{"id":56465,"date":"2017-03-01T20:28:25","date_gmt":"2017-03-01T19:28:25","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=56465"},"modified":"2017-03-01T20:28:25","modified_gmt":"2017-03-01T19:28:25","slug":"dahiru-seeks-court-order-remove-tambuwal-sokoto-governor","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/dahiru-seeks-court-order-remove-tambuwal-sokoto-governor\/","title":{"rendered":"Dahiru Seeks Court Order To Remove Tambuwal As Sokoto Governor"},"content":{"rendered":"<p>The Federal High Court in Abuja will on <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1108940023\"><span class=\"aQJ\">March 10<\/span><\/span> give ruling on whether to<br \/>\nallow or refuse an application seeking to amend an originating summon<br \/>\npleading for the removal of the Sokoto State governor, Malam Aminu Waziri<br \/>\nTambuwal, from office on the account that the primary election of the All<br \/>\nProgressive Congress (APC) that produced him for the 2015 governorship<br \/>\nelection was not validly conducted.<\/p>\n<p>The application filed by Senator Umaru Dahiru, an APC governorship<br \/>\naspirant, and argued by his counsel, Mr. Ikoro I. Ikoro, sought to amend<br \/>\nthe originating summon filed against the APC, Tambuwal and the Independent<br \/>\nNational Electoral Commission as 1st, 2nd and 3rd defendants respectively<br \/>\nbefore the April 11, 2015 governorship election.<\/p>\n<p>In the amendment being sought, Senator Dahiru is now asking the Federal<br \/>\nHigh Court to remove Governor Tambuwal from office and declare him as the<br \/>\nwinner of the December 2014 APC primary election. The applicant also asked<br \/>\nthe court for an order compelling INEC to withdraw the certificate of<br \/>\nreturn issued to Governor Tambuwal and present it to him on the grounds<br \/>\nthat he was the lawfully elected candidate of the APC at the primary<br \/>\nelection.<\/p>\n<p>The Senator also sought an order nullifying the nomination of Tambuwal by<br \/>\nAPC for the 2015 governorship election and replaced him as the properly<br \/>\nnominated APC candidate to INEC for the 2015 governorship election.<br \/>\nHowever, in his vehement objection to the application, the APC asked the<br \/>\ncourt to dismiss the request for the amendment on the ground that it is<br \/>\nnot in compliance with the Supreme Court Judgment of <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1108940024\"><span class=\"aQJ\">December 9<\/span><\/span>, last year<br \/>\nwhich ordered a retrial of the plaintiff\u2019s case.<\/p>\n<p>The APC represented by Mr. Jubrin Okutepa SAN argued yesterday that the<br \/>\napplicant, Senator Dahiru had changed the character and direction of his<br \/>\nearlier originating summon. The party told the court that the applicant<br \/>\nsought to amend the originating summon because of his sudden discovery<br \/>\nthat event had overtaken the initial originating summon and that any<br \/>\nattempt to allow the amendment will amount to an affront to the Supreme<br \/>\nCourt Judgment of December last year.<\/p>\n<p>Okutepa further argued that the applicant was not consistent in the<br \/>\nreliefs been sought in the proposed amendment, adding that in the<br \/>\noriginating summon, the applicant had asked the court to nullify the APC<br \/>\nprimary election on the grounds that it was unlawfully conducted and that<br \/>\nthe same applicant cannot seek to be declared winner of the said<br \/>\nunlawfully conducted primary election.<\/p>\n<p>The counsel therefore urged the court to refuse the proposed amendment and<br \/>\nallow hearing in the initial originating summon as directed by the Supreme<br \/>\nCourt. Counsel to Tambuwal Mr. <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1108940025\"><span class=\"aQJ\">Sunday<\/span><\/span> Ibrahim Ameh SAN aligned himself<br \/>\nwith the submission of the APC and urged the court to hold that the<br \/>\namendment being sought by the governorship aspirant is unmeritorious.<\/p>\n<p>The counsel insisted that it is too late in the day for the applicant to<br \/>\nseek the relief after the governorship election had been conducted adding<br \/>\nthat the proper place for the applicant to ventilate his anger is the<br \/>\nelection petition tribunal. Ameh also submitted that the applicant cannot<br \/>\neven go to any Election Petition Tribunal because the 21 days required by<br \/>\nlaw under which a petition can be filed to challenge the election of any<br \/>\ndeclared winner had lapsed since 2015.<\/p>\n<p>The senior counsel therefore urged the court to refuse the temptation of<br \/>\nturning itself to an election petition tribunal as there is no law for<br \/>\nsuch an action.
