A Lawyer representing Omoyele Sowore, the founder and publisher of
\nSaharaReporters, has accused the Lagos State Commissioner of Police, Fatai
\nOwoseni, of conniving with Lekan Fatodu and others who on Wednesday<\/span><\/span>
\nassaulted the online publisher to manufacturer a petition accusing Mr.
\nSowore of \u201ccriminal defamation and blackmail.\u201d<\/p>\n

In a statement released today, Inibehe Effiong, a solicitor and one of the
\ncounsel to Mr. Sowore, decried some reports in print, online and social
\nmedia suggesting that the publisher of the New York City-based
\nSaharaReporters \u201cwas arrested and is being investigated by the Nigeria
\nPolice Force on allegations bothering on \u2018criminal defamation\u2019 and
\n\u2018blackmail.\u2019\u201d Mr. Effiong dismissed the reports as outright falsehood,
\nadding that they were \u201cvariously credited to the duo of Mr. Lekan Fatodu
\nand the Lagos State Police Public Relations Officer, SP. Dolapo Badmos and
\nher Commissioner of Police, Fatai Owoseni.\u201d<\/p>\n

Mr. Effiong declared that he issued a statement in order to set the
\nrecords straight for the sake of credulous and unsuspecting members of the
\npublic who may be misled by the outright falsehood being fed the public by
\nthe police in active connivance with Mr. Sowore\u2019s assailants.
\nMr. Effiong gave a blow-by-account of what transpired between Mr. Sowore
\nand his assailant, Mr. Fatodu, an associate of former Aviation Minister
\nFemi Fani-Kayode. In a report early last year, SaharaReporters had
\nidentified Mr. Fatodu as a role player in the former minister\u2019s massive
\nmoney laundering schemes.<\/p>\n

Part of Mr. Effiong\u2019s statement read, \u201cOn Wednesday the 11th<\/span><\/span> day of
\nJanuary 2017 while driving in company of two of his associates through the
\nGovernment Reserved Area (GRA) in Ikeja, Lagos State, Mr. Sowore was
\nwaylaid and gruesomely attacked by one Mr. Lekan Fatodu and his accomplice
\nsimply identified as Dare aka \u201cMr. \u2018Andre\u2019.\u201d The said assailants assaulted
\nSowore and made attempts on his life before they were restrained and
\noverpowered by concerned members of the public.<\/p>\n

\u201cFollowing the intervention of concerned members of the public, the
\nassailants fled from the scene only to return soon afterwards in company
\nwith a team of armed policemen from the Area \u2018F\u2019 Police Station, Ikeja on
\nthe pretext that Sowore had committed \u2018traffic offence\u2019 and should be
\narrested and taken to the nearest Police Station.<\/p>\n

\u201cThe policemen first took Sowore and his associates to the Area \u2018F\u2019 Police
\nStation in Ikeja after which he was taken before the Lagos State
\nCommissioner of Police, Mr. Fatai Owoseni at the State Police Command,
\nIkeja. In what smacks of an unholy alliance between the assailants and the
\nPolicemen from Area \u2018F\u2019, Fatodu continued to assault and molest Sowore
\nright inside the Police van while he was being conveyed to the State
\nPolice Command and at the police station without any resistance from the
\npolicemen.<\/p>\n

Shockingly, when Sowore drew the CP\u2019s attention to the assault on his
\nperson and the attempt on his life by Fatodu and his accomplice, he was
\nignored and treated with scorn by the CP. He was subsequently transferred
\nto the State Criminal Investigation Department (SCID), Panti, Yaba, Lagos
\nState where he also reported the assault on his person and the attempt on
\nhis life by Fatodu and his accomplice.<\/p>\n

Today, without any plausible or prior investigation, the Lagos CP held a
\npress conference where he dismissed the assault and attempt made on the
\nlife of Sowore by Fatodu and his accomplice as \u2018\u2019false alarm\u2019\u2019. This is
\nnot surprising given the unfriendly, rude and aggressive manner the CP
\ntreated Sowore when he was brought before him on Wednesday, January 11th,
\n2017.<\/p>\n

Unknown to the Lagos State Police Command, the so-called offense of
\n\u2018\u2019criminal defamation\u2019\u2019 no longer exist in Lagos State. Just for clarity,
\nthe existing penal legislation in Lagos State is the Criminal Code Law of
\nLagos State 2011 which came into force on the\u00a0 August 8th,\u00a0 2011. The
\nPolice may have wrongly relied on the provisions of a repealed law,
\nspecifically Chapter 33 of the Criminal Code Law, Chapter C17, Vol. 2,
\nLaws of Lagos State of Nigeria, 2003 (now repealed by Section 417 of the
\nCriminal Code Law of Lagos State 2011) under which the said offence was
\ncreated. However, the offence was abrogated and expunged by the Lagos
\nState House of Assembly under the current law (The Criminal Law of Lagos
\nState 2011) as it cannot be found in any of the 418 Sections of the
\nCriminal Law of Lagos State 2011.<\/p>\n

