{"id":55607,"date":"2017-01-21T19:21:59","date_gmt":"2017-01-21T18:21:59","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=55607"},"modified":"2017-01-21T20:26:16","modified_gmt":"2017-01-21T19:26:16","slug":"diezani-describes-forfeited-153-3million-hoax-challenges-efcc-publish-details","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/diezani-describes-forfeited-153-3million-hoax-challenges-efcc-publish-details\/","title":{"rendered":"Diezani Describes Forfeited $153.3million As A Hoax, Challenges EFCC To Publish Details"},"content":{"rendered":"<p><iframe width=\"1170\" height=\"658\" src=\"https:\/\/www.youtube.com\/embed\/hIQdZfz_JdA?feature=oembed\" frameborder=\"0\" allowfullscreen><\/iframe><\/p>\n<p>Former Petroleum Minister, Mrs. Diezani Alison-Madueke has said the<br \/>\n$153.3million allegedly forfeited by her to the Nigerian Government is a<br \/>\nhoax, a bogus lies aimed at tarnishing her reputation.<\/p>\n<p>Mrs. Madueke who is currently recuperating at a London Hospital where she<br \/>\nis undergoing treatment for cancer challenged the Economic and Financial<br \/>\nCrimes Commission, EFCC, to publish the account details linking where the<br \/>\n$153.3million was found.<\/p>\n<p>The former Petroleum Minister said no one has contacted her in regards to<br \/>\nthe $153.3million allegedly found in her account, yet her name has been<br \/>\nlinked as the owner of the said huge sums<\/p>\n<p>Below is Mrs. Alison-Madueke\u2019s response:<\/p>\n<p>DIEZANI ALISON-MADUEKE REFUTES EFCC $153.3 MILLION CLAIM AND RESPONDS TO<br \/>\nOTHER ALLEGATIONS<\/p>\n<p>I have up till now chosen to maintain my silence and not to respond to<br \/>\ninaccurate press reporting. However, given the level of deliberate<br \/>\ninaccuracies, I am now forced to respond because it is clear that the EFCC<br \/>\nis taking advantage of my silence to try me by media and to convict me in<br \/>\nthe eyes of the public on false reports.<\/p>\n<p>THE $153.3MILLION ALLEGATION<br \/>\nI am deeply disturbed and bewildered by recent media reports (Premium<br \/>\nTimes Thursday 12 January, 2017 and other dailies about the same time)<br \/>\nclaiming that by virtue of an order of the Federal High Court, I have<br \/>\nforfeited to the Federal Government, the sum of $153.3m which I<br \/>\npurportedly stole from the Nigerian National Petroleum Corporation, NNPC.<br \/>\nFirst and foremost, whilst the reasons for my being out of the country are<br \/>\npublic knowledge, the principle of fair hearing demands that I should have<br \/>\nbeen notified of formal charges if truly there was a prima facie evidence<br \/>\nor indictment against my person linking me with the said issue, so as to<br \/>\nensure that I had adequate legal representation. This was never\u00a0done.<br \/>\nI wish to state that I cannot forfeit what was never mine. I do not know<br \/>\nthe basis on which the EFCC have chosen to say that I am the owner of<br \/>\nthese funds as no evidence was provided to me before the order was<br \/>\nobtained and they have not in fact served me with the order or, any<br \/>\nevidence since they obtained it. As at the time of my writing this<br \/>\nrebuttal (Thursday 19th January, 2017) the EFCC have still not furnished<br \/>\nme or my Lawyers, with a copy of the order.<br \/>\nI am also informed by my lawyers that the legislation under which the EFCC<br \/>\nobtained this order is for situations where the\u00a0 funds are believed to be<br \/>\nthe proceeds of crime and the owner is not known. I do not therefore,<br \/>\nunderstand how the EFCC can in the same breath say that the monies in<br \/>\nquestion are mine. If they had evidence that the monies were mine then<br \/>\nthey would not \/should not, have used the procedure which applies only to<br \/>\nfunds of unknown ownership. If indeed they used this particular legal<br \/>\nprocedure because they did not know who owned the monies, then how can<br \/>\nthey now be falsely attributing the ownership to me(Annex-1A).