{"id":52401,"date":"2016-08-18T16:08:23","date_gmt":"2016-08-18T15:08:23","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=52401"},"modified":"2016-08-18T16:08:23","modified_gmt":"2016-08-18T15:08:23","slug":"abia-governorship-tussle-ikpeazu-defeats-ogah-appeal-court","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/abia-governorship-tussle-ikpeazu-defeats-ogah-appeal-court\/","title":{"rendered":"Abia Governorship Tussle: Ikpeazu Defeats Ogah At Appeal Court"},"content":{"rendered":"<p>Governor Okezie Ikpeazu of Abia State has won the first appeal delivered<br \/>\nby the Court of Appeal in Abuja with respect to the judgments of the<br \/>\nFederal High Court in Abuja <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2127728985\"><span class=\"aQJ\">June 27<\/span><\/span> removing him from office.<\/p>\n<p>Ikpeazu\u2019s appeal was with respect to the ruling delivered by Justice Okon<br \/>\nAbang of the Federal High Court in Abuja on <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2127728986\"><span class=\"aQJ\">July 8<\/span><\/span> in which the judge<br \/>\ninsisted that he had jurisdiction to hear a motion for stay of execution<br \/>\nof his earlier judgments delivered on <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_2127728987\"><span class=\"aQJ\">June 27<\/span><\/span> even after the appeals<br \/>\nagainst the judgments had been entered.<\/p>\n<p>The Justice Helen Ogunwumiju-led five-man bench unanimously agreed in<br \/>\ntheir judgment that Justice Abang erroneously assumed jurisdiction to hear<br \/>\nthe motion and adjourned it till a later date.<\/p>\n<p>Justice Philomina Ekpe, who read the lead judgment, held that what Justice<br \/>\nAbang ought to have done in line with time-honoured doctrine of \u201cstari<br \/>\ndecisis\u201d was to have transferred the motion to the Court of Appeal for<br \/>\ndetermination.<\/p>\n<p>She also held that the Justice Abang wrongly interpreted the provisions of<br \/>\nOrder 4(10) and (11) of the Court of Appeal rules when he held that the<br \/>\nsaid provisions were only applicable to an interlocutory ruling of the<br \/>\nlower court and when a final judgment in a suit had been delivered.<\/p>\n<p>She also held that Justice Abang lacked jurisdictions to interpret the<br \/>\nprovisions of the Court of Appeal being the rules of a superior court.<\/p>\n<p>In her contribution, Justice Ogunwumiju, held that the trial judge<br \/>\n\u201cdeliberately stood the law on its head\u201d by justifying his jurisdiction to<br \/>\nhear the motion when appeal has been entered.<br \/>\nPunch<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Governor Okezie Ikpeazu of Abia State has won the first appeal delivered by the Court of Appeal in Abuja with respect to the judgments of the Federal High Court in&hellip;<!-- AddThis Advanced Settings generic via filter on wp_trim_excerpt --><!-- AddThis Share Buttons generic via filter on wp_trim_excerpt --><!-- AddThis Related Posts generic via filter on wp_trim_excerpt --><\/p>\n","protected":false},"author":1,"featured_media":52402,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[17],"tags":[],"class_list":["post-52401","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-exclusive"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v26.8 -
