{"id":36964,"date":"2015-03-22T13:22:03","date_gmt":"2015-03-22T12:22:03","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=36964"},"modified":"2015-03-22T17:35:23","modified_gmt":"2015-03-22T16:35:23","slug":"buhari-certificate-saga-fear-grips-apc-as-court-orders-accelerated-hearing","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/buhari-certificate-saga-fear-grips-apc-as-court-orders-accelerated-hearing\/","title":{"rendered":"Buhari Certificate Saga: Fear Grips APC As Court Orders Accelerated Hearing"},"content":{"rendered":"<p><span style=\"color: #000000;\">There is tension in the opposition All Progressives Congress as a Federal<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">High Court in Abuja, presided over by Justice Abdu Kafarati, has given an<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">order for accelerated hearing in a suit brought by a non-governmental<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">organization, Global Center for Conscious Living Against Corruption,<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">asking for an order of mandamus to compel the Inspector General of Police<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">to investigate allegations of forgery and perjury against the party\u2019s<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">presidential candidate, Gen Muhammadu Buhari.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">In the suit number FHC\/ABJ\/CS\/172\/2015, filed by Professor Andrew<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Chukwuemerie, SAN, the plaintiffs are seeking the order of the court to<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">order police investigation into the \u201calleged acquisition and possession of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">the West African School Certificate by Gen. Muhammad Buhari at Provincial<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Secondary School, Katsina in view of non-production of the said School<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Certificate of certified true copy thereof\u201d.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The court originating summons, supported by a 31-paragraph affidavit,<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">sworn to by Joy Odoh, averred that the Inspector-General of Police has an<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">obligation under the Nigerian Constitution to investigate allegations of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">forgery and lying on oath made against the APC presidential candidate and<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">that the police had refused to do so despite repeated demands.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">One of the exhibits attached to the originating summons by the plaintiff<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">is a copy of a letter written by the Test Department of the National<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Office of the West African Examinations Council in Ghana which states that<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Buhari\u2019s name and records were not in its examinations archive thus<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">suggesting that he was never a candidate for the examination set by the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">body.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The plaintiffs contended that Buhari lied on oath and ought to be tried<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">for perjury when he declared in an affidavit submitted to the Independent<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Electoral Commission that his Secondary School Certificate was with the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Military Board, a claim denied by the Board.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The group said the allegations of forgery and perjury were too weighty to<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">be ignored by the police \u201cwhich has a constitutional duty to investigate<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">all allegations bordering on crime in the interest of justice and that all<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">efforts made to make the police perform its duties have proved futile\u201d.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Meanwhile, subsequent upon an application by the plaintiffs counsel, the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">court gave an order for accelerated hearing and directed the<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">Inspector-General of Police to enter his defence within seven days.<\/span><br style=\"color: #000000;\" \/><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">The plaintiffs are also asking the court to determine whether by virtue of<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">the provisions of the 1999 Constitution and the Police Act, the Inspector<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">General of Police is not duty bound to investigate the allegations<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">especially when the APC candidate has not submitted either an original<\/span><br style=\"color: #000000;\" \/><span style=\"color: #000000;\">copy or a certified true copy of his secondary school certificate to INEC<\/span><br