<br \/>\nLet me re-state categorically as I have always maintained, for the record,<br \/>\nI have NOT and WILL NEVER Steal Money from OR DEFRAUD the Federal<br \/>\nGovernment of Nigeria. I am willing to respond to any charges brought<br \/>\nagainst me that follow duly laid down procedures. However, in their<br \/>\ntypical manner and style, the EFCC have gone to the media to attempt to<br \/>\nprosecute their case as trial by TV and other media, rather than go<br \/>\nthrough the onerous but tried and tested means of the Judicial Court<br \/>\nprocess.<br \/>\nIn the face of the obvious falsification of facts and misinformation, it<br \/>\nis only right and proper that the EFCC should publish the details of the<br \/>\n$153.3M lodgements, the bank account numbers and the account<br \/>\nbeneficiaries, showing proof of my link to them. Having also alleged that<br \/>\nthe said $153.3M was \u2018wired\u2019 from NNPC, the EFCC should also publish<br \/>\ndetails of the NNPC accounts from where the said $153.3 million was taken<br \/>\nfrom, with proof that I authorized such a transaction\/transactions acting<br \/>\neither in my private capacity or, as The Honourable Minister of Petroleum.<br \/>\nLet me state for the record that as Minister of Petroleum, the operation<br \/>\nand management of NNPC finances were outside my purview as outlined in<br \/>\nboth the Petroleum Act and the NNPC Act. The only involvement I had in<br \/>\nNNPC Finances was in terms of statutory matters, where the Petroleum Act<br \/>\nprescribed that as Minister, there were certain duties or actions which I<br \/>\nhad to perform or take in relation to NNPC.<br \/>\n(See Petroleum Act \u2013\u00a0<a href=\"https:\/\/www.google.co.uk\/url?sa=t&amp;source=\" target=\"_blank\" rel=\"noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/www.google.co.uk\/url?sa%3Dt%26source%3D&amp;source=gmail&amp;ust=1485106361187000&amp;usg=AFQjCNES2UV53v4gpiMswmgoWm2tGzOdkA\">https:\/\/www.google.co.uk\/<wbr \/>url?sa=t&amp;source=<\/a>)<\/p>\n<p>MALABU<br \/>\nWith regards to\u00a0the various news reports published in both the online and<br \/>\nprint media, insidiously inferring that I was indicted by Italian<br \/>\nprosecutors for, as they put it, \u2018 sharing in the Loot\u2019 of the $1.3bn OPL<br \/>\n245 oil block deal that involved Malabu and the Joint Venture<br \/>\nMultinational partners, ENI(AGIP) and Royal Dutch Shell. Let me once again<br \/>\nState for the record, that this is another figment of the author\u2019s<br \/>\nimagination, which given the persistent bid to ensure my destruction and<br \/>\nstick all of the Sins of the Corruption plagued Oil and Gas Sector of over<br \/>\nthe last 30years upon my head, probably emanated from the EFCC itself!<br \/>\nLet me clarify the position re the history of OPL 245, otherwise known as<br \/>\nMalabu. You will find a full chronology in the attached report that I made<br \/>\nto the House of Representatives in late 2011 (Annex 2A\/Annex-2B).<br \/>\nIn 2010, shortly after I was appointed as Minister of Petroleum Resources,<br \/>\nthe issue of OPL 245 was brought to my attention. I looked into the case<br \/>\nand immediately became aware of the inherent and long standing<br \/>\nsensitivities around this issue. It became clear from the onset that this<br \/>\ncase was not within the direct purview of the Minister of Petroleum<br \/>\nResources but in the main was centered around issues of Law. By this time<br \/>\nthere was already an ICSID(International Centre for Settlement of<br \/>\nInvestment Disputes) investigation and claims against the FGN running into<br \/>\nbillions of dollars. Therefore, we took directives from the Chief Legal<br \/>\nOfficer of the Nation; the Attorney General and Minister of Justice. In<br \/>\nall of these matters due process was followed to the letter at all times.