In view of the judgment\/ruling of the Court in the above suit delivered by Justice Adeniola, on the 31st<\/sup> of March, <\/i>2014, <\/b>our clients; instructed us to proceed with an appeal.<\/p>\n

Consequently, we, filed a Notice of Appeal dated 1st<\/sup> of April, 2014 <\/b>challenging the judgment of the court in the above suit.<\/p>\n

It is trite in law that once an <\/i>appeals filed in a particular suit, all matters relating to or pertaining to the said judgement must wait for the outcome in <\/i>the said matter.<\/p>\n

ERROR IN LAW<\/b><\/p>\n

The\u00a0 learned\u00a0\u00a0 trial\u00a0\u00a0 judge\u00a0 erred\u00a0\u00a0 in\u00a0\u00a0 law\u00a0 when\u00a0\u00a0 he\u00a0\u00a0 dismissed\u00a0 the\u00a0 Appellants’<\/p>\n

Preliminary. Objection on grounds that the suit was not incompetent.<\/p>\n

PARTICULARS OF ERROR<\/b><\/p>\n

a) The Learned trial judge did not advert his mind to the provisions of section 4 of the 1 999 constitution of the Federal Republic of Nigeria 1999 (as amended)<\/p>\n

b.) The Learned trial judge failed to reckon his mind with the provisions of Section 60 of the 1999 Constitution of the Federal Republic of Nigeria 1999 (as amended).<\/p>\n

c) The learned trial judge failed to follow the decisions in the cases of ATTORNEY GENERAL, FEDERATION and 22 others (1992) 3 NWLR 1 NCLR at 156 (2001) FWLR (Pt.65) 448, INAKOGU VS. ADELEKE (2007) All FWLR (Pt.353) page 143 – 1 44 paras H – B, ANUKWU VS. EZE (201 2) 2 NWLR (pt.1310) at page 53.<\/p>\n

d) The learned trial judge erred when he refused to hold that the 1st Respondent does not have the locus standi to institute this suit.<\/p>\n

e)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge erred when he granted the reliefs of the 1st Respondent and went further to hold that the 1st – 39th Respondents ought to have resigned their seats as members of the 1st Appellant.<\/p>\n

f)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The 1st Respondent suit was predicated upon speculation.<\/p>\n

g)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The reliefs sought are not justiciable; unknown to law and do not disclose any cause of action against the Appellants.<\/p>\n

GROUND 2<\/p>\n

ERROR IN LAW<\/p>\n

The Learned trial Judge erred in law when he held that the commencement of this suit via an originating summons was right and proper.<\/p>\n

PARTICULARS OF ERROR<\/p>\n

a)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge did not reckon with the provision of Order 3 Rule 6 of the Federal High Court Civil procedure Rules 2009.<\/p>\n

b)\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The learned trial judge erred when he refused to be bound by the case of BALONWE VS. OBI (2007) 5 NWLR (pt. 1028) 488 CA, FAGBOLA VS. T1T1LAYO PLAST. IND. LTD (2005) 2 NWLR<\/p>\n

(Pt. 909) 1 At. 19 Paroi A – B, AJAGUNGBADE (!!!) Vs. ADEYEKU (II) (2001)16 NWLR (PT.783) 126 CA, UGWU VS. ARARAUME (2007) All FWLR (Pt.377) page 883 paras D-E.<\/i><\/b><\/p>\n

c)\u00a0\u00a0\u00a0\u00a0 The learned trial judge did not advert his mind to the conflict with respect to the 1st<\/sup> Respondent Affidavit which would have required the 1s+ <\/sup>Respondent’s testimony to be tested and proven during cross examination.<\/p>\n

d)\u00a0\u00a0 The learned trial judge did not advert his mind to the fact that the Respondent’s Suit ought to have been struck out when same was filed by an originating summons.<\/p>\n

e)\u00a0\u00a0\u00a0\u00a0 The 1st<\/sup> Respondent suit is contentious and same can only be properly determined by way of, Writ of Summons, yet the judge went ahead to entertain the suit<\/p>\n

GROUND 3<\/b><\/p>\n

ERROR IN LAW<\/b><\/p>\n

The Learned trial judge erred when he held that the reliefs of the 1st <\/sup><\/i>Respondent where justiciable and went ahead to make pronouncement on the reliefs sought by the ]5t<\/sup> Respondent.<\/p>\n

