A Federal High Court in Abuja has refused application by Sen. Buruji
\nKashamu, seeking an order to restrain the Department of State Services
\nfrom extraditing him to the U.S to face charges.<\/p>\n
The Judge, Justice Okon Abang, refused the application on Tuesday after
\nCounsel to Kashamu, Mr Godswill Mrakpo, argued the application in favour
\nof his client.<\/p>\n
Abang ordered that the third respondent should be served outside
\njurisdiction of the court. The judge directed the applicant to filed and
\nserve the motion on notice on the Director-General of DSS,
\nInspector-General of Police and Mr Oladikupo Adebutu.<\/p>\n
\u201cIt is my view that the court should give the respondents opportunity to
\nshow cause why restraining order should not be granted against them. \u201cThe
\ncourt shall give them time to respond, I want to hear from the
\nrespondents,\u2019\u2019 he said.<\/p>\n
Abang also refused another prayer seeking to serve the respondents through
\na substituted means. He said the applicant did not placed any material
\nbefore the court to show he made any effort to serve the respondents which
\ndid not yielded any result.<\/p>\n
He, therefore, struck out the first and second reliefs sought by the
\napplicant. The senator was asking the court to restrain all the
\nrespondents and their agents from arresting and detaining him.<\/p>\n
Abang adjourned hearing in the suit till Sept. 8 to enable the applicant
