Our attention has been drawn to various media reports in which\u00a0the Senate Committee on FCT accused the previous\u00a0administration of illegally converting the green areas of Maitama
\nDistrict into developable lands and allocating same to named\u00a0individuals.<\/span><\/p>\n

While we had not wanted to join issues with the Senate\u00a0Committee, however, the exuberance of the Committee’s\u00a0Chairman that borders on ignorance of the limitations of the
\ndoctrine of separation of powers under the constitution has necessitated us to set the records straight:<\/span><\/p>\n

1<\/span>. <\/span>Throughout the tenure of the previous administration, all\u00a0allocations of land in the FCT were based on professional advice,\u00a0availability of layouts and the provisions of the Land Use Act. In\u00a0reference to the Ministerial Hill, which the Senate Committee\u00a0<\/span>gave the Department of Development Control directive to stop\u00a0work, we state as follows:<\/span><\/p>\n

2. That sometimes in 2010, the FCTA under Senator Adamu\u00a0Aliero commissioned Messrs. Fola Consult Limited to advise the FCT<\/span> Administration on the extent of the area in Maitama
\nMinisterial Hill that could be converted for residential use;<\/span><\/p>\n

3. That Messrs. Fola Consult Limited submitted its report\u00a0highlighting the history of the area and rationale for its\u00a0<\/span>development as follows:<\/span><\/p>\n<\/div>\n

\n

a)\u00a0\u00a0\u00a0 <\/span>The redesign of Plot 2278 was carried out during the regime\u00a0of Air Vice Marshall Hamza Abdullahi in 1998 to\u00a0accommodate the Federal Ministers who moved from\u00a0Lagos into the FCT;<\/span><\/p>\n

b)\u00a0\u00a0\u00a0 <\/span>That the change in land use was captured by the Land use\u00a0plan produced in June 1989 by Messrs. Dynasys Resource\u00a0Company in association with Alpha Consult Rome;<\/span><\/p>\n

c)\u00a0\u00a0\u00a0 <\/span>That the redesign of Messrs. Dynasys Company was not\u00a0comprehensive since the sole aim of the design was just to\u00a0create plots to accommodate some few Ministers’ houses;<\/span><\/p>\n

d)\u00a0\u00a0\u00a0 <\/span>That the area was not designated as recreational area or\u00a0park but was designated as undevelopable area based on\u00a0its difficult terrain and that the level of technology at the
\ntime was the major consideration for its classification as\u00a0undevelopable;<\/span><\/p>\n

4. That Fola Consult Limited advised the Aliero Administration\u00a0that additional plots should be created to justify existing\u00a0underutilized infrastructure In line with its land use\u00a0<\/span>categorization as a low-density residential area;<\/span><\/p>\n

5. That sometimes in 2014, the Department of Urban <\/span>& <\/span>Regional\u00a0Panning also made recommendations that additional plots\u00a0<\/span>should be created on plot 2180 to justify existing underutilized\u00a0infrastructure around the Mississippi street of Maitama;<\/span><\/p>\n<\/div>\n

\n

6. That the immediate past FCT administration was fully\u00a0convinced that the master plan is a dynamic road map for the\u00a0city’s land use and infrastructure development, guided by the
\ndemands of change and time. Hence, on the basis of the above\u00a0recommendations, and in recognition of its responsibility to\u00a0ensure full utilization of resources, the administration approved
\nthe redesigns and subsequently, allocations were made in line\u00a0with the Land Use Act;<\/span><\/p>\n

7. That the FCT Administration allowed for commencement of\u00a0work on the plots after the allottees got due building plan\u00a0approvals from the Department of Development Control which
\napproval, needless to add, can only be reversed by the authority\u00a0of the Hon. Minister;<\/span><\/p>\n

8. Apart from insisting that such new developments were based\u00a0on the green city concept, the approval process was predicated\u00a0on a robust environmental impact assessment conducted by a\u00a0team of professionals within the FCT Administration.<\/span><\/p>\n

9. That the Senate Committee is advised to seek adequate\u00a0information from the FCT Administration before issuing\u00a0wrongful directives.<\/span><\/p>\n

With the above said, we consider it imperative, at this juncture,\u00a0to make some clarifications on the concept of the master plan,\u00a0green areas and the dynamism of city development.<\/span><\/p>\n<\/div>\n

