{"id":49584,"date":"2016-05-25T14:27:46","date_gmt":"2016-05-25T13:27:46","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=49584"},"modified":"2016-05-25T21:08:05","modified_gmt":"2016-05-25T20:08:05","slug":"medical-trip-abroad-going-no-judge-tells-metuh","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/medical-trip-abroad-going-no-judge-tells-metuh\/","title":{"rendered":"Medical trip abroad: You are going no where, Judge tells Metuh"},"content":{"rendered":"<div>A Federal High Court in Abuja on Wednesday rejected the request \u00a0by Olisa Metuh, asking for the release of his passport to enable \u00a0him travel to the United Kingdom for medical treatment.<\/div>\n<div><\/div>\n<div>\n<div>Justice Okon Abang \u00a0said that counsels to Metuh failed to produce \u00a0any evidence that his spinal cord-related ailment which he sought to treat at London Royal Hospital could not be treated in any of the nation\u2019s teaching hospitals and the new hospital in Akwa Ibom State, which he said had been adjudged to be of international standard.<\/div>\n<div><\/div>\n<div><\/div>\n<div>He held that Metuh could not ask for the release of his passport as of right without placing sufficient materials before the court.<\/div>\n<\/div>\n<div><\/div>\n<div><\/div>\n<div>Abang held that the court lacked jurisdiction to order the release of Metuh\u2019s passport having earlier directed that it should be deposited with the Chief Registrar of the Court throughout the period of the PDP spokesperson\u2019s ongoing trial.<\/div>\n<div><\/div>\n<div>\u201cThe law is settled and required no restatement that when a court has made an order, the court lacks jurisdiction to set aside the order or vary the order,\u201d Justice Abang ruled.<\/div>\n<div><\/div>\n<div>Justice Abang also ruled that the prosecution \u2013 the Economic and Financial Crimes Commission \u2013 having expressed fear that Metuh could jump bail, \u201cthe court must be very careful in deciding such complex application.\u201d<\/div>\n<div><\/div>\n<div>\u201cWhat the court needs to do is to balance the conflicting rights of parties,\u201d the judge ruled.<\/div>\n<div><\/div>\n<div><\/div>\n<div><\/div>\n<div>The judge ruled, \u201cThis is not a sentimental issue. This is not the issue of sympathy.
