The Appellants further state that the names and addresses of those directly affected by the appeal are set out in paragraph 5.<\/p>\n<p><b>2.\u00a0\u00a0\u00a0\u00a0 PART OF THE DECISION COMPLAINED OF<\/b><\/p>\n<p align=\"center\">&#8220;THE WHOLE DECISION&#8221;<\/p>\n<p><b>3.\u00a0\u00a0\u00a0\u00a0 GROUNDS OF APPEAL<br \/>\nGROUND 1<\/b><\/p>\n<p><b>ERROR IN LAW<\/b><\/p>\n<p>The\u00a0 learned\u00a0\u00a0 trial\u00a0\u00a0 judge\u00a0 erred\u00a0\u00a0 in\u00a0\u00a0 law\u00a0 when\u00a0\u00a0 he\u00a0\u00a0 dismissed\u00a0 the\u00a0 Appellants&#8217;<\/p>\n<p>Preliminary. Objection on grounds that the suit was not incompetent.<\/p>\n<p><b>PARTICULARS OF ERROR<\/b><\/p>\n<p>a) The Learned trial judge did not advert his mind to the provisions of section 4 of the 1 999 constitution of the Federal Republic of Nigeria 1999 (as amended)<\/p>\n<p>b.) The Learned trial judge failed to reckon his mind with the provisions of Section 60 of the 1999 Constitution of the Federal Republic of Nigeria 1999 (as amended).<\/p>\n<p>c) The learned trial judge failed to follow the decisions in the cases of ATTORNEY GENERAL, FEDERATION and 22 others (1992) 3 NWLR 1 NCLR at 156 (2001) FWLR (Pt.65) 448, INAKOGU VS. ADELEKE (2007) All FWLR (Pt.353) page 143 &#8211; 1 44 paras H &#8211; B, ANUKWU VS. EZE (201 2) 2 NWLR (pt.1310) at page 53.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>d) The learned trial judge erred when he refused to hold that the 1st Respondent does not have the locus standi to institute this suit.<\/p>\n<p>e)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge erred when he granted the reliefs of the 1st Respondent and went further to hold that the 1st &#8211; 39th Respondents ought to have resigned their seats as members of the 1st Appellant.<\/p>\n<p>f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The 1st Respondent suit was predicated upon speculation.<\/p>\n<p>g)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The reliefs sought are not justiciable; unknown to law and do not disclose any cause of action against the Appellants.<\/p>\n<p>GROUND 2<\/p>\n<p>ERROR IN LAW<\/p>\n<p>The Learned trial Judge erred in law when he held that the commencement of this suit via an originating summons was right and proper.<\/p>\n<p>PARTICULARS OF ERROR<\/p>\n<p>a)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge did not reckon with the provision of Order 3 Rule 6 of the Federal High Court Civil procedure Rules 2009.<\/p>\n<p>b)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge erred when he refused to be bound by the case of BALONWE VS. OBI (2007) 5 NWLR (pt. 1028) 488 CA, FAGBOLA VS. T1T1LAYO PLAST. IND. LTD (2005) 2 NWLR<\/p>\n<p><b>(Pt. 909) 1 At. 19 Paroi A &#8211; B, AJAGUNGBADE (!!!) Vs. ADEYEKU (II) (2001)16 NWLR (PT.783) 126 CA, UGWU VS. ARARAUME (2007) All FWLR (Pt.377) page 883 paras <i>D-E.<\/i><\/b><\/p>\n<p>c)\u00a0\u00a0\u00a0\u00a0 The learned trial judge did not advert his mind to the conflict with respect to the 1<sup>st<\/sup> Respondent Affidavit which would have required the 1<sup>s+ <\/sup>Respondent&#8217;s testimony to be tested and proven during cross examination.<\/p>\n<p>d)\u00a0\u00a0 The learned trial judge did not advert his mind to the fact that the Respondent&#8217;s Suit ought to have been struck out when same was filed by an originating summons.<\/p>\n<p>e)\u00a0\u00a0\u00a0\u00a0 The 1<sup>st<\/sup> Respondent suit is contentious and same can only be properly determined by way of, Writ of Summons, yet the judge went ahead to entertain the suit<\/p>\n<p><b>GROUND 3<\/b><\/p>\n<p><b>ERROR IN LAW<\/b><\/p>\n<p>The Learned trial judge erred when he held that the reliefs of the <i>1<sup>st <\/sup><\/i>Respondent where justiciable and went ahead to make pronouncement on the reliefs sought by the ]<sup>5t<\/sup> Respondent.<\/p>\n<p align=\"center\"><b>PARTICULARS OF ERROR<\/b><\/p>\n<p>a) The learned trial judge erred in law when he failed to follow the decisions in IBRAHIM VS.
