{"id":44818,"date":"2015-12-12T15:15:30","date_gmt":"2015-12-12T14:15:30","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=44818"},"modified":"2015-12-12T15:15:30","modified_gmt":"2015-12-12T14:15:30","slug":"appeal-tribunal-upholds-abaribes-election-sets-aside-election-tribunal-rerun-ruling","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/appeal-tribunal-upholds-abaribes-election-sets-aside-election-tribunal-rerun-ruling\/","title":{"rendered":"Appeal Tribunal Upholds Abaribe\u2019s Election, Sets Aside Election Tribunal Rerun Ruling"},"content":{"rendered":"<p>The Election Appeal Tribunal sitting in Owerri, Imo State <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1536076491\"><span class=\"aQJ\">on Friday<\/span><\/span><br \/>\naffirmed the election of the Senate Committee Chairman on Information and<br \/>\nNational Orientation, Senator Enyinnaya Harcourt Abaribe as the validly<br \/>\nelected senator representing Abia South Senatorial District in the senate.<\/p>\n<p>The three-man appeal panel led by Justice Tur in a late evening judgment<br \/>\nnot only upheld the senator\u2019s appeal against the lower tribunal judgment<br \/>\nordering a rerun election in Obingwa and some wards in Ugwunagbo local<br \/>\ngovernment areas of Abis State, but also struck out the cross appeal filed<br \/>\nby Chief Chris Nkwonta for being incompetent and not in compliance with<br \/>\nlegal procedures adding that the cross appeal lack merit in its entirety.<br \/>\nHe awarded a cost of N50,000 against Nkwonta who had challenged Abaribe\u2019s<br \/>\nelection the lower tribunal.<\/p>\n<p>Nkwonta had in the cross-appeal prayed the appeal court to declare him the<br \/>\nwinner of the election and set aside the judgment of the lower tribunal,<br \/>\nwhich had ordered a staggered rerun election.<\/p>\n<p>Abaribe who was a Deputy Governor of Abia State, is a currently a third<br \/>\nterm senator in the senate where he was its spokesman in the 7th Session.<\/p>\n<p>In his ruling, the judge held that the petitioners\/respondents failed to<br \/>\nprove their allegations challenging the election and added that Abaribe\u2019s<br \/>\nelection was valid as it complied with the electoral Act.