\n

The Master Plan Concept<\/span><\/b><\/p>\n

I <\/span>am not a Town Planner, but a Master plan has been defined by\u00a0professionals as that broad policy document meant to guide the\u00a0growth and development of a town or city.<\/span><\/p>\n

May I add that the life span of a master plan which is not less\u00a0than Ten years minimum, is so wide that there is no way changes\u00a0will not occur for a document based on assumptions,
\npredications and projections. As soon as gaps are observed\u00a0between these proposals and realities, as is the case of the Abuja\u00a0master plan over time, a review or redesign becomes imperative.<\/span><\/p>\n

Above all, nowhere in the world and on any town or city is a\u00a0master plan implementation achieved at 100 percent level even\u00a0in developed countries.<\/span><\/p>\n

Concept of Green Areas and the Dynamism <\/span><\/b>– <\/span><\/b>of City\u00a0Development<\/span><\/b><\/p>\n

Green area is a land use provision within the master plan for\u00a0recreation, flood drains, city buffers, urban farming, reserved\u00a0lands and contextually undevelopable area. However, for\u00a0reasons of population growth, expansion in infrastructural\u00a0<\/span>facilities, security concerns and logistical demands, city\u00a0development all over the world has never remained static.<\/span><\/p>\n<\/div>\n

\n

Rather, it has been a dynamic process. Abuja has not been an\u00a0exception.<\/span><\/p>\n

Thus, long before the advent of the last FCT Administration,\u00a0Ministers had reviewed and re-conceptualized green area\u00a0provisions in the Abuja Master plan. For instance, part of the
\nPresidential Villa was a green area in the master plan. So also\u00a0were the office of the National Security Adviser (NSA), the High\u00a0Court, the residence of the Chief Justice of Nigeria (CJN) and\u00a0recently, the residences of the presiding officers of the National\u00a0Assembly. Military formations such as Camp Wu Bassey and\u00a0Niger barracks, and urban fringes including Usuma, Maitama
\nExtension and Mpape Districts etc. were part of the changes\u00a0made to the master plan. Many other examples abound of green\u00a0areas being converted to other uses by previous ministers based\u00a0on need of the time to make the city more functional and more\u00a0socio-economically viable.<\/span><\/p>\n

In fact, all of what is termed the “Urban Fringe” including Usuma\u00a0and Mpape Districts, was a green area and was supposed to\u00a0constitute a buffer zone between the city on the one hand and
\nthe regional space, on the other. However, it was utilized by\u00a0previous administrations for the building of the various barracks,\u00a0Asokoro District, Guzape District, Sunrise Hills Estate and parts<\/span><\/p>\n

of Apo. These urban fringes were redesigned by previous\u00a0ministers in accordance with the powers conferred on them by\u00a0<\/span>the Land Use Act.<\/span><\/p>\n<\/div>\n

\n

For emphasis, it is important to note that even part of the\u00a0present Presidential Villa and the Eagle Square were changed\u00a0from Transportation Center to what they are today, while under
\nthe Master Plan, what is now known as Maitama Extension was\u00a0supposed to be a Sports Center but was redesigned by previous\u00a0administrations. Even in the city center occasions arose where
\nthe Boulevard Project in the Central Business District area led to\u00a0redesign of many plots in the original master plan.<\/span><\/p>\n

For the enlightenment of all stakeholders and members of the\u00a0public who are ignorant of the historical background to this\u00a0matter, it was Mallam Nasir EI-Rufai as FCT minister who, seeing
\nthe lack of capacity on the part of the FCT Administration, to\u00a0maintain the green areas, started allocating them to individuals\u00a0in the hope that the allottees would live up to expectation.
\nUnfortunately, they did not. Instead, most of the park allottees\u00a0converted the green areas to commercial uses thereby placing\u00a0them on a collision course with the Development Control\u00a0Department. Overnight, restaurants, hotels, showrooms, beer\u00a0parlours, pubs etc. sprang up in these areas, in complete negation\u00a0of the master plan. In some cases these unapproved conversions\u00a0<\/span>constituted not only a nuisance to the public but a grave security\u00a0threat. To tackle the deplorable situation, the immediate past\u00a0<\/span>leadership of the FCT set up a committee headed by former<\/span><\/p>\n<\/div>\n