<br \/>\nI wish to categorically state that I have never held any discussions on<br \/>\nthis matter, with any individuals or entities outside of official<br \/>\nchannels. As Minister of Petroleum Resources, I did not participate in any<br \/>\nactivity relating to financial payments on\u00a0 the Malabu matter, other than<br \/>\nthose statutorily mandated to the Minister of Petroleum Resources by the<br \/>\nPetroleum Act. My role in this matter was a purely statutory one as<br \/>\nrequired by Law in the Petroleum Act<br \/>\n(<a href=\"https:\/\/www.google.co.uk\/url?sa=t&amp;sourc\" target=\"_blank\" rel=\"noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/www.google.co.uk\/url?sa%3Dt%26sourc&amp;source=gmail&amp;ust=1485106361188000&amp;usg=AFQjCNHFTYTuyIP2nBYXonvXl5972s3Gfg\">https:\/\/www.google.co.uk\/url?<wbr \/>sa=t&amp;sourc<\/a>) and the NNPC Act<br \/>\n(<a href=\"http:\/\/www.nigeria-law.org\/Nigerian%20\" target=\"_blank\" rel=\"noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=http:\/\/www.nigeria-law.org\/Nigerian%2520&amp;source=gmail&amp;ust=1485106361188000&amp;usg=AFQjCNGlNrWSv0yNCQ7YHP-KDhxI0Ii9UA\">http:\/\/www.nigeria-law.org\/<wbr \/>Nigerian%20<\/a>)<\/p>\n<p>THE ALJAZEERA REPORT \u2013 $18MILLION MANSION<br \/>\nOn the 13th of June 2016, the EFCC once again took their well-trodden path<br \/>\nto the media. This time claiming\u00a0 that they had \u2018discovered\u2019 a mansion in<br \/>\nAsokoro, Abuja, worth $18million\u00a0 (approx. N9billion) which they purported<br \/>\nto belong to me. The EFCC went to the extent of bringing in Aljazeera, an<br \/>\nInternational TV Station, to air a damaging documentary against me in this<br \/>\nregard, showing a particular residential building in Asokoro, Abuja, which<br \/>\nthey told Aljazeera belonged to<br \/>\nme\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=hIQdZfz_JdA\" target=\"_blank\" rel=\"noreferrer\" data-saferedirecturl=\"https:\/\/www.google.com\/url?hl=en&amp;q=https:\/\/www.youtube.com\/watch?v%3DhIQdZfz_JdA&amp;source=gmail&amp;ust=1485106361188000&amp;usg=AFQjCNFZ64hxglFsGS_B2cAF88JO20lyEQ\">https:\/\/www.youtube.com\/<wbr \/>watch?v=hIQdZfz_JdA<\/a>. The EFCC Chairman Ibrahim<br \/>\nMagu, personally took the Aljazeera reporter to the building, alleging<br \/>\nthat it belonged to me. It has since become apparent that the house<br \/>\nbelongs to a company owned by Mr Kola Aluko.<br \/>\nIf this is not a witch hunt or a personal vendetta against me, how is it<br \/>\nthat one of our Country\u2019s premier investigative agencies were unable to<br \/>\navail themselves of facts that are freely available in the public domain.<br \/>\nSince the EFCC claims that the alleged $18million Asokoro property belongs<br \/>\nto me, then they should kindly produce the \u2018Authentic\u2019 Certificate of<br \/>\nOccupancy and Land Registry information and any other relevant<br \/>\ninformation, as proof of my ownership of the property.<\/p>\n<p>FAMILY HOME \u2013 YENEGOA, BAYELSA STATE<br \/>\nOn the 9th November 2016, the EFCC visited our Family home in Yenegoa<br \/>\n(Bayelsa State) as pre-agreed and they were escorted around the premises.<br \/>\nI was therefore completely shocked to once again see my name sensationally<br \/>\nsplashed across the Front Pages of Newspapers and widely circulated on the<br \/>\ninternet, with blaring Headlines such as \u201cEFCC UNCOVERS DIEZANI\u2019S<br \/>\nMULTI-BILLION NAIRA ESTATE\u201d \u2013 Nation Newspaper, January 8, 2017 (Annex-<br \/>\n4A). There was absolutely nothing \u2018Hidden\u2019 or \u2018Concealed\u2019 about the home.