{"id":55829,"date":"2017-01-31T06:20:55","date_gmt":"2017-01-31T05:20:55","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=55829"},"modified":"2017-01-31T06:20:55","modified_gmt":"2017-01-31T05:20:55","slug":"alleged-n40bn-fraud-ekiti-house-assembly-gives-efcc-21-day-ultimatum-investigate-fayemi-others-accuses-efcc-compromise","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/alleged-n40bn-fraud-ekiti-house-assembly-gives-efcc-21-day-ultimatum-investigate-fayemi-others-accuses-efcc-compromise\/","title":{"rendered":"Alleged N40bn Fraud: Ekiti House of Assembly gives EFCC 21-day ultimatum to investigate Fayemi, others; accuses EFCC of compromise"},"content":{"rendered":"<p>The Ekiti State House of Assembly has given the Economic and Financial<br \/>\nCrimes Commission (EFCC), 21-day ultimatum to commence investigation<br \/>\ninto the allegation of N40 billion fraud made against the immediate<br \/>\npast governor of the State and Minister of Mines and Steel<br \/>\nDevelopment, Dr Kayode Fayemi and others, or face legal action,<br \/>\naccusing the anti-corruption commission of compromise.<\/p>\n<p>The House of Assembly, in a letter reminding the EFCC of the petition<br \/>\nit submitted to the commission on October 27, 2016, said;\u00a0 \u201cshould the<br \/>\nEFCC fail, refuse and or neglect to act on this petition within 21<br \/>\ndays of receipt of this letter of reminder; we shall have no option<br \/>\nthan to institute legal action against you. Consequently, we shall be<br \/>\nasking for an order of mandamus compelling you to perform your duties<br \/>\naccording to the 1999 Constitution of the Federal Republic of Nigeria<br \/>\n(as amended) and the EFCC Act 2004.\u201d<\/p>\n<p>The house had submitted a petition, dated October 24, 2016 and signed<br \/>\nby the Speaker, Pastor Kolawole Oluwawole, to the EFCC in Abuja on<br \/>\nOctober 27, 2016, complaining of fraudulent practices against Dr.<br \/>\nFayemi, Mr Dapo Kolawole, Mr Yemi Adaramodu, Mr Abiodun Oyebanji, Arc<br \/>\nOyelade (CASA Nig Ltd), Mr Bayo Kelekun and others.<\/p>\n<p>However, more than three months after submitting the petition with<br \/>\nrelevant documents, the EFCC has not acted on it.<\/p>\n<p>The letter of reminder, also signed by the Speaker and submitted by<br \/>\nthe Deputy Speaker, Hon Segun Adewumi and Chairman of the House<br \/>\nCommittee on Information, Dr Samuel Omotoso read; \u201cWe write to remind<br \/>\nyou of our petition dated 24th October 2016, which was submitted and<br \/>\nduly received in your office on 27th October 2016.<\/p>\n<p>\u201cThree months after the petition was submitted, you have refused, and<br \/>\nor neglected to act on it.<\/p>\n<p>\u201cThis is at variance with the speed and swiftness with which you have<br \/>\nacted on other petitions, especially those involving members of the<br \/>\nPeoples Democratic Party (PDP), and this is confirming the general<br \/>\nbelief that you have been forbidden to act on any complaint against<br \/>\nfunctionaries of the APC led government.<\/p>\n<p>\u201cEven though we have closed our ears to insinuations that your office<br \/>\nis under a very strong influence to sweep under the carpet, any<br \/>\ncomplaint that is made against Dr Kayode Fayemi and other top<br \/>\nfunctionaries of the federal government, your refusal to act on our<br \/>\npetition, three months after it was submitted is making us to think<br \/>\notherwise.<\/p>\n<p>\u201cTherefore, in view of the need for an all-inclusive anti-corruption<br \/>\nfight, we implore that you direct thorough investigation into the<br \/>\nalleged fraudulent practices enumerated in our complaint dated October<br \/>\n24, 2016 (See attached) with a view to bringing anyone fund culpable<br \/>\nto justice.<\/p>\n<p>\u201cWe again attach herewith copies of relevant documents submitted with<br \/>\nthe petition and hope that this time around; you will not shy away<br \/>\nfrom your responsibility this time around.<\/p>\n<p>\u201cHowever, should you fail, refuse and or neglect to act on this<br \/>\npetition <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_802442662\"><span class=\"aQJ\">within 21 days<\/span><\/span> of receipt of this letter of reminder; we<br \/>\nshall have no option than to institute legal action against you.