{"id":57835,"date":"2017-05-24T13:23:04","date_gmt":"2017-05-24T12:23:04","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=57835"},"modified":"2017-05-24T13:23:04","modified_gmt":"2017-05-24T12:23:04","slug":"serap-fashola-order-discos-provide-pre-paid-meters-nigerians-face-legal-action","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/articles-opinions\/serap-fashola-order-discos-provide-pre-paid-meters-nigerians-face-legal-action\/","title":{"rendered":"*SERAP to Fashola: Order DISCOs to provide pre-paid meters to Nigerians or face legal action*"},"content":{"rendered":"<p>Socio-Economic Rights and Accountability Project (SERAP) has sent an open<br \/>\nletter to the Minister of Power, Works and Housing Babatunde Fashola, SAN<br \/>\nrequesting him to use his \u201cgood offices and leadership position to urgently<br \/>\nenforce your directives to electricity distribution companies (DISCOs) to<br \/>\nprovide free pre-paid meters to Nigerians, and end the use of patently<br \/>\nillegal and inordinate estimated billing across the country.\u201d<\/p>\n<p>The organization asked Mr Fashola to \u201ctake this step <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_696871283\"><span class=\"aQJ\">within 7 days<\/span><\/span> of the<br \/>\nreceipt and\/or publication of this letter, failing which SERAP will<br \/>\ninstitute appropriate legal proceedings to compel the discharge of your<br \/>\nministerial and statutory duty in this matter in order to ensure completion<br \/>\nof metering of unmetered customers and total abolition of estimated billing<br \/>\nin the country.\u201d<\/p>\n<p>In the letter dated 22 May 2017 and signed by SERAP executive director<br \/>\nAdetokunbo Mumuni, the organization expressed \u201cconcern that while countries<br \/>\nlike Zambia are subsidising electricity payments to enable consumption by<br \/>\nsocially and economically vulnerable groups, this government is implicitly<br \/>\npromoting the use of unjustifiable estimated billing, and increasing<br \/>\nconsumer costs. The use of estimated billing is marginalizing Nigerians<br \/>\nliving in extreme poverty, disproportionately affecting women, children and<br \/>\nthe elderly, and increasing their vulnerability to discrimination.\u201d<\/p>\n<p>According to the organization, \u201cExcessive billing of customers is<br \/>\narbitrary, unfair, unjust, unreasonable and exploitative of millions of<br \/>\nsocially and economically vulnerable groups. SERAP is concerned that the<br \/>\napparent failure of your office to exercise due diligence and effective<br \/>\nregulatory oversight on DISCOs to ensure full compliance with your<br \/>\ndirectives to provide free pre-paid meters to Nigerians has denied millions<br \/>\nof customers regular and uninterrupted access to electricity.\u201d<\/p>\n<p>The letter read in part: \u201cIt\u2019s the responsibility of this government and<br \/>\nyour ministry to ensure that the privatisation of the power sector does not<br \/>\nimpair in any way, shape, or form access of Nigerians to regular and<br \/>\nuninterrupted electricity supply by among others actively promoting the<br \/>\nprovision of pre-paid meters to all Nigerians particularly the socially and<br \/>\neconomically vulnerable groups. Nigerians should not be penalized by<br \/>\ndisconnection or denial of access to electricity because they cannot pay<br \/>\nunwarranted estimated bills.\u201d<\/p>\n<p>\u201cIt\u2019s unlawful for DISCOs to disconnect electricity supplies on the basis<br \/>\nof unpaid estimated bills. This government and your ministry bear<br \/>\nresponsibility for the failure and\/or refusal of DISCOs to provide free<br \/>\npre-paid meters to millions of Nigerians.<\/p>\n<p>\u201cSeveral years after the country\u2019s power sector was privatized, millions of<br \/>\nNigerian households particularly the socially and economically vulnerable<br \/>\nsectors of the population continue to complain about outrageous bills for<br \/>\nelectricity not consumed, and poor power supply from distribution firms.<br \/>\nDespite several directives and deadlines by both your office and the<br \/>\nNigerian Electricity Regulatory Commission for DISCOs to provide free<br \/>\npre-paid meters to customers, our information reveals that millions of<br \/>\nelectricity users across the country remain unmetered.\u201d<\/p>\n<p>\u201cSERAP is concerned that diminished power infrastructure and your<br \/>\nministry\u2019s inability to enforce your directives and regulations on<br \/>\nprovision of pre-paid meters to Nigerians means that millions of customers<br \/>\ncontinue to be exploited through the use of patently illegal estimated<br \/>\nbilling by DISCOs.\u201d<\/p>\n<p>\u201cSERAP continues to receive complaints through our helpline against<br \/>\ncorruption in the electricity sector that majority of consumers still get<br \/>\nestimated bills.\u00a0 While electricity supply is for the most part declining,<br \/>\nestimated bills continue to go up. In several parts of the country,<br \/>\nconsumers pay more for electricity than they pay for house rent. The<br \/>\nfeedbacks we have regularly received suggest that unreliable, inefficient<br \/>\nand poor quality of electricity in several parts of the country is majorly<br \/>\nresponsible for the deplorable living conditions of millions of Nigerians.\u201d<\/p>\n<p>\u201cSERAP argues that access to regular electricity supply is a prerequisite<br \/>\nfor satisfying basic human needs, improving living standards, maintaining<br \/>\ngood human health, alleviating poverty and facilitating sustainable<br \/>\ndevelopment. SERAP notes that Article 14(2)(h) of the Convention on the<br \/>\nElimination of All Forms of Discrimination Against Women (CEDAW) to which<br \/>\nNigeria is a state party explicitly recognises electricity as a human<br \/>\nright.\u201d<\/p>\n<p>\u201cSimilarly, the UN Commission on Sustainable Development has argued that<br \/>\nsustainable development is attainable through universal access to<br \/>\ncost-effective energy sources. Moreover, the African Commission on Human<br \/>\nand Peoples\u2019 Rights has adjudged the failure of States to provide basic<br \/>\nservices such as electricity as violating the right to health.\u201d<\/p>\n<p>\u201cSERAP believes that electricity provides a safe means of cooking (through<br \/>\nelectric stoves) and food preservation (refrigeration). Electricity is<br \/>\ntherefore essential to agriculture and a prerequisite for food security.<br \/>\nElectricity can also be employed to realise the human right to access clean<br \/>\nwater. Electric power operates pumps and sanitation systems so that<br \/>\ndrinking water is within the safe physical reach of all individuals and<br \/>\naccessible by households, educational institutions and workplaces.\u201d<\/p>\n<p>\u201cSERAP therefore urges you to act diligently and swiftly to enforce your<br \/>\ndirectives, deadlines and regulations on the provision of free pre-paid<br \/>\nmeters to Nigerians and end the use of patently illegal estimated billing<br \/>\nacross the country.