<br \/>\nI HAD DECLARED IT OPENLY as required by Law, in my Asset declaration forms<br \/>\n(Annex-4B). Yet the EFCC have announced that they \u2018Just Discovered\u2019 my<br \/>\n\u2018Hidden Estate\u2019! And labelled it a \u2018Multi-Billion Naira Estate\u2019! Even<br \/>\nthough they had been given the Bill of Quantities, showing actual amount<br \/>\nspent.<\/p>\n<p>It is accepted Tradition across the length and breadth of Nigeria, for<br \/>\npeople to own Country\/Village homes. Given the size of the land and the<br \/>\nlocation of the compound, the buildings thereon cannot by any stretch of<br \/>\nthe imagination be a \u201cMulti-Billion Naira\u201d palatial estate, as the news<br \/>\nmongers would want to portray.<br \/>\nThe EFCC were taken on a tour of the compound which consisted of A Main<br \/>\nhouse, and two outhouses \u2013 An Obi (meeting bungalow) and a staff<br \/>\nquarters(BQ) building \u2013 above which we built 3 guest rooms and a parlour.<br \/>\nThe only other 2 structures are the gate and generator houses.<br \/>\nConstruction began in late 2011 and was handled in phases. During the<br \/>\nvisit the EFCC was given the bill of quantities, which up until the time<br \/>\nconstruction stopped in early 2015, due to my illness, was at<br \/>\napproximately N394million which was declared in the code of conduct<br \/>\ndocumentation, attached (the costs were partially funded by a loan \u2013 see<br \/>\ncode of conduct \u2013 Annex4B, the work is still uncompleted and the<br \/>\ncontractor is still being owed). Building costs escalated as a result of<br \/>\ndelays in construction and external factors such as the extreme flooding<br \/>\nof late 2012, that covered most of our areas in the Niger Delta.<br \/>\nIt is the accepted norm when building in the Niger Delta, that due to the<br \/>\ntopography of the land and the heavily waterlogged and marshy terrain,<br \/>\nconstruction is infinitely more expensive than in other parts of the<br \/>\nCountry, as by its nature it requires the building of extensive<br \/>\npiling\/raft foundations before any structural work can commence. The<br \/>\nflooding of 2012 compounded the problem and further increased the cost of<br \/>\nconstruction.<br \/>\n$700 Million Cash Found In My House<br \/>\nStories were circulated by unscrupulous agents of calumny that\u00a0 the EFCC<br \/>\nfound a mind boggling $700million in cash in my home in Abuja. Would the<br \/>\nvideos of this $700 million cash discovery not have made good viewing? Or<br \/>\nshould those who recovered this money not tell the public where exactly<br \/>\nthe money has been kept? Perhaps the Central bank should corroborate that<br \/>\nit is in custody of these monies allegedly found in my house? But then, it<br \/>\nis now patently apparent that Nigerians are no longer easily led to<br \/>\nbelieve\u00a0 fables and sensational untruths.<\/p>\n<p>REALITY VERSUS FICTION<br \/>\nI would like to state for the record that I performed my duty as Minister<br \/>\nof Petroleum Resources with the utmost sincerity and sense of<br \/>\nresponsibility, ensuring that all Nigerians irrespective of creed, gender<br \/>\nor tribe enjoyed their rightful benefits from the Oil and Gas Sector.<br \/>\n$5.6 Billion LNG Dividend Fund<br \/>\nIt is pertinent to note that at the end of my tenure, I left behind in the<br \/>\nLNG dividend fund, for the incoming Administration, the sum of<br \/>\n$5.6billion(five billion six hundred million US Dollars)(Annex-6A). I did<br \/>\nthis to ensure continuity in the crucial gas sector development which<br \/>\nunderpins the entire Power and Energy Sector and which was and still is,<br \/>\nabsolutely imperative for the Country\u2019s current and future economic<br \/>\ndevelopment.