Court confirms the sack of Sheriff"},"content":{"rendered":"<p>\u2022<em>says May 21 National Convention was valid<\/em><br \/>\n<em>\u2022confirms the PDP Caretaker Committee\u00a0<\/em><br \/>\nA Federal High Court sitting \u00a0in \u00a0Port Harcourt on Monday \u00a0declared \u00a0that the \u00a0May 21, 2016 National Convention of the Peoples Democratic Party, PDP,<br \/>\nwas duly constituted, \u00a0declaring that the dissolution \u00a0of the National Working Committee and the National Executive Committee by that convention \u00a0were valid.<\/p>\n<p>In his judgment \u00a0on the suit filed by the PDP \u00a0against \u00a0Senator \u00a0Ali Modu Sheriff and others, Justice Abdullahi Liman \u00a0declared that the appointment \u00a0of \u00a0the \u00a0Caretaker \u00a0Committee \u00a0of the PDP \u00a0to oversee \u00a0its\u00a0affairs \u00a0was legal and in line with \u00a0the \u00a0provisions of the PDP constitution.<\/p>\n<p>Justice Liman said that\u00a0Article\u00a0 31 (1) of the \u00a0PDP \u00a0constitution \u00a0vested the powers to convene a national \u00a0convention \u00a0on the National Executive Committee of the party.<\/p>\n<p>The court held that pursuant \u00a0to the constitution of the party, the former Acting National Chairman had no powers to unilaterally \u00a0postpone \u00a0the properly \u00a0constituted national convention \u00a0on a day all delegates \u00a0had converged \u00a0on\u00a0Port Harcourt, \u00a0the host city.<\/p>\n<p>He described \u00a0the action of Senator \u00a0Ali Modu Sheriff as most unconscionable , \u00a0pointing \u00a0out \u00a0that \u00a0the \u00a0former \u00a0Acting National Chairman participated in all the processes leading to the National Convention, \u00a0only to make a u-turn at the final minute after he was screened and disqualified.<\/p>\n<p>The court ruled that after Sheriff \u00a0was disqualified following \u00a0his screening, \u00a0the only option \u00a0that was left to \u00a0Senator \u00a0Sheriff \u00a0was to have \u00a0gone to the venue of the National Convention to seek the opinion of delegates \u00a0whether they were prepared to go on with the convention or not.<\/p>\n<p>According \u00a0to \u00a0Justice Liman, the absence of Senator Ali Modu Sheriff from the convention did not visible from the process as his powers were not usurped.<\/p>\n<p>The court declared that under \u00a0Article 35 (b) of the PDP \u00a0constitution \u00a0, in the absence of the Chairman, \u00a0the Deputy Chairman \u00a0was empowered \u00a0to preside over the National Convention.<\/p>\n<p>It therefore ruled that the May 21st, 2016 PDP \u00a0National Convention \u00a0was properly \u00a0constituted \u00a0and the decisions \u00a0taken at the convention, valid.<\/p>\n<p>The Federal High Court further ruled that in line with Article 33 (2) of the PDP \u00a0constitution, \u00a0the National Convention of the party is supreme and can exercise \u00a0the powers to dissolve the National Working Committee and the National Executive Committee of the party.<br \/>\nOn the issue of the abuse of court process \u00a0claimed by the Former National Acting Chairman, \u00a0Senator Ali Modu Sheriff, the court held that the \u00a0plaintiffs in the case in question \u00a0are not the same in the cases mentioned by the defendants, noting that the plaintiffs \u00a0suit only centred on the National Convention.<\/p>\n<p>The court noted that five days to the National Convention, \u00a0the Former Acting National Chairman, \u00a0Senator Ali Modu Sheriff had through \u00a0his counsel&#8217;s dissociated himself \u00a0from one of the suits they filed via proxies.<\/p>\n<p>Justice \u00a0Liman \u00a0emphasised \u00a0that there was no suit challenging the conduct of the National Convention \u00a0in Port Harcourt \u00a0and that no injunction \u00a0sought to stop the convention.<\/p>\n<p>Addressing \u00a0journalists \u00a0after the judgment, Counsel to the PDP, Dejo Lamikanra \u00a0(SAN) said that the judgment\u00a0settles all the contending issues concerning \u00a0the \u00a0PDP. \u00a0He said with the judgement, \u00a0the decision of the National Convention \u00a0to appoint \u00a0a Caretaker Committee stands and that Senator Ali Modu Sheriff was duly sacked.<\/p>\n<p>In his remarks, Secretary of the Caretaker Committee, Senator Ben Obi declared \u00a0that the Caretaker Committee will now settle down to carry out the responsibility \u00a0bestowed \u00a0on it by the National Convention.<\/p>\n<p>Counsel to Senator Ali Modu Sheriff, Mr
