{"id":31117,"date":"2014-09-11T16:25:13","date_gmt":"2014-09-11T15:25:13","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=31117"},"modified":"2014-09-11T16:25:13","modified_gmt":"2014-09-11T15:25:13","slug":"tribunal-grants-omisore-order-substituted-service-aregbesola","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/tribunal-grants-omisore-order-substituted-service-aregbesola\/","title":{"rendered":"Tribunal grants Omisore order of substituted service on Aregbesola"},"content":{"rendered":"<div id=\"main\" style=\"color: #000000;\">\n<div id=\"paneshell\">\n<div id=\"shellcontent\" class=\" no-tabs\">\n<div id=\"shellinner\">\n<div id=\"yui_3_16_0_1_1410423560832_59448\" class=\"tab-content\" data-tid=\"yui_3_16_0_1_1410423560832_59426\" data-title=\"News\">\n<div id=\"yui_3_16_0_1_1410423560832_59454\" class=\"messagepane basepane \" style=\"color: #000000;\" tabindex=\"0\" title=\"Message pane\">\n<div id=\"yui_3_16_0_1_1410423560832_59450\" class=\"message content\">\n<div id=\"yui_3_16_0_1_1410423560832_59549\" class=\"base-card \">\n<div id=\"yui_3_16_0_1_1410423560832_59607\" class=\"base-card-body\">\n<div id=\"yui_3_16_0_1_1410423560832_59550\" class=\"msg-body inner  undoreset\" tabindex=\"0\">\n<div id=\"yiv9908951174\">\n<div id=\"yui_3_16_0_1_1410423560832_59609\">\n<div id=\"yui_3_16_0_1_1410423560832_59610\" style=\"text-align: justify;\">The Election Petitions Tribunal hearing the petitions arising from the Osun State governorship \u00a0election has granted the Peoples Democratic Party governorship candidate, Senator Iyiola Omisore, the permission to paste the notice of the tribunal on the walls of Government House, Osogbo and the Governor\u2019s Office.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59618\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59619\" style=\"text-align: justify;\">The chairman of the tribunal, Justice Suleiman Ambrusa, gave the order on Thursday.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59620\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59621\" style=\"text-align: justify;\">He said having \u00a0considered the \u00a0application of the petitioner\u2019s counsel, Mr. Afolabi Fashanu, \u00a0the respondent should be served a copy of the petition by pasting same on the walls of the Government House and Governor\u2019s Office at the state secretariat.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59622\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59623\" style=\"text-align: justify;\">The petitioner had prayed the tribunal for an order of substituted service following an allegation that security agents did not allow the bailiff \u00a0to serve the governor.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59624\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59625\" style=\"text-align: justify;\">The chairman of the tribunal said that evading service would not be an excuse for not serving the respondent because the case should not be one-sided.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59635\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59626\" style=\"text-align: justify;\">But Aregbesola\u2019s counsel, Mr. Kunle Adegoke, asked the tribunal chairman to disqualify himself from the petition because of a petition written to the National Judicial Council.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59627\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59628\" style=\"text-align: justify;\">Adegoke said, \u201cThere are certain fundamental issues that must be addressed in the petition against you at the NJC. If a party is expressing lack of confidence in a judge, the requirement is that such judge should step aside from handling the case.\u201d<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59629\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59634\" style=\"text-align: justify;\">But Ambrusa said that he could not be stampeded into stepping aside from sitting on the panel because it was only the NJC which could ask him to step down.<\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59633\" style=\"text-align: justify;\"><\/div>\n<div id=\"yui_3_16_0_1_1410423560832_59632\" style=\"text-align: justify;\">He said, \u201d I am ready to step down. I didn\u2019t put myself here. I have not seen the copy of the petition against me. There should be a decorum.
