{"id":44687,"date":"2015-12-08T05:31:07","date_gmt":"2015-12-08T04:31:07","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=44687"},"modified":"2015-12-08T05:31:07","modified_gmt":"2015-12-08T04:31:07","slug":"social-media-bill-count-me-out-buhari-tells-senate","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/social-media-bill-count-me-out-buhari-tells-senate\/","title":{"rendered":"Social Media Bill: Count Me Out, Buhari tells Senate"},"content":{"rendered":"<p>An unexpected deluge of criticisms against an attempt by privileged<br \/>\nmembers of the Nigerian upper legislative chamber, the Senate, to enact an<br \/>\nanti New Media law <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_197910592\"><span class=\"aQJ\">on Monday<\/span><\/span> forced President Muhammadu Buhari to openly<br \/>\ndistance himself from the legislative misadventure.<\/p>\n<p>President Muhammadu Buhari, who had come under serious criticisms of being<br \/>\nthe \u201chand of Esau\u201d on the proposed law sponsored by lawmakers from his<br \/>\nruling party, All Progressives Congress (APC) said he would deny the bill<br \/>\nwhich passed a second reading in record eight days, his assent if the law<br \/>\ncomes on his desk.<\/p>\n<p>The influential Online Publishers Association (OPA) had suspected the<br \/>\nadministration of trying to re-harsh an infamous Decree 4 of 1984 through<br \/>\nwhich Buhari as a military dictator muzzled and hampered the media.<br \/>\nBut Buhari came out <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_197910593\"><span class=\"aQJ\">on Monday<\/span><\/span> proclaiming himself a champion of<br \/>\nconstitutionality.<\/p>\n<p>The controversial bill, although garnished as an endeavour to deal<br \/>\ndecisively with speculative and fraudulent publications on internet social<br \/>\nplatforms, is a misadventure to target and destroy Nigerian Online news<br \/>\norganizations, particularly Sahara Reporters and others which operate from<br \/>\nthe diaspora.<\/p>\n<p>Apart from the APC sponsored bill, the new Minister of Information and<br \/>\nCulture, Mr. Lai Mohammed, has allegedly endorsed secret memos to<br \/>\nministries and agencies of the Nigerian government to deny accreditation<br \/>\nand advertisement patronage to some marked down online news websites.<br \/>\nCorrespondents of on-line news outlets were left out of the fact finding<br \/>\ntrip led by Mr. Lai Mohammed to the theatre of war in the North \u2013East last<br \/>\nweek.<br \/>\nApart from the deliberate moves to cripple the online news organizations,<br \/>\nbeat organizations are being proliferated in ministries like Education to<br \/>\ndeny journalists operating with internet platforms access. Journalists who<br \/>\nwork with so-called mainstream newspapers, radio and television stations<br \/>\nare encouraged and funded to denigrate their new media colleagues.<br \/>\nApart from the anti-New Media antics of Minister Mohammed, inspite of<br \/>\nBuhari\u2019s avowal of commitment to the freedom of expression and free press,<br \/>\npresidential minders like Messrs Femi Adesina, Shehu Garba and pastor<br \/>\nLaolu Akande are said to have advised and agreed with decisions taken<br \/>\nallegedly in \u201cnational security interest\u201d to deny accreditation to fellow<br \/>\nNigerians to freely practice and report from Aso Rock Presidential Villa.<br \/>\nPresident Muhammadu Buhari <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_197910594\"><span class=\"aQJ\">on Monday<\/span><\/span> distanced himself from the proposed<br \/>\nSocial Media Bill currently being debated in the senate seeking to<br \/>\nrestrict Nigerians from \u201ccriticizing\u201d, political and public office<br \/>\nholders.<br \/>\nThe president stated that the principle of the bill was inconsistent with<br \/>\ndemocratic ideals of free speech enshrined in the constitution of the<br \/>\nland.<\/p>\n<p>He added that he had sworn to protect and uphold the dictates of the<br \/>\nconstitution and would not in anyway go against it.<br \/>\nSpeaking through his Senior Special Assistant on Media and Publicity,<br \/>\nMalam Garba Shehu, president Buhari however stated that \u201che is not averse<br \/>\nto lawful regulation, so long as that is done within the ambit of the<br \/>\nconstitution which he swore to uphold.