{"id":32530,"date":"2014-10-26T19:53:53","date_gmt":"2014-10-26T18:53:53","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=32530"},"modified":"2014-10-26T19:53:53","modified_gmt":"2014-10-26T18:53:53","slug":"ghana-moves-sack-nigerian-traders","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/ghana-moves-sack-nigerian-traders\/","title":{"rendered":"Ghana Moves To Sack Nigerian Traders"},"content":{"rendered":"<p><span style=\"color: #000000;\">Effective November 2014, non-Ghanaians illegally undertaking retail<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">business will be arrested and put before special courts for prosecution.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">This is the outcome of interaction between Dr Spio Garbrah, Trade<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Minister, and Mrs. Georgina Wood, Chief Justice, on the rumpus in the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">country\u2019s retail trade sector.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The Ghana Investment Promotion Council (GIPC) Act 865, which came into<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">effect in 2013, has been met with mixed feelings by locals and non-locals.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The locals, led by the Ghana Union of Traders Association (GUTA) see it as<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">\u201ca Daniel come to judgment\u201d (apologies to The Merchant Of Venice) while<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">foreign traders, especially Nigerians, perceive it as a stumbling block on<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">which they must overleap or fall.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The Law does not forbid foreigners from trading in Ghana but they are not<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">expected to partake in petty trading at designated markets. It also allows<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">non-locals to trade in Ghana provided they have one million US dollars in<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">cash or goods, to be ascertained by customs clearance forms or certified<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">by the country\u2019s central bank and additionally, employs 20 Ghanaians.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Though the legislation aims at preserving the retail trade for the local<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">people to the exclusion of all foreigners, Nigerian traders in the country<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">see it as a measure meant to flush them out of business.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The crux of the misunderstanding is against the background that most of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">the over 10,000 Nigerians could not meet the former criteria of 300,000 US<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">dollars, how much more the upgraded one million US dollars?<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">To GUTA, the large numbers of Nigerian traders in the country\u2019s markets is<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">a complete take over of the retail business which is a total preserve of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">locals, and if the move is left unchecked would deprive Ghanaian traders<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">of their livelihood.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">But do one blame the foreigner for the woes of the locals? In a lot of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">instances the non-Ghanaians carry out their operations with the consent of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Ghanaians who front for them in the market centres.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Interestingly, the Nigerian traders have not sat down idly bemoaning their<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">fate while the saga of the GIPC Law rages on \u2013 they have combined legal<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">process with diplomacy to stifle the operations of the Law.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The ECOWAS Community Court of Justice, last year, dismissed a case brought<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">against Ghana by some Nigerian traders plying their trade in the country.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The group led by the National Association of Nigerian Traders (NANTS) and<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">the Nigerian Union of Traders Association in Ghana (NUTAG) petitioned the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Court over the new GIPC Law revised in July, 2013, which among others<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">specifies the criteria foreigners will have to meet in order to engage in<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">business activities in Ghana.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Ghana argued that the Law was necessary to protect domestic interests and<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">could not have been said to violate any ECOWAS protocol.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Ruling, the Sub-Regional Court rejected the position of the traders that<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">sections of the new GIPC Act that bar foreigners from engaging in retail<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">trade in the Ghanaian markets are in violation of the ECOWAS Protocol on<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">free movement of people and goods.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Now that special courts are to be set up for the prosecution of foreigners<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">illegally engaged in the retail trade and their local front men, the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Nigerian Community is calling for a dialogue to resolve the issue.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Effective November 2014, non-Ghanaians illegally undertaking retailbusiness will be arrested and put before special courts for prosecution.This is the outcome of interaction between Dr Spio Garbrah, TradeMinister, and Mrs. Georgina&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":32531,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[17],"tags":[],"class_list":["post-32530","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-exclusive"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
