Power outage at the Federal High Court Complex in Ikoyi, Lagos, on Friday,
\nstalled hearing in a suit filed by suspended Central Bank Governor, Sanusi
\nLamido Sanusi.<\/p>\n
Sanusi is seeking an order of the court to stop the Financial Reporting
\nCouncil of Nigeria (FRCN) from investigating him.<\/p>\n
The trial judge, Justice James Tsoho, therefore, adjourned the case to
\nApril 17, for hearing.
\nThe court, following persistent cuts in public power supply, had relied
\nsolely on generating sets.<\/p>\n
The generators could, however, not supply power to the 10 courtrooms, a
\nsituation that forced several courts to adjourn cases earlier listed for
\nhearing.<\/p>\n
The counsels to the plaintiff and defendants were in court.<\/p>\n
Sanusi had filed the suit through his counsel, Mr Kola Awodehin (SAN),
\nseeking a declaration that the conduct of FRCN, actions and decision is
\nultra vires.<\/p>\n
Other prayers include: \u201cA declaration that the defendant\u2019s recommendation
\nregarding the plaintiff in briefing note dated June 7, 2013, that he be
\nremoved from office as CBN of Governor, were ultra vires under the FRCN
\nAct 2011.<\/p>\n
\u201cA declaration that the proposed investigation as advertised in the Punch
\nnewspaper of March 24, in the circumstance of having reached a conclusion
\nin the briefing note of June 2013, before embarking on the investigation,
\nis tantamount to a breach of natural justice.<\/p>\n
\u201cA declaration that the defendant do not have the power to conduct
\ninvestigation as advertised in the newspaper.\u201d<\/p>\n
Sanusi also sought for an order restraining the defendants or their
\nprivies, under its authority, or pursuant to the FRCN Act, from conducting
\nand continuing with any investigation or inquiry as advertised.<\/p>\n
He also asked the court to order the setting aside or nullification of any
\nreport, conclusion or recommendation, based on any investigation conducted
\nby FRCN, as advertised in the Punch Newspaper.<\/p>\n
The defence had filed a preliminary objection challenging the jurisdiction
\nof the court to hear the suit.<\/p>\n
The trial judge had ruled that he would hear the defendant\u2019s objection and
\nthe plaintiff\u2019s motion together.<\/p>\n
Tsoho had ordered that the status quo as at the time of instituting the
