The Independent National Electoral Commission (INEC) says it will comply
\nwith the order of the Federal High Court, Abuja, and temporarily suspend
\nthe recall process of Dino Melaye from the Senate.<\/p>\n
Mr. Melaye represents the Kogi West Senatorial District at the Upper Chamber.<\/p>\n
The Commission disclosed this in a statement issued by Adedeji Soyebi,
\nINEC National Commissioner and Chairman, Information and Voter Education
\nCommittee on Thursday.<\/p>\n
Mr. Soyebi said the commission reached the decision after considering the
\ncourt order dated July 6, at its regular weekly meeting held on Thursday.<\/p>\n
The court order had directed all parties listed in the suit filed by Mr.
\nMelaye to maintain the status quo till the determination of the motion on
\nnotice.<\/p>\n
Mr. Melaye was seeking an injunction against the commission to stop it
\nfrom acting on the petition by registered voters of Kogi west senatorial
\ndistrict.<\/p>\n
\u201cAs a responsible, law-abiding institution, INEC will comply with the order.<\/p>\n
\u201cHowever, the commission has also decided to take immediate steps to
\nvacate the court order for the matter to be heard and determined
\nexpeditiously.<\/p>\n
\u201cWhereas the court had adjourned hearing of the Motion on Notice till
\nSept. 29, the commission by law has 90 days to complete the process,\u2019\u2019 he
\nsaid.<\/p>\n
Mr. Soyebi further said: \u201csection 69 of the 1999 Constitution (as amended)
\nsets a limit of 90 days from the date of the presentation of the petition
\n(21st June, 2017) for the exercise to be completed.\u2019\u2019<\/p>\n
The national commissioner however, said the commission did draw the
\nattention of the Chief Justice of Nigeria to the order.<\/p>\n
Mr. Soyebi said this was in view of the negative effect the order had on
\nthe performance of the commission\u2019s constitutional duty.<\/p>\n
In another development, Mr. Soyebi said the commission had approved a
\npolicy of comprehensive audit after all elections.<\/p>\n
\u201cThis is in line with its commitment of ensuring transparency and overall
