{"id":58432,"date":"2017-07-06T16:24:40","date_gmt":"2017-07-06T15:24:40","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=58432"},"modified":"2017-07-06T16:24:40","modified_gmt":"2017-07-06T15:24:40","slug":"osinbajo-senate-cant-remove-magu-nightmare","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/osinbajo-senate-cant-remove-magu-nightmare\/","title":{"rendered":"OSINBAJO TO SENATE: You Can&#8217;t Remove Magu, He is Your Nightmare"},"content":{"rendered":"<p>Acting President Yemi Osinbajo says nobody can remove Ibrahim Magu, acting<br \/>\nchairman of the Economic and Financial Crime Commission (EFCC).<\/p>\n<p>He said this in Kaduna\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1394582543\"><span class=\"aQJ\">on Thursday<\/span><\/span>\u00a0while commissioning a zonal office of<br \/>\nthe EFCC.<\/p>\n<p>Represented by Nasir el-Rufai, governor of Kaduna, \u00a0the acting president<br \/>\ndescribed Magu as a \u201cnightmare for corrupt people\u201d.<\/p>\n<p>\u201cWe have confidence in Magu to fight corruption to a standstill. He will<br \/>\nremain the EFCC chairman as long as I remain the acting president and as<br \/>\nlong as Muhammadu Buhari remains the president,\u201d he said.<\/p>\n<p>\u201cFor those thinking that corruption is beginning to win this war, Magu<br \/>\nwill remain their nightmare for the next two years or six years as the<br \/>\ncase may be.\u201d<\/p>\n<p>Making personal remarks, el-Rufai said over N500 million had been<br \/>\nrecovered from corrupt officials of the past government and some<br \/>\ncontractors in Kaduna.<\/p>\n<p>He added that those officials would be handed over to the EFCC for<br \/>\nprosecution.<\/p>\n<p>El-Rufai said because of the zero tolerance his administration has for<br \/>\ncorruption, the anti-graft agency EFCC encouraged him to establish a zonal<br \/>\noffice in Kaduna.<\/p>\n<p>The governor promised to allocate a piece of land to the commission for<br \/>\nconstruction of its training school and staff quarters.<\/p>\n<p>There is a brewing crisis between the legislature and executive over<br \/>\nMagu\u2019s position.<\/p>\n<p><span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1394582544\"><span class=\"aQJ\">On Tuesday<\/span><\/span>, the upper legislative chamber resolved to suspend the<br \/>\nconfirmation of nominees sent by the executive over Osinbajo\u2019s support for<br \/>\nMagu.<\/p>\n<p>Ahmad Yerima, senator representing Zamfara west, had moved a motion to<br \/>\nstop the confirmation of Lanre Gbajabiamila as the director-general of<br \/>\nNigeria Lottery Commission.<\/p>\n<p>He wondered why Osinbajo would send a nominee to the senate after he said<br \/>\nthe upper legislative chamber did not have the power of confirmation.<\/p>\n<p>Yerima was making reference to a statement made by Osinbajo when he spoke<br \/>\nwith select media organisations, including TheCable, in April.<\/p>\n<p>Osinbajo had expressed support for the view of Femi Falana, human rights<br \/>\nlawyer, that the executive did not need to send the name of Magu to the<br \/>\nsenate for confirmation.<\/p>\n<p>\u201cThere is an argument, whether or not we need to present him (Magu) for<br \/>\nconfirmation and that\u2019s a compelling argument from Femi Falana,\u201d Osinbajo<br \/>\nhad said.<\/p>\n<p>\u201cHis (Falana) argument is that under the constitution, section 171, and if<br \/>\nyou look at that section, it talks about the appointments that the<br \/>\npresident can make. They include appointments of ministers, ambassadors<br \/>\nand heads of agencies such as the EFCC. In that same section 171, the<br \/>\nconstitution rightly said that certain appointments must go to the senate<br \/>\nsuch as ministerial and ambassadorial appointments. Those of heads of<br \/>\nagencies like the EFCC do not have to go to the senate. That\u2019s what the<br \/>\nconstitution says. But the EFCC act, which of course as you know is<br \/>\ninferior, says that EFCC chairman should go to the senate for<br \/>\nconfirmation.<\/p>\n<p>\u201cI am sure that even a pocket book lawyer knows that when a legislation<br \/>\nconflicts with constitution, it\u2019s the constitution that prevails.