<br \/>\nConsequently, we shall be asking for an order of mandamus compelling<br \/>\nyou to perform your duties according to the 1999 Constitution of the<br \/>\nFederal Republic of Nigeria (as amended) and the EFCC Act 2004.\u201d<\/p>\n<p>Speaking to journalists after submitting the reminder, Dr Omotoso, who<br \/>\nwas flanked by Hon Adewumi said the APC led federal government was<br \/>\nfighting corruption involving opposition sulphuric acid while using<br \/>\ncold water to fight the ones involving APC members and functionaries<br \/>\nof the federal government.<\/p>\n<p>He said the misappropriation of the SUBEB N852.9 million has done<br \/>\nincalculable damage to education of children in Ekiti State, adding<br \/>\nthat the rights of Ekiti children to education was being violated with<br \/>\nthe\u00a0 collaboration of EFCC.<\/p>\n<p>Dr Omotoso called on Nigerians to help prevail on the EFCC to perform<br \/>\nits duties without bias, saying; &#8220;Ekiti people are suffering from the<br \/>\nconsequences of the looting of their collective wealth by Dr Fayemi<br \/>\nand others, and it is sad that EFCC appears to be in support of this<br \/>\ncriminal and inhuman act.&#8221;<\/p>\n<p>The petition, dated October 24, 2016 and signed by Speaker of the<br \/>\nHouse of Assembly, Pastor Kolawole Oluwawole, was submitted to the<br \/>\nEFCC in Abuja today, by the trio of the Deputy Speaker, Hon Segun<br \/>\nAdewumi, Chairman House Committee on Information, Dr Samuel Omotoso<br \/>\nand Hon Sina Animasaun.<\/p>\n<p>In the petition, dated October 24, 2016 and submitted on October 27,<br \/>\n2016 with several documents, the House accused Dr Fayemi and others of<br \/>\nfraudulent practices \u201cincluding, but not limited to contracts<br \/>\ninflation, misappropriation of fund, diversion of Local Council and<br \/>\nState Universal Basic Education (SUBEB) funds, amongst others.\u201d<\/p>\n<p>Fayemi and others were accused of diverting N8552.9 million belonging<br \/>\nto the State Universal Basic Education Board (SUBEB).<\/p>\n<p>\u201cA sum of\u00a0 N852, 936,713.92 was illegal\u00a0 withdrawn from SUBEB Access<br \/>\nBank Account Number 0065385694 on October 8, 2014, eight days to the<br \/>\nend of Dr Fayemi\u2019s tenure as Ekiti State governor. The N852,<br \/>\n936,713.92 was counterpart fund paid by the Ekiti State Government to<br \/>\naccess the Universal Basic Education Commission (UBEC) 2012 Marching<br \/>\nGrant of N852, 936,793.12.<\/p>\n<p>\u201cThis illegal withdrawal was in contravention of Section 11(2) of the<br \/>\nUniversal Basic Education (UBE) Act, 2004.<\/p>\n<p>\u201cIt should be noted that UBEC Deputy Executive Secretary, Dr. Yakubu<br \/>\nGambo told the Senate Committee on Finance\u2019s Budget Defence that Dr<br \/>\nFayemi, used the N852.9 million counterpart funds dedicated for<br \/>\neducation by the federal government through the UBEC for other<br \/>\npurposes.<\/p>\n<p>\u201cMr Dapo Kolawole, who was Fayemi\u2019s Commissioner for Finance, while<br \/>\ndefending the allegation, said there was no law forbidding States from<br \/>\nborrowing counterpart funds to support states capital development<br \/>\noperations.<\/p>\n<p>\u201cConsequent upon this illegal withdrawal, UBEC caused a letter to be<br \/>\nwritten to the Ekiti SUBEB in which the commission called for the<br \/>\nreturn of the N852, 936,713.92 to the account of SUBEB.<\/p>\n<p>\u201cUBEC also suspended Ekiti SUBEB from accessing any further FGN-UBE<br \/>\nIntervention Fund until further notice.<\/p>\n<p>\u201cUBEC, in the letter dated April 16, 2015, with Reference Number;<br \/>\nUBEC\/FA\/SUBEB\/EK\/183\/Vol.II\/<wbr \/>162 described the withdrawal as criminal<br \/>\nact that violated Section 11(2) of UBE Act 2004 and conveyed its<br \/>\nsuspension of Ekiti State from accessing any further FGN-UBE<br \/>\nIntervention Fund.<\/p>\n<p>\u201cUBEC letters dated April 16, 2015 and April 29, 2015 as well extract<br \/>\nfrom Ekiti SUBEB Statement of Account are herewith attached.\u201d<\/p>\n<p>The House also listed contract for the construction of a New Civic<br \/>\nCentre awarded to TIANJIN-YUYANG Construction Eng. Limited on August<br \/>\n30, 2012 at the cost of N2, 573,584,395.75 and contract for the<br \/>\nconstruction of earthwork for New Governor\u2019s Office was awarded to<br \/>\nPONTI-ITALWARE Nig Ltd on March 3rd, 2012 at the sum of N383,<br \/>\n900,911.06, noting that despite that N115, 170,273.32 was paid to the<br \/>\ncontractor for earthwork, the site was abandoned, with no significant<br \/>\nwork done.