A lawyer, Mike Ojiako has threatened to sue the National Judicial Council<\/p>\n
(NJC) if the judicial officials\u2019 disciplinary body fails to rescind the
\norder it made that he should be investigated by the Police and Nigerian Bar
\nAssociation (NBA).<\/p>\n
The NJC had last week among others, recommended to the Abia State governor,
\nOkezie Ikpeazu the dismissal of Justice Ugbor Ononugbo of the state high
\ncourt over a matter involving the estate of a deceased businessman, Chief
\nDike Udensi Ifegwu (DUBIC) she handled. NJC further recommended that one of
\nthe lawyers to the children of Dubic; Ojiako be investigated by the police
\nand NBA.<\/p>\n
Ojiako who expressed shock over the NJC\u2019s directive stated that earlier
\nthis year, one of the brothers of Dubic, Orum Ifegwu Udensi wrote a
\npetition against him to the national body of NBA over the same matter NJC
\nadjudicated.<\/p>\n
He said after investigation into matter, it was dismissed as NBA saw no
\nmerit in the petition.<\/p>\n
The fiery lawyer said even when the petitioner had dragged him to the
\nDepartment of State Security (DSS) on the same matter, that the children of
\nthe late Dubic in a letter dated September 8, 2014 and signed by the
\nsurviving eldest son, Mr. Okafor Dike Udensi exonerated him of any wrong
\ndoing, stating that whatever he did with regard to their father\u2019s estate,
\nwas authorized by them.<\/p>\n
Ojiako stated again, \u201cWhen they took Justice Ugbor Ononugbo to NJC, they
\ninvited us as witnesses; that we should state our case, we forwarded our
\ndefence for her (not for us because we were not under trial). When we
\nappeared, we wanted to adopt our case, but they refused, saying they don\u2019t
\nhave jurisdiction over us.<\/p>\n
The lawyer said he was shocked to learn that after asking the governor of
\nAbia State to dismiss the Judge, NJC said that he should be investigated
\nwhen in the real fact he was not under them and when NBA had already done
\ntheir investigations and set him free.<\/p>\n
\u201cThe NJC has tarnished my image. I was not a party to the petition, they
\ndon\u2019t have jurisdiction over me, I was only a witness in that petition.
\nSince NJC has no jurisdiction over me, they don\u2019t have powers to make
\nconsequential order against me. I am going to write NJC to reverse the
\norder because it has spread everywhere across the world and if they do not
\ndo that, I will take them to court at least to clean my name. And all the
\nlawyers that tried me in the internet over this matter if they don\u2019t recant
\nthem, I will take all of them to court, I know that the court will
\nvindicate me\u201d, he said.<\/p>\n
Meanwhile, a constitutional lawyer, Ebere Uzoatu has condemned the action
\nof the NJC.<\/p>\n
In an interview, Uzoatu said it was wrong for NJC to have made the order
\nwithout first hearing from Ojiako, more so when NBA that was
\nconstitutionally empowered to investigate lawyers had done so and found him
\ninnocent.<\/p>\n
\u201cBefore making that order, NJC should have tried him, but in this instance,
\nhe was not. The people that can make that order is NBA, they have did their
\ninvestigations and found him not guilty.\u201d<\/p>\n