<br \/>\nLocal Content<br \/>\nHaving pushed for the full implementation of the Nigerian Local Content<br \/>\nAct, despite resistance from various stakeholders, I actively promoted the<br \/>\nbenefits of \u2018Nigerians Right to First Consideration\u2019 in both the<br \/>\ndownstream and upstream sectors. The immediate effect of my actions was<br \/>\nthat for the first time in history, thousands of Nigerians were able to<br \/>\nbreak through the barriers of a sector that had hitherto been the preserve<br \/>\nof a few powerful groups with vested interest, and thereby earn a living.<br \/>\nThis remains a source of pride to me, that not only did it create wealth<br \/>\nacross the entire economic value chain but it also ensured the<br \/>\nunparalleled transfers of knowledge and expertise for our indigenous<br \/>\noperators. It is noteworthy that the template is being adapted for use in<br \/>\nother countries.<br \/>\nFuel Scarcity<br \/>\nIt is on record, that I immediately took the issue of incessant fuel<br \/>\nqueues head-on and in my time as petroleum minister, Nigerians rarely<br \/>\nexperienced fuel shortages. These queues had long dominated our landscape,<br \/>\ncausing untold hardship to millions of ordinary Nigerians stuck in fuel<br \/>\nqueues for hours; like the bus driver who was unable to earn enough to go<br \/>\nto the market, and the market woman who, therefore, earned less and so<br \/>\ncould not afford school fees. This example, though at the most basic<br \/>\nlevel, caused a chain reaction which was replicated in various facets<br \/>\nthroughout the economy. So, on the macro economic level, the main benefit<br \/>\nof ending the fuel queues was an immediate increase in GDP, reduction in<br \/>\ninflation and easier facilitation and movement of people, goods and<br \/>\nservices, across the country.<br \/>\nThe continuing effect of all these measures were that even in the most<br \/>\nremote locations, Nigerians could buy and sell petroleum products.<br \/>\nGas Supply &amp; Infrastructure<br \/>\nAs soon as I assumed office, I put into play my wealth of experience in<br \/>\nthe oil and gas sector, knowing that gas was imperative for our future<br \/>\ngrowth and prosperity. I put together a team to look at all aspects of<br \/>\ngrowing Nigeria\u2019s Gas with the intent of turning Nigeria into a Premier<br \/>\nGas Exploring and Producing Country, even more than an oil producing<br \/>\ncountry. We started working on Gas for Industry \u2013 The commercialisation<br \/>\napproach, Gas for home use \u2013 LPG, and Gas for Power generation. We even<br \/>\nsponsored a pilot scheme for Gas to power vehicles. I implemented a short,<br \/>\nmedium and long term project to put in place sustainable gas supply to<br \/>\nunderpin the power sector and began laying the requisite infrastructure<br \/>\nthat was virtually non-existent when we took office. We worked with NERC<br \/>\nand the CBN to put in place the necessary fiscal levers, to ensure that<br \/>\nGas supply would be competitively priced. I left behind a comprehensive<br \/>\nand detailed plan for the rollout of LPG and the Industrialisation of GAS<br \/>\neg. The Ogidingben project.<\/p>\n<p>Petroleum Industry Bill<br \/>\nI personally worked tirelessly through the night on many occasions, with<br \/>\nthe committee on the Petroleum Industry Bill, to finally get it to the<br \/>\npoint where for the first time in over 12 years, we could place it before<br \/>\nthe Federal Executive Council, and the National Assembly. I championed<br \/>\nthis in a bid to create a less corrupt, more transparent, accountable and<br \/>\nresponsible NNPC and Oil and Gas Industry as a whole. It was also to<br \/>\ncreate additional funding inflows for the Nation. This was in spite of the<br \/>\nfact that there was major resistance from powerful interest groups within<br \/>\nand outside Nigeria.<br \/>\nI take personal satisfaction even now, that the PIB template I presented<br \/>\nto the country is still the benchmark for the current and future<br \/>\ndevelopment of the Oil Sector in Nigeria. The Template is already being<br \/>\nadapted for use in other countries.