Some civil society groups in Nigeria have condemned a bill before the
\nHouse of Representatives which \u201cseeks to properly supervise, monitor and
\nco-ordinate Civil Society Organizations (CSOs) and Community Based
\nOrganizations (CBOs) in Nigeria.\u201d
\nThe groups are: Socio-Economic Rights and Accountability Project (SERAP);
\nWomen Advocates and Documentation Centre (WARDC); Women Empowerment and
\nLegal Aid Initiative, (WELA); Partnership for Justice, and Committee for
\nDefence of Human Rights (CDHR).
\nThe groups in a statement today signed on their behalf by SERAP executive
\ndirector Adetokunbo Mumuni expressed \u201cdeep concern that the National
\nAssembly of Nigeria is pursuing anti-people and anti-civil society agenda
\nby using its law-making powers to wage a deliberate campaign to shield its
\nmembers from accountability.\u201d
\nThe statement reads in part: \u201cThe latest in the series of obnoxious and
\nrepressive bills being promoted in the National Assembly is the so-called
\nbill to establish a regulatory commission to monitor the work of civil
\nsociety organizations in the country, which passed second reading in the
\nHouse of Representatives at a plenary session on 14 July 2016, under the
\nleadership of Speaker Yakubu Gogara who is pushing, promoting and
\nfast-tracking the bill.\u201d
\n\u201cUnder the bill, civil society and community groups including the labour
\nunion, association of journalists, association of teachers, association of
\nmarket women, human rights NGOs and other civil society bodies will face
\nintrusive and unwarranted surveillance of their operations. The bill
\nclearly aims not only to undermine and frustrate the work of independent
\ncivil society and community organizations in the country but also to
\nintimidate human rights and anti-corruption activists.\u201d<\/p>\n

\u201cLike the anti-social media bill, the anti-civil society bill would
\nseriously violate citizens\u2019 human rights to freedom of expression,
\nassociation and assembly, preventing them from freely forming
\norganizations, meeting together and criticizing the abuse of legislative
\npowers and allegations of massive corruption in the National Assembly. We
\nbelieve that the bill demonstrates the National Assembly\u2019s pattern of
\nproposing anti-people and anti-civil society bills while at the same time
\npromoting bills such as the immunity and life pensions bills that serve
\ntheir personal and financial interests.\u201d<\/p>\n

\u201cWe are deeply concerned that the bill if passed would outlaw
\nanticorruption and human rights activism in this country. We believe that
\nthe bill is an attempt to divert public attention from the deepening
\ncrisis of public trust and confidence in the National Assembly.\u201d<\/p>\n

\u201cLike the anti-social media bill, this anti-civil society bill is entirely
\nunnecessary as Nigeria already has enough legislation such as the
\nCompanies and Allied Matters Act, the criminal code and the penal code and
\nother common law provisions to address any purported issues of \u201cdefective
\noperational values of such organizations that are left to operate within
\nits own Constitution and sometimes within the whims and caprices of their
\ndonors.\u201d<\/p>\n

\u201cWe note that if any institution needs monitoring at the moment, it should
\nbe the National Assembly as it is common knowledge that the priorities of
\nthe Senate and House of Representatives in the past months have been to
\npush for immunity for its principal officials against corruption; life
\npensions for members including former governors now serving in the
\nNational Assembly; and anti-social media bill which was temporarily
\ndropped but we now understand the Senate has completed plans to bring
\nback.\u201d<\/p>\n

\u201cWe consider the anti-civil society bill being promoted by the leadership
\nof the House of Representatives as marking a new and disturbing pattern of
\nrepressive and anti-people\u2019s bills being championed by the National
\nAssembly.\u201d<\/p>\n

\u201cWe agree with Hon Oghene Emmanuel Egor (APC: Delta) who opposed the bill
\nwhen he said that \u201cthe establishment of the [anti-civil society]
\nCommission would defeat the aim and objectives of CSOs as it may attempt
\nto manage and control funds received\u201d, and that \u201cit is not within the
\njurisdictions of the Federal Government to monitor funds that it did not
\ndonate nor have ownership of.\u201d<\/p>\n

\u201cThe bill also clearly amounts to interference and restriction of the work
\nof independent civil society and community organizations in the country.
\nThe bill also directly violates constitutionally and internationally
\nguaranteed human rights and the UN Declaration on the Right and
\nResponsibility of Individuals, Groups and Organs of Society to Promote and
\nProtect Universally Recognized Human Rights and Fundamental Freedoms
\nadopted by the General Assembly in 1999.\u201d<\/p>\n

\u201cThe bill titled \u201cA Bill to provide for the Establishment of Non-
\nGovernmental Organizations (NGO) Regulatory Commission Nigeria\u201d was
\nintroduced by Umar Buba Jibril (Deputy Leader, PDP: Kogi) According to
\nJibril, the bill \u201cseeks to properly supervise, monitor and co-ordinate
\nCivil Society Organizations (CSOs) and Community Based Organizations
\n(CBOs).\u201d<\/p>\n

\u201cWe note that Nigeria has many well-established and reputable civil
\nsociety groups which have continued to promote transparency,
\naccountability in governance and respect for human rights over many years.
\nCivil society plays a crucial role both in helping draw attention to
\nabuses by state agents and by providing support and services to victims of
\nhuman rights violations.\u201d<\/p>\n

\u201cWe contend that if the governments of General Sani Abacha and Ibrahim
\nBabangida as repressive as they were could not win the battle to clampdown
\non the civil society, this latest effort by the House of Representatives
\nwill fail woefully.\u201d<\/p>\n

\u201cWe further note that the anti-civil society bill amounts to regulation of
\nthe constitutional and internationally recognized human rights of
\nNigerians to freedom of expression and association and therefore
\nconstitutes a blatant affront on constitutional authority and legitimacy.\u201d<\/p>\n

“We also note that the United Nations, the African Union and the African
\nCommission on Human and Peoples\u2019 Rights have repeatedly affirmed the
\nimportance of civil society. human rights defenders. The Kigali
\nDeclaration, adopted by the African Union Ministerial Conference on Human
\nRights in May 2003, calls on African governments to \u201ctake appropriate
\nsteps to implement the UN Declaration on Human Rights Defenders in
\nAfrica.\u201d The UN Declaration sets down a series of principles and standards
\naimed at ensuring that states fully support the efforts of human rights
\ndefenders and ensure that they are free to conduct their activities for
\nthe promotion, protection and effective realization of human rights
\nwithout hindrance or fear of reprisals.”<\/p>\n

\u201cWe therefore call the Speaker of the House of Representatives Yakubu
\nDogara to use his leadership position to ensure the withdrawal of the
\nanti-civil society bill from the House. We will take all appropriate legal
\nactions nationally and internationally to ensure that the bill is dropped
\nand promote the rights to freedom of expression, association, and peaceful
\nassembly in Nigeria.\u201d<\/p>\n