<br \/>\nAccording him, free speech was central to democratic societies anywhere in<br \/>\nthe world.<br \/>\n\u201cThe President won\u2019t assent to any legislation that may be inconsistent<br \/>\nwith the constitution of Nigeria\u201d, he said.<br \/>\nHe further explained that without free speech, elected representatives<br \/>\nwon\u2019t be able to gauge public feelings and moods about governance issues.<br \/>\n\u201cAs a key component of democratic principles are so emotionally attached<br \/>\nto free speech that they would defend it with all their might\u201d, he said.<br \/>\nMalam Garba Shehu explained that President Buhari was fully aware of the<br \/>\npublic reservations about the proposed legislation but assured that there<br \/>\nwas no cause for alarm \u201cbecause the Senate is a democratic senate.<br \/>\nThe highly influential On-line Publishers Association, an umbrella<br \/>\norganization for some pioneer new-media platforms based outside Nigeria<br \/>\nand Nigeria-based news publishing websites described the initiative of the<br \/>\nBukola Saraki led senate to take its eye off the watch on critical<br \/>\nlegislations such as issues of pedophilia, copyright and intellectual<br \/>\ninfringement as a dubious misadventure.<\/p>\n<p>The President of the on-line publishers association, Mr. Olufemi Awoyemi,<br \/>\ndrew a parallel line between the proposed law and the infamous Decree 4 of<br \/>\n1984, through which Mr. Muhammadu Buhari, as the head of a dictatorial<br \/>\njunta, held the media and the Nigerian nation, by the jugular during his<br \/>\nill-fated military regime.<br \/>\nBelow is the detailed statement by the association:<br \/>\n\u201cWe, the entire board and members of Online Publishers Association condemn<br \/>\nin the strongest terms the motivation, process and purpose of the \u201cBill<br \/>\nfor an Act to Prohibit Frivolous Petitions and Other Matters Connected<br \/>\nTherewith\u201d which passed its 2nd reading at the Senate in a record eight<br \/>\n(8) days; and is now set for a public hearing subsequent to its being<br \/>\nreferred by the Senate President, Bukola Saraki; to the committees on ICT,<br \/>\nJudiciary led by the Ethics and Privileges Committee.<\/p>\n<p>\u201cWe align with the Nigerian public in describing this action by the<br \/>\nNigerian Senate as pure idleness, and an abandonment of the electoral<br \/>\nmandate to focus on laws for good governance to deliver increased welfare<br \/>\nfor the people. The Senate is seeking instead to restrict the scope of<br \/>\nhuman freedoms, growth of new platforms of social interaction and public<br \/>\naccountability.<\/p>\n<p>\u201cHaving engaged and consulted widely with stakeholders in the country,<br \/>\nincluding members of the National Assembly and the ruling government; we<br \/>\noffer our support to the \u201cPublic March\u201d being organized by \u2018The Freedom of<br \/>\nInformation Coalition in Nigeria; on the National Assembly and across the<br \/>\nnation on <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_197910595\"><span class=\"aQJ\">Tuesday, December 08, 2015<\/span><\/span>; amongst the many other lawful steps<br \/>\nto be taken individually and severally to not only stop this unjust law<br \/>\nbut to hold the lawmakers more accountable.<\/p>\n<p>\u201cThe proposed bill immediately reminds the general public of the infamous<br \/>\nDecree 4 of 1984 passed under military rule; one that took away our<br \/>\nfreedoms. The continuous attempt at gagging members of the public was<br \/>\nagain re-enacted in 2011, when the Senate attempted to pass a bill by<br \/>\nanother APC Senator; for which ironically, the current members of the<br \/>\nSenate stepped down after extensive public outcry. This appears therefore<br \/>\nto be an on-going project in the Nigerian Senate.