\n

Director General of the Nigerian Tourism Development\u00a0Commission, Otunba Segun Runsewe which, in the course of its \u00a0activities, established that most of the beneficiaries had made\u00a0heavy investments in the green areas. It was therefore decided,\u00a0that in deserving cases, the allottees should retain only 10 of\u00a0the green areas while the remaining should be developed for\u00a0public use with the firm belief that if the administration needed\u00a0to recover the whole land, it could do so since it was not covered\u00a0by deeds and titles.<\/span><\/p>\n

We have gone to this extent to explain dynamics of the\u00a0transformation of the green areas to prove the point that the\u00a0immediate past FCT administration was simply following\u00a0precedents in adopting out-of-the-box strategies that would\u00a0guarantee more effective land use management. The truth is\u00a0that the previous administration drew immensely from both the\u00a0Accelerated Development Program of EI-Rufai and the Sunshine\u00a0Hills Estate of Abba Gana, in prosecuting its highly ambitious\u00a0mass housing programs. It is on record that the administration,\u00a0under Senator Bala Mohammed, collaborated with estate\u00a0developers and institutions like the Nigeria Labour Congress, NLC\u00a0and the Trade Union Congress, TUC to develop districts for\u00a0<\/span>workers while the administration itself conceived three social\u00a0and affordable housing schemes in Wasa and Mamusa Districts <\/span>which were allocated to co-operatives to provide housing to the\u00a0<\/span>lower cadre.<\/span><\/p>\n<\/div>\n

\n

Conclusion<\/span><\/b><\/p>\n

From the above, we want to conclude as:<\/span><\/p>\n

1.\u00a0\u00a0 <\/span>The Minister never acted outside the limits of his powers in\u00a0the matter of land management in the FCT.<\/span><\/p>\n

2.\u00a0\u00a0\u00a0\u00a0 <\/span>The Abuja Master Plan has never been inviolable. At various\u00a0times in the past, Senator Bala Mohammed’s predecessors\u00a0had managed the plan to achieve a functional and\u00a0harmonious development in the city. For all his actions in\u00a0the area of land management, there were precedents by his\u00a0predecessors some of whom are still serving the nation in\u00a0various capacities.<\/span><\/p>\n

3.\u00a0\u00a0\u00a0\u00a0 <\/span>What we do not understand is the Senate Committee\u00a0Chairman’s unusual interest in the Minister’s Hill<\/span>. <\/span>The\u00a0committee needs no reminding that all the beneficiaries of\u00a0plots at the redesigned Minister’s Hill are Nigerians who are\u00a0legitimately and eminently qualified <\/span>to <\/span>receive <\/span>the\u00a0<\/span>allocations that were made within the constitutional\u00a0powers of the minister following laid down procedures and\u00a0precedence set by his predecessors. Some of these\u00a0<\/span>Predecessors are not just around they are still very much in\u00a0the service of the nation<\/span><\/p>\n<\/div>\n

4.\u00a0\u00a0\u00a0\u00a0 <\/span>We recognize the prerogative of the Chairman of the Senate\u00a0Committee on FCT<\/span> to carry out his oversight functions in\u00a0any manner he chooses but that should never include\u00a0making unguarded statements that tend to ridicule those\u00a0who served to the best of their ability or derogate the\u00a0powers of the executive to carry out their normal\u00a0constitutional duties.<\/span><\/p>\n

5.\u00a0\u00a0\u00a0\u00a0 <\/span>The committee will need to be reminded that a similar\u00a0effort to revoke the last minute allocations by EI-Rufai on\u00a0the eve of his departure could not stand. Ironically, it fell on\u00a0Senator Bala Mohammed to resolve the matter and restore\u00a0the status quo, which led to massive development in the\u00a0FCT and alleviate unnecessary litigation.<\/span><\/p>\n

6.\u00a0\u00a0\u00a0\u00a0 <\/span>The former minister is available at all times to clarify his\u00a0<\/span>actions in the area of land management thereby avoiding\u00a0unnecessary dramatization of ignorance or grandstanding\u00a0for media attention.<\/span><\/p>\n