<\/p>\n<p>\u201cAlso, contract for the construction of the New Governor\u2019s Office was<br \/>\nawarded to Messrs Interkel Nig. Ltd (12, Maitama Sule Street,<br \/>\nSouthwest Ikoyi, Lagos 0812900918) on March 1, 2014. The contract sum<br \/>\nwas N2, 027,495,857.45. Out of the 30% mobilisation fee of N608,<br \/>\n248,757.24, a sum of N100 million was paid to the contractor with<br \/>\nnothing to show,\u201d the House alleged.<\/p>\n<p>Alleging further, the House said; \u201cTowards the June 21, 2014<br \/>\ngovernorship election, N5 billion loan was obtained, using Fountain<br \/>\nHoldings Limited, a company with N15 million share capital. The N5<br \/>\nbillion loan was obtained from EcoBank without recourse to the Debt<br \/>\nManagement Office (DMO) and it was claimed that the loan was used to<br \/>\nexecute capital projects like construction of roads.<\/p>\n<p>\u201cOur question is; is it part of the responsibilities of Fountain Holdings<br \/>\nLimited to execute capital projects like road construction on behalf of<br \/>\nEkiti State Government?<\/p>\n<p>\u201cFor your information, Fountain Holdings Limited is an investment<br \/>\ncompany owned by the Ekiti State Government. The responsibility of<br \/>\nFountain Holdings Limited is to manage and supervise all companies<br \/>\nowned by the Ekiti State Government. The Share Capital of the company<br \/>\nis N15m, and we wonder how a company with N15m Share Capital could be<br \/>\ngranted N5bn loan by EcoBank without any recourse to the DMO!<\/p>\n<p>\u201cAs at today, there is no single evidence of utilisation of the N5 billion,<br \/>\nsuggesting that the loan was taken to fund Fayemi\u2019s botched re-election<br \/>\nbid.\u201d<\/p>\n<p>The House also accused Fayemi of fraudulently purchasing 156 units of<br \/>\nFord vehicles from Coscharis Motors Limited, for traditional rulers in<br \/>\nthe State.<\/p>\n<p>\u201cN1.2 billion loan was obtained from First Bank Plc for the purchase<br \/>\nof 156 units of Ford vehicles from Coscharis Motors Limited, for<br \/>\ntraditional rulers in the State.<\/p>\n<p>\u201cIt is on record that only 156 units of the vehicles were delivered<br \/>\nwhile Coscharis, in its letter dated May 2, 2014 said it delivered 235<br \/>\nunits. Up till today, the remaining 79 vehicles are yet to be<br \/>\naccounted.<\/p>\n<p>\u201cIt is also on record that proposal for the supply of vehicles was<br \/>\nsubmitted on November 14, 2013 while the vehicles were distributed to<br \/>\nthe Obas on August 27, 2013! The supplier, Coscharis also registered<br \/>\nas a civil\/building contractor in Ekiti State on November 13, 2013.<\/p>\n<p>\u201cCoscharis, which supplied the vehicles only registered as a<br \/>\ncivil\/building contractor in Ekiti State on November 13, 2013 and<br \/>\nsubmitted proposal for the supply of the vehicles on November 14, 2013<br \/>\nwhile the vehicles were supplied in August 2013 and distributed on<br \/>\nAugust 27, 2013, three clear months before the proposal to supply the<br \/>\nvehicles was made.<\/p>\n<p>\u201cFurthermore, it is also on record that instructions were sent to<br \/>\nLocal Government Chairmen on November 15, 2013 to deliberate on the<br \/>\nproposal sent by Coscharis on November 14, 2013 in their F&amp;GPC<br \/>\nmeetings and their decision to get back to the Ministry of Local<br \/>\nGovernment and Chieftaincy Affairs not later than November 22, 2013;<br \/>\nwhile the vehicles they were to deliberate upon in the F&amp;GPC meetings<br \/>\nin November were delivered in August and distributed to the Obas on<br \/>\nAugust 27, 2013.<\/p>\n<p>\u201cAlso, while the vehicles were distributed on August 27, 2013 and the<br \/>\ntracking done on September 13, 2013, certificate of no objection to<br \/>\nprocure the vehicles was issued on February 24, 2014,\u201d the House<br \/>\nclaimed.<\/p>\n<p>On the N25 billion sourced from the capital market to finance capital<br \/>\nprojects, the House said; \u201cThe Bond Prospectus, which was approved by<br \/>\nthe House of Assembly was not adhered to as the money was diverted<br \/>\ninto projects not listed in the Bond Prospectus.
