OF KANU: Don&#8217;t Escalate Tension In Nigeria, Ohaneze Warns FG"},"content":{"rendered":"<p>The President of the Igbo apex socio-political organisation, Ohanaeze,<br \/>\nChief John Nwodo, yesterday rejected the planned re-arrest of the leader<br \/>\nof the Indigenous Peoples of Biafra (IPOB), Nnamdi Kanu, by the federal<br \/>\ngovernment.<\/p>\n<p>Federal Attorney-General, Justice Minister\u00a0 \u00a0Abubakar Malami (SAN),<br \/>\nannounced\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1239406570\"><span class=\"aQJ\">on Friday<\/span><\/span>\u00a0that government had approached a high court to revoke<br \/>\nKanu\u2019s bail for allegedly violating the conditions attached to the bail.<\/p>\n<p>But Nwodo, reacting to the AGF\u2019s statement, accused him of bias.<\/p>\n<p>He wondered why Malami failed to move against the Arewa youths who gave<br \/>\nIgbo residing in the north an\u00a0<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1239406571\"><span class=\"aQJ\">October 1<\/span><\/span>\u00a0ultimatum to leave.<\/p>\n<p>He said Kanu is free as a citizen to hold any point of view no matter how<br \/>\ndispleasing to anyone, as long as such a view is not inciting or provoking<br \/>\nany criminal activities.<\/p>\n<p>Nwodo, who made the association\u2019s stance known in a statement in Abuja,<br \/>\nwarned the AGF against exacerbating the tension in the country.<\/p>\n<p>He said: \u201cIt has just been brought to my notice that the Attorney-General<br \/>\nof the Federation has approached the courts to incarcerate Nnamdi Kanu for<br \/>\nflouting his bail conditions.<\/p>\n<p>\u201cI am amazed that the distinguished attorney is prepared to contest the<br \/>\nsuperiority of the provisions of the constitution on fundamental human<br \/>\nrights of freedom of movement and freedom of association over an erroneous<br \/>\njudicial proclamation violating those rights.<\/p>\n<p>\u201cI am equally miffed by the audacity with which the Attorney-General<br \/>\ndisplays his bias without regard to his oath of office.<\/p>\n<p>\u201cA few hours ago under the watchful eyes of the Chairman of the Northern<br \/>\nGovernors Forum and in total defiance of the Head of State\u2019s proclamation<br \/>\nof the rights of a citizen of Nigeria to live anywhere in Nigeria and to<br \/>\ndo business anywhere in Nigeria, the Arewa youths, pretending to withdraw<br \/>\ntheir quit notice gave qualifications to the president\u2019s proclamation,<br \/>\nissuing conditions for enjoyment of citizenship status.\u201d<\/p>\n<p>He added: \u201cThese same Arewa Youths are supposed to have been arrested on<br \/>\nthe orders of the Governor of Kaduna State and the Inspector General of<br \/>\nPolice for acts of treason, conversion and sedition.<\/p>\n<p>\u201cAs the Chief Law officer of the Federation the Attorney-General looks the<br \/>\nother way.\u00a0 He does not go to court to seek an order of arrest or<br \/>\nprosecution.<\/p>\n<p>\u201cNnamdi, as a citizen of Nigeria, is free to hold any point of view no<br \/>\nmatter how displeasing to anyone so long as it is not inciting or<br \/>\nprovoking any criminal activities.\u201d<\/p>\n<p>Nwodo said although he and some Igbo leaders had disagreed with Kanu and<br \/>\nRadio Biafra on a number of issues, they have upheld his right to differ<br \/>\nin the spirit of democracy.<\/p>\n<p>He warned the AGF against aggravating the tension in the country by<br \/>\nre-arresting the IPOB leader.<\/p>\n<p>He said:\u00a0 \u201cI and some Igbo leaders have differences of opinion with Nnamdi<br \/>\non a number of issues.\u00a0 We have been insulted and abused by Radio Biafra<br \/>\nbut we concede them their right to differ from us.\u00a0 We concede them their<br \/>\nnature to be exuberant as youths but we cannot be judgmental about their<br \/>\nrights.<\/p>\n<p>\u201cThis is a democracy.\u00a0 In democracies leaders are abused, pelted with<br \/>\nrotten eggs and booed at, as the former Edo State Governor was booed in<br \/>\nAbuja a few days ago.\u00a0 These acts are not necessarily criminal.<\/p>\n<p>\u201cI urge the Attorney-General not to exacerbate our already tense nation by<br \/>\ncommencing a legal action which portrays him as biased, insensitive and<br \/>\nmisdirected.\u201d<\/p>\n<p>The federal government wants the Federal High Court, Abuja, to revoke the<br \/>\n<span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1239406572\"><span class=\"aQJ\">April 25<\/span><\/span>\u00a0bail granted Kanu for allegedly breaching the conditions attached<br \/>\nto the bail.