\u201cSowore was released unconditionally from the SCID Panti late in the night
\nof Wednesday the 11th<\/span><\/span> day of January 2017 and asked to report the
\nfollowing day by 2:00 p.m.<\/span><\/span> On his part, the assailant and his accomplice
\nwere only released after signing a bail bond.<\/p>\n

\u201cBefore they were released on Wednesday<\/span><\/span> night, the Deputy Commissioner of
\nPolice in charge of the SCID, Panti (DCP) Bolaji Salami invited the
\nInvestigating Police Officer (IPO) in charge of the matter and asked him
\nopenly the offense that he was investigating as it concerns Sowore, Fatodu
\nand his accomplice. The IPO in the presence of and to the hearing of the
\nfollowing persons: Sowore and his Counsel (Mr. Inibehe Effiong, Esq.);
\nComrade Olanrewaju Suraj; and the Assistant Commissioner of Police SCID,
\nPanti ACP Frank Mba, declared that he was investigating a case of \u2018TWO
\nFIGHTING\u2019.<\/p>\n

When Sowore reported at the SCID, Panti on Thursday January 12, 2017 by
\n2:00 p.m.<\/span><\/span> as requested, the DCP and the ACP in charge of the SCID, Panti
\nrather than investigating the assault and attempt made on the life of
\nSowore, or the alleged offense of \u2018two fighting\u2019 earlier alluded to by the
\nIPO, told him in unmistaken terms to forego the case and accept an
\namicable settlement or resolution with Fatodu. A senior lawyer and
\nactivist, Dr. Tunji Abayomi, who was among the numerous persons present
\nduring the meeting at the DCP\u2019s office where the peaceful settlement was
\ndiscussed offered to interface between the parties and report back to the
\nDCP on Tuesday the 17th<\/span><\/span> day of January, 2017.
\n\u201cWe are\u00a0 indicating to the Nigerian public our total rejection of the
\nso-called mediation; it was a ruse packaged by the CP to fool the public.\u201d<\/p>\n

Mr. Effiong stated that the police never informed Mr. Sowore throughout
\nhis stay at Area \u2018F\u2019 and SCID, Panti that he was being investigated for
\nalleged criminal defamation or blackmail. He added that his client was
\nnever \u201cquestioned or confronted with evidence in respect of the malicious,
\nunfounded and spurious allegations even though Mr. Mba admitted that the
\nCP had sent a \u2018petition\u2019 against Sowore to his office in a separate car.
\nThe petition was a photocopy, a situation Mr. Mba told Sowore, was also
\nirregular.<\/p>\n

Though the Lagos CP had brandished a piece of paper which he claimed
\ncontained a petition supposedly written by Fatodu against Sowore and
\nUK-based activist, Kayode Ogundamisi for \u2018criminal defamation\u2019, Sowore was
\nneither given, shown nor allowed to peruse or respond to the alleged
\npetition and the contents thereof despite asking for same.\u201d According to
\nMr. Effiong, \u201cThe CP was actually incensed by Sowore\u2019s demand to be given
\nthe petition and allowed to respond,\u201d adding that the commissioner
\nfuriously asked Mr Sowore, \u201cwho do you think you are\u2019\u2019?<\/p>\n

Mr. Effiong stated that he was dismayed that \u201cthe very person who
\nassaulted and attempted to kill Sowore is now doling out tissues of lies
\nto the public despite the questionable mediation initiated by the Police
\nfor his benefit.<\/p>\n

The fact that Fatodu\u00a0 and the Mr. Owoseni disingenuously went to press
\nafter Thursday\u2019s<\/span><\/span> meeting at the SCID, Panti and infamously accused Sowore
\nof \u2018criminal defamation\u2019, \u2018blackmail\u2019 and boasted of having in his
\npossession either non-existent or fabricated evidence is, to say the least
\ndefamatory, irresponsible and utterly ludicrous.\u201d<\/p>\n

Mr. Effiong vehemently \u201cagain\u201d condemn a press interview that appeared
\nearlier today and attributed to the Commissioner of Police where Mr.
\nOwoseni claiming that it was Sowore who first alerted the police.
\nAccording to Mr. Effiong, \u201cWhen police arrived with Fatodu, they claimed
\nit was the public that alerted them to a robbery incident via a distress
\ncall.\u201d<\/p>\n

Mr. Sowore\u2019s lawyer stated that Mr. Fatodu was not acting alone. \u201cThe
\ntreacherous attempts by Fatodu to dishonestly denigrate Sowore, for
\nimmediate and insatiable gains is most unfortunate.\u201d Mr. Effiong said that
\nMr. Sowore had \u201cresisted compromising offers from different governments at
\nall levels and politically exposed persons in Nigeria right from his days
\nas a fearless student leader,\u201d adding that his client could not
\n\u201ccondescend to the level of seeking pecuniary benefits from the very
\nperson he has assisted financially and otherwise for several years.\u201d<\/p>\n

He warned those who think \u201cthey can use Mr. Fatodu or any other
\nmischievous element to cow or blackmail Sowore and SaharaReporters into
\nsubmission\u201d to \u201cwake-up from their self-induced slumber because it is
\neasier for the camel to pass through the needle than for Sowore or