PARTICULARS OF ERROR<\/b><\/p>\n

a) The learned trial judge erred in law when he failed to follow the decisions in IBRAHIM VS. GAYE (2002) 13 NWLR (Pt.783) page 296 paras C – F, HON. EDWIN UME – EZOKE VS. ALHAJi ISA ALIYU MAKAF1 (1982) 3 NCLR at page 674, <\/i>N.N.B Pic VS. OSOR (2001) 13 NWLR<\/p>\n

(Pt.729) page 250 paras E – G, 1NAKOGU VS. ADELEKE (2007) All FWLR (Pt. 353) page 143-144 Paras H – B.<\/p>\n

b)\u00a0\u00a0\u00a0 By Section 30 of the Legislative Houses (powers and privilege) Act Cap LI 2 LFN 2004; Neither the President or the Speaker as the case may be, of a Legislative House shall be subject io <\/i>the jurisdiction of any Court in respect of the Exercise of any Power conferred on or vested in him by or lender this Act or the standing orders of the Legislative House, or by the Constitution.<\/p>\n

c)\u00a0\u00a0\u00a0 The Judgement of the trial judge is perverse.<\/p>\n

d)\u00a0\u00a0\u00a0 The judgement of the Court is not supported by the Relief sought by the plaintiffs.<\/p>\n

e)\u00a0\u00a0\u00a0 The trial judge erred in law when he granted reliefs not sought by the plaintiff.<\/p>\n

GROUND 4<\/b><\/p>\n

The Learned trial judge erred in law when he held that the claims of the 1st<\/sup> Respondent do not amount to an abuse of Court process.<\/p>\n

a) The Learned trial judge did not reckon with the case of UMEH VS. 1WU (2008) Ail FWLR (PU18) 362 at 393, CHRISTIAN OUTREACH MINISTRIES INC & 2 ORS VS. COBHAM & ORS (2006) 15 NWLR (PU002) at 283, SEVE UP BOTTLING COY. LTD VS. ABILITY AND SONS BOTTLING CO. LTD (1996) 7 NWLR (Pt.75) 156 at 177.<\/p>\n

b)\u00a0\u00a0 The learned trial judge failed to reckon with the
\nsubsistence of suit No: FHC\/ABJ\/CS\/621\/2013
\nBetween Senator Beilo Hayatu Gwarzo and
\n79 others VS.\u00a0 Aihaji Bamanga <\/b>Tukur and 4<\/p>\n

others which is in ali fours with this instant suit.<\/p>\n

c)\u00a0\u00a0 The subject matter of this suit, the parties and the
\nreliefs sought for in Suit No; FHC\/ABJ\/CS\/4\/14
\nand Suit No: FHC\/ABJ\/CS\/621\/2013 between
\nBeilo Hayatu Gwarzo and 79 others Vs. Aihaji
\nBamanga Tukur and 4 others <\/b>are the same.<\/p>\n

GROUND 5<\/b><\/p>\n

The Learned Trial Judge lacks the jurisdiction to entertain this suit.<\/p>\n

PARTICULARS OF ERROR<\/span><\/b><\/p>\n

a)\u00a0\u00a0 The suit is predicated on internal affairs of the
\nHouse\u00a0\u00a0 of\u00a0\u00a0 Representatives\u00a0\u00a0 which\u00a0\u00a0 is\u00a0\u00a0\u00a0 protected<\/p>\n

, under Section 60 of the 1 999 Constitution.<\/p>\n

b)\u00a0\u00a0 The reliefs sought for are not justiciable yet the
\ntrial judge granted the reliefs sought for by the
\n1st<\/sup> Respondent<\/p>\n

GROUND 6<\/b><\/p>\n

The plaintiff\/1st<\/sup> Respondent lacked the locus standi to institute the suit.<\/p>\n

PARTICULARS OF ERROR<\/span><\/b><\/p>\n

a)\u00a0\u00a0 The plaintiff action is not predicated on any recognized legal interest.<\/p>\n

b)\u00a0\u00a0 The reliefs sought ore <\/i>not supported by any legal evidence.<\/p>\n