<\/p>\n<p>Besides, government also requests an order directing Kanu\u2019s arrest and<br \/>\ncommitting him to custody pending trial as well as any such order the<br \/>\ncourt may deem fit in the circumstance.<\/p>\n<p>Kanu is facing trial for alleged offences of conspiracy to commit acts of<br \/>\ntreasonable felony and other related offences.<\/p>\n<p>\u201cThe offence for which he is standing trial is not ordinarily bailable but<br \/>\ndue to the magnanimity of the court and its quest for justice and<br \/>\nfairness, he was granted bail on health grounds,\u201d Malami said through his<br \/>\nspokesman, Salihu Isah.<\/p>\n<p>\u201cAmong the other conditions for his bail is that he should not be seen in<br \/>\na crowd exceeding 10 people and he should not grant any interviews, hold<br \/>\nor attend any rallies.<\/p>\n<p>\u201cAnd that he should file in court, medical updates of his health status<br \/>\nevery month. But rather than observing all of the conditions listed above,<br \/>\nKanu, in flagrant disobedience to the court order, flouted all conditions<br \/>\nof the bail.\u201d<\/p>\n<p>According to the government, Kanu has in furtherance to the offence he was<br \/>\ncharged, inaugurated a so called Biafra Security Service, an act it<br \/>\ndescribes as grave threat to national security and unity of the country.<\/p>\n<p>In a separate statement, the Kanu led IPOB said the federal government was<br \/>\nout of order by moving for Kanu\u2019s re-arrest.<\/p>\n<p>Spokesman for the group, Emma Powerful said in a statement in Owerri that<br \/>\n\u201cthreats and more threats heaped upon intimidation after intimidation do<br \/>\nnot wash with IPOB.\u201d<\/p>\n<p>\u201cMerely asserting that Mazi Nnamdi Kanu is a threat to the Nigerian<br \/>\ngovernment,\u201d according to Powerful, \u201cis not a crime unless accompanied by<br \/>\nlegally definable crime or offence.<\/p>\n<p>\u201cBefore Buhari decides to make a move to arrest our leader, he must first<br \/>\ngo to court to obtain a court order or else it will be resisted by<br \/>\nmillions of IPOB members.<\/p>\n<p>\u201cFederal government must do exactly what IPOB did, after all the matter is<br \/>\nbefore a court of competent jurisdiction. When IPOB complained about the<br \/>\ninhumane bail conditions, we were advised to approach the court for<br \/>\nvariation.<\/p>\n<p>\u201cWhatever issue government of Buhari has with our leader Kanu must first<br \/>\nbe presented before Justice Binta Nyako\u2019s court for determination.<\/p>\n<p>\u201cNnamdi Kanu is spiritually and mentally prepared for this epic battle. He<br \/>\nis not afraid of being locked up without trial as long as his personal<br \/>\nphysician will be allowed to visit and attend to his medical needs.<\/p>\n<p>\u201cThe Federal Government must also state where it is written in the 1999<br \/>\nConstitution that being in a crowd of more than 10 people, calling for<br \/>\nelection and attending rallies is a crime. Our teams of local and<br \/>\ninternational lawyers are following the developments closely. That Nigeria<br \/>\nis dangerously close to the brink of collapse today is a direct result of<br \/>\nthe first illegal arrest and detention of Kanu, arresting him again will<br \/>\nplunge Nigeria into an unimaginable crisis.\u201d<\/p>\n<p>\u201cWe are peacefully agitating for our independent homeland for the people<br \/>\nof Biafra. We have engaged in any armed conflict of any sort, we have not<br \/>\ncalled for the expulsion of any ethnic group, neither have we declared any<br \/>\nstate within a state. Nigerian government must explain which law of the<br \/>\nland has been violated to justify their move to re-arrest our leader.\u201d<\/p>\n<p>Kanu\u2019s lawyer Ifeanyi Ejiofor, had told PREMIUM TIMES, an online newspaper<br \/>\nat the weekend that his client had \u201csuccessfully challenged the bail<br \/>\nconditions referred to by the government.\u201d<\/p>\n<p>He was quoted as saying: \u201cThough we intend to file a formal response to<br \/>\ntheir most misconceived motion, it is my position that it does not lie in<br \/>\nthe power of the AG to ask for the revocation of the bail granted to my<br \/>\nclient. The prosecution can\u2019t be seen at the same time as the persecutors.<\/p>\n<p>\u201cWe have successfully challenged the bail terms we considered offensive to<br \/>\nour clients constitutionally guaranteed rights. So their recent<br \/>\napplication is belated.<\/p>\n<p>\u201cSection 169 of the ACJA being relied upon by the AG can\u2019t avail the<br \/>\nAttorney General absolute power to ask for the revocation of bail.
