{"id":58193,"date":"2017-06-21T21:08:45","date_gmt":"2017-06-21T20:08:45","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=58193"},"modified":"2017-06-21T21:08:45","modified_gmt":"2017-06-21T20:08:45","slug":"abia-gov-poll-ikpeazu-presented-false-information-inec-nwosus-lawyer-tells-court","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/abia-gov-poll-ikpeazu-presented-false-information-inec-nwosus-lawyer-tells-court\/","title":{"rendered":"ABIA GOV POLL: IKPEAZU PRESENTED FALSE INFORMATION TO INEC &#8212; NWOSU\u2019S LAWYER TELLS COURT"},"content":{"rendered":"<p>Counsel to Sir <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_697532168\"><span class=\"aQJ\">Friday<\/span><\/span> Nwosu, Chief Solomon Umoh(SAN),\u00a0 has told a\u00a0 five<br \/>\nman panel of the Court of Appeal sitting at Owerri Division , Imo State,<br \/>\nthat Governor Okezie Ikpeazu, presented false tax information to the<br \/>\nIndependent National Electoral Commission(INEC) for the 2015 governorship<br \/>\nelection.<\/p>\n<p>He prayed the Court to disqualify Ikpeazu and declare Nwosu the lawful<br \/>\ncandidate of the PDP in the 2015 governorship election in Abia State, and<br \/>\norder his swearing- in as Governor.<\/p>\n<p>The Senior Advocate who was represented by Abel Ozioko argued that Ikpeazu<br \/>\npresented false information to INEC on his affidavit in support of his<br \/>\nnomination in Form CF001 as well as his PAYE tax clearance certificate and<br \/>\nreceipts for 2011, 2012 and 2013, stressing that the offence is punishable<br \/>\nunder Section 31(6) of the Electoral Act 2010, as amended.<\/p>\n<p>Counsel to Governor Ikpeazu, Chief Theo Nkire had filed a motion seeking<br \/>\nthe\u00a0 dismissal of Nwosu\u2019s appeal based on the decision of the Supreme<br \/>\nCourt in the Uche Ogah vs Ikpeazu case, SC\/ 717\/2016, SC\/719\/2016 and<br \/>\nSC\/739\/ 2016, delivered on May 12, 2017. The motion was supported by<br \/>\nCounsel for INEC, Jude Nnodum , SAN and Uche Ogah, O.J. Nnadi, who were<br \/>\nrepresented, as well as Dr. Livy Uzoukwu representing the PDP. They agreed<br \/>\nwith Nkire that the Court lacked jurisdiction to hear Nwosu\u2019s appeal<br \/>\nclaiming that it had become academic and urged the Court to dismiss it.<\/p>\n<p>During the announcement of appearances for parties, Dr. Livy Uzoukwu, SAN<br \/>\nand B.O. Nafagha, were at each other throat over who should represent the<br \/>\nPDP.