<\/p>\n<p>\u201cThe planned action by the Senator Bukola Saraki led Senate seeks to<br \/>\nnegate Chapter IV section 39 of the Nigerian Constitution which provides<br \/>\nthat \u201cEvery person shall be entitled to freedom of expression, including<br \/>\nfreedom to hold opinions and to receive and impart ideas and information<br \/>\nwithout interference\u201d. Equally, it seeks to set aside the UN Charter:<br \/>\nArticle 19 of the Universal Declaration of Human Rights, adopted in 1948<br \/>\nwhich states that &#8211; \u201cEveryone has the right to freedom of opinion and<br \/>\nexpression; this right includes freedom to hold opinions without<br \/>\ninterference and to seek, receive and impart information and ideas through<br \/>\nany media and regardless of frontiers.\u201d<\/p>\n<p>\u201cWe believe that online publication and social media use is a welcome<br \/>\ndisruptor consistent with the aspirations of Nigerians and we offer<br \/>\ncredible, integrity laden and purposeful lawmakers a different approach<br \/>\nthat adopts a strategy of assisting the Senate to re-orient any bill that<br \/>\nwould improve, sanitize and expand the frontiers and penetration of<br \/>\nresponsible online publishing and social media use.<\/p>\n<p>\u201cThere are laws in other jurisdictions guiding internet use from which we<br \/>\ncan learn useful lessons from. Examples include the Computer Misuse Act<br \/>\n(1990) \u2013UK; Electronic Communications Act (2000) \u2013 UK; Electronic Commerce<br \/>\nRegulations (2000) \u2013 UK; Electronic Communications Act, 1999 \u2013 Australia;<br \/>\nElectronic Transactions Act, 1999 \u2013 Australia; Measures on the<br \/>\nAdministration of Internet Information Services, 2001 \u2013 China; Electronic<br \/>\nTransactions and Commerce Law No 2 of 2002 \u2013 Dubai; Act on the<br \/>\nDissemination of Publications and Media Contents Harmful to Youth &#8211;<br \/>\nGermany; Digital Signature Act, 1997 \u2013 Germany; Child Online Protection<br \/>\nAct, 1998 &#8211; United States; and the Electronic Communications Privacy Act,<br \/>\n1986 &#8211; United States; to mention a few.<\/p>\n<p>\u201cThe summary of our position is thus: If the Senate is really interested<br \/>\nin providing national interest governance over the use of the internet or<br \/>\nelectronic communication, as indicated in Sections 3 and 4 of the proposed<br \/>\nBill (bearing in mind the cybercrimes bill of 2014), there are other areas<br \/>\nof intervention that can be in public interest such as<br \/>\ncopyright\/intellectual property, anonymity\/pseudonymity regulation,<br \/>\neditorial rules compliance, obscenity, privacy, child molestation,<br \/>\npedophilia, harassment, competition rules etc.<\/p>\n<p>\u201cThe attempt to jump from petitions\/affidavit to electronic communication<br \/>\nis dubious at best with no clear guidance on interpretations for intent,<br \/>\npetition, and other issues covered under the Freedom of Information Act<br \/>\nand protection of whistleblowers.<\/p>\n<p>\u201cThey are two different issues. While the emphasis on affidavits seeks to<br \/>\ntie the hands of the petitioner with a threat of perjury, the extension<br \/>\nviolates basic human rights, and runs counter to the letter and spirit of<br \/>\ncertain extant laws: the mischief that the law maker seeks to address in<br \/>\nthis regard is however already taken care of by other extant laws, to wit:<br \/>\nthe laws on libel and defamation.<\/p>\n<p>\u201cThe relationship between government and new media may be complex, but it<br \/>\nmay well be the case that majority of the people expect government to<br \/>\ncontrol offensive or dangerous media and communications, whether old or<br \/>\nnew; but not to shield dubious, corrupt and fraudulent conduct by public<br \/>\nofficials.<\/p>\n<p>\u201cTherefore, instead of seeing censorship as an untoward governmental<br \/>\nintrusion into a domain of legitimate private choice, we believe a more<br \/>\nconstructive engagement with key stakeholders can elevate the subject to<br \/>\nthe domain of public interest and help guide an ill-informed Senate<br \/>\ntowards more enlightened direction.<\/p>\n<p>\u201cFinally, in pushing ahead with this bill, the Nigerian Senate has only<br \/>\nsucceeded in representing itself as a \u201cThreat\u201d to Democracy.\u201d<\/p>\n<p>Nigerian On-line journalists do not view the current exercise by the<br \/>\nSenate as an isolated affair.
