{"id":47027,"date":"2016-02-29T21:09:14","date_gmt":"2016-02-29T20:09:14","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=47027"},"modified":"2016-02-29T21:09:14","modified_gmt":"2016-02-29T20:09:14","slug":"n225000-bribery-ricky-tarfa-denies-affidavit","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/n225000-bribery-ricky-tarfa-denies-affidavit\/","title":{"rendered":"N225,000 Bribery: Ricky Tarfa Denies Own Affidavit"},"content":{"rendered":"<p>Ruling in the case of unlawful arrest brought by Rickey Tarfa, SAN,<br \/>\nagainst the Economic and Financial Crimes Commission, EFCC, and three<br \/>\nothers persons which was billed for today suffered a setback sequel to the<br \/>\napplicant\u2019s attempt to introduce new evidence.<\/p>\n<p>Tarfa had approach the court asking the court to award N2.5 billion as<br \/>\ndamages against the EFCC over his arrest and detention.<\/p>\n<p>At the last date in court, Justice Mohammed Idris of the Federal High<br \/>\nCourt, Lagos adjourned to today <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2072598599\"><span class=\"aQJ\">February 29, 2016<\/span><\/span> for judgment after<br \/>\nlistening to the submissions of counsel.<\/p>\n<p>Tarfa had in an affidavit by one John Olusegun Odubela, who is the head of<br \/>\nChambers in the firm of Messrs Rickey Tarfa &amp; Co, admitted that the<br \/>\napplicant gave the sum of Two Hundred and Twenty Five Thousand Naira Only<br \/>\n(N225,000) to Justice M.N Yunusa of the Federal High Court.<\/p>\n<p>He has now approached the court for an order granting him leave to re-open<br \/>\nand adduce further evidence that the said Justice M. N. Yunusa is Mr.<br \/>\nMohammed Awwal Yunusa, a former employee in Tarfa\u2019s chambers, as the<br \/>\nbeneficiary of the N225, 000.<\/p>\n<p>Tarfa, SAN, had stated in his earlier affidavit \u2019\u2019That it was a common<br \/>\nknowledge in legal circles that the Honourable Justice M.N Yunusa lost his<br \/>\nfather in-law Alhaji Audi Garba Damasa on 28th December 2013 in Maiduguri<br \/>\nand travelled there to attend to the funeral rites.<\/p>\n<p>\u201cThat the applicant and some friends of the Honourable Justice M.N Yunusa<br \/>\nmade some donations towards the said funeral rites and to commiserate with<br \/>\nthe Judge since they could not physically go and commiserate with him in<br \/>\nMaiduguri where he was and stayed for a while.<\/p>\n<p>\u201cThat the contributed monies amounted to Two Hundred and Twenty Five<br \/>\nThousand (N225,000) which sum was given to the applicant with the<br \/>\nresponsibility to get same across to the bereaved judge.<\/p>\n<p>\u201cThat the applicant consequently made arrangements to forward the sum of<br \/>\nN225,000.<\/p>\n<p>\u201cThat I know as a fact that it is common in Nigeria for friends and<br \/>\nwell-wishers to contribute gifts in cash and kind to people who are<br \/>\ncelebrating or bereaved\u201d.<\/p>\n<p>Tarfa has now made a u-turn. \u201cThat the Applicant did not in paragraphs 35,<br \/>\n36, 37, 38, &amp; 39 of the Applicant\u2019s further affidavit deposed to on 19th<br \/>\nFebruary, 2016 stated that the sum of N225,000 was paid to Honourable<br \/>\nJustice M. N. Yunusa of this Honourable Court.\u201d\u2026 \u201cThat the sum of N225,000<br \/>\nwas paid to the Applicant\u2019s former staff, M. A. Yunusa Esq and it is<br \/>\nnecessary to adduce further evidence by allowing the use of further and<br \/>\nbetter affidavit of Mr. Mohammed Awwal Yunusa in support of the<br \/>\napplication for enforcement of fundamental rights who owns the account<br \/>\nthat was said to have been owned by Honourable Justice M. N. Yunusa\u201d,<\/p>\n<p>In his counter affidavit the EFCC counsel, Wahab Shittu claims that the<br \/>\ngrounds upon which the applicant was bringing the application is blatant<br \/>\nfalsehood and an afterthought. He claims that the applicant\u2019s further<br \/>\naffidavit that was deposed to earlier cannot be twisted or misrepresented<br \/>\nin any way whatsoever.<\/p>\n<p>\u201dThat paragraph 10 of the affidavit in support stands logic on its heads<br \/>\nand in response thereto paragraphs 37 and 38 of the further affidavit of<br \/>\nthe applicant showing clearly that the applicant averred that the sum of<br \/>\nN225,000 (Two hundred and twenty five Naira) was paid directly to<br \/>\nHonourable Justice M. N.
