following concerns over its legal status and allegations that individuals associated with the organisation held themselves out as representatives of the Presidency in dealings with prospective investors.<\/p>\n

During earlier hearings, the Federal Ministry of Foreign Affairs told lawmakers it neither recognised the council nor had any official dealings with its alleged Director-General, Prince Adeniyi Adeyemi.<\/p>\n

The ministry also disclosed that the Office of the National Security Adviser had informed it that both the council and its alleged chief executive were unknown to the Federal Government.
