{"id":128610,"date":"2026-07-25T22:59:25","date_gmt":"2026-07-25T21:59:25","guid":{"rendered":"https:\/\/pointblanknews.com\/pbn\/?p=128610"},"modified":"2026-07-25T22:59:25","modified_gmt":"2026-07-25T21:59:25","slug":"appellate-court-dismisses-cosons-appeal-upholds-nccs-position","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/appellate-court-dismisses-cosons-appeal-upholds-nccs-position\/","title":{"rendered":"Appellate Court\u00a0 Dismisses COSON&#8217;s Appeal, Upholds NCC&#8217;s Position"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>By John Azu<\/strong><\/p>\n<p style=\"text-align: justify;\">The Court of Appeal in Lagos has dismissed an interlocutory appeal filed by the Copyright Society of Nigeria Ltd\/Gte (COSON) against the Nigerian Copyright Commission (NCC), affirming an earlier decision of the Federal High Court.<\/p>\n<p style=\"text-align: justify;\">In a unanimous judgment delivered by a three-member panel comprising Justices Polycarp Terna Kwahar, Folasade Ayodeji Ojo, and Muslim Sule Hassan, the appellate court held that the appeal lacked merit and awarded costs of\u00a0<strong>N200,000<\/strong>\u00a0against COSON.<\/p>\n<p style=\"text-align: justify;\">Although the judgment was delivered on\u00a0<strong>July 9<\/strong>, it was made available to journalists by the NCC on\u00a0<strong>July 25<\/strong>.<\/p>\n<p style=\"text-align: justify;\">The ruling upholds the Federal High Court&#8217;s refusal to grant an interlocutory injunction sought by COSON to restrain the Commission.<\/p>\n<p style=\"text-align: justify;\">In dismissing the appeal, the Court of Appeal resolved the sole issue in favour of the NCC, holding that there was no valid or subsisting operating approval for the lower court to preserve through an injunction.<\/p>\n<p style=\"text-align: justify;\">Delivering the lead judgment, Justice Kwahar stated:<\/p>\n<blockquote><p>&#8220;Both the Appellant and the Respondent have demonstrated, through their affidavit evidence, that the Appellant&#8217;s operations had, prior to the commencement of the suit, become inoperative by virtue of the suspension of the Appellant&#8217;s licence and its expiration by effluxion of time.