<\/p>\n<p>MY POSITION<br \/>\nIt is saddening that after eight years of serving my country, my<br \/>\nexperience as a public servant has been fraught with continuous malicious<br \/>\ncastigation and character assassination, all in the name of \u2018personal<br \/>\nvendettas\u2019 or political horse trading. It has become apparent to many that<br \/>\nthese untruths told were at best well-crafted fables. The most dramatic<br \/>\nand damning accusation was the infamous missing $49.8 Billion Dollars,<br \/>\nthat went from to $12 Billion and then up to $20 Billion and which was<br \/>\nalleged missing from NNPC. Today, we all know that the PWC report that was<br \/>\npublished cleared me of any wrong doing and no one up till now has been<br \/>\nable to controvert the PWC report nor has anyone found the \u201cmissing\u201d 20<br \/>\nbillion, or who took it. In addition, the Makarfi-led committee in the<br \/>\nSenate of The\u00a0 Federal Republic of Nigeria, in a series of publicly-held<br \/>\nhearings, also vindicated me on the matter of the purportedly missing<br \/>\nfunds. Yet, we are all silent as if these events never occurred! SEE<br \/>\nATTACHMENT-1 THAT<\/p>\n<p>EXPLAINS MY POSITION ON THE \u2018MISSING\u2019 $20 BILLION.<br \/>\nThe allegations that I have addressed above are no different, the<br \/>\ncharacter assassination continues, this time with a new set of hirelings.<br \/>\nOne of the basic tenets of the human trait is that we all have<br \/>\nshortcomings and we all make our fair share of mistakes, whether we are in<br \/>\npositions of Leadership, or not. However, one error that cannot be<br \/>\nascribed to me is STEALING FROM NIGERIA &amp; DEFRAUDING MY COUNTRY! It is<br \/>\ntherefore sad and distressing that in spite of all that I tried to do in<br \/>\nthe best interest of our Nation, I continue to be faced with constant<br \/>\ndemonisation, unproven accusations and deeply personal insults.<br \/>\nIn response I have chosen not to insult, accuse or demonism anyone, any<br \/>\nperson or persons. In spite of all the allegations that have been made<br \/>\nagainst me, not one has been factually proven.<br \/>\nI remain very proud of the fact that all the policies, tenets and plans<br \/>\nthat I initiated in the Oil &amp; Gas sector are still underpinning the entire<br \/>\nstructure. This is because they were put in place with the good of the<br \/>\nentire nation and its people in mind. They were not factional, or tribal,<br \/>\nneither were they based on religious bias.<br \/>\nI am a woman from the Niger Delta, who through perseverance and sheer hard<br \/>\nwork rose to one of the highest positions in the Country\u2019s premier<br \/>\nInternational Oil Company, and in tune with my ethos of hard work I earned<br \/>\nthe prestigious British Foreign &amp; Commonwealth Chevening Scholarship Award<br \/>\nand was thereafter admitted to my MBA program at the World renowned<br \/>\nCambridge University. In 2006, I was appointed as the first female<br \/>\nexecutive director in the history of Shell Petroleum, Nigeria. Just over a<br \/>\nyear later, I was nominated and appointed as a minister of the Federal<br \/>\nRepublic of Nigeria, culminating in my appointment as Nigeria\u2019s first<br \/>\nfemale Minister of Petroleum, where again by dint of hard work I was<br \/>\nappointed as the first female in history(in a completely male dominated<br \/>\nspace) to hold the Presidency of OPEC.<br \/>\nI can therefore, NO LONGER SIT BACK and allow the fabricated accusations<br \/>\nagainst my person designed by unscrupulous persons with a vengeful agenda<br \/>\ngo unchallenged.<br \/>\nAs a Christian, it is my sincerely held belief that in the coming months,<br \/>\nhistory will be the judge of exactly who Lied and who told the Truth.
