Ahead of the 2019 General elections, the Attorney General of the
\nFederation and Minister of Justice Abukabar Malami SAN has disclosed that
\nPresident Muhammadu Buhari has directed all relevant agencies to compile
\ndocuments on names of all looters with a view to promptly enforcing the
\njudgment of a Federal High Court in Lagos ordering the government to
\nrelease to Nigerians information about the names of high ranking public
\nofficials from whom public funds were recovered.<\/p>\n

The court also ordered the government to tell Nigerians the circumstances
\nunder which funds were recovered, as well as the exact amount of funds
\nrecovered from each public official.<\/p>\n

Mr Malami made the disclosure yesterday during a meeting at his office in
\nAbuja with a delegation from Socio-Economic Rights and Accountability
\nProject (SERAP). This development was disclosed today in a statement by
\nSERAP executive director Adetokunbo Mumuni.<\/p>\n

Mumuni said, \u201cWe had a very productive meeting with Mr Malami, discussing
\namong other critical issues the need for the government to obey the
\njudgment delivered in July by Hon Justice Hadiza\u00a0Rabiu Shagari following a
\nFreedom of Information suit number:\u00a0\u00a0FHC\/CS\/964\/2016 brought by SERAP.\u201d<\/p>\n

According to Mumuni, \u201cMr Malami informed us that President Buhari has
\ndirected the Ministry of Justice, Ministry of Finance, Economic and
\nFinancial Crimes Commission (EFCC), Independent Corrupt Practices and
\nOther Related Offences Commission (ICPC) and other relevant agencies
\ninvolved in the recovery of looted funds to promptly put the documents
\ntogether with a view to fully and promptly enforcing the judgment by
\nJustice Shagari.\u201d<\/p>\n

\u201cWe appreciate the opportunity to meet with the Attorney General of the
\nFederation and look forward to working with him as the government strives
\nto enforce this very important judgment. We hope that the implementation
\nof the judgment will now happen sooner rather than later. We believe that
\neffectively implementing the judgment will be a victory for the rule of
\nlaw, show the way forward in the fight against corruption and impunity of
\nperpetrators in the country, as well as demonstrate Buhari\u2019s oft-repeated
\ncommitment to tackling the problem of grand corruption,\u201d Mumuni added.
\nIt would be recalled that the SERAP suit followed disclosure last year by
\nthe Federal Government of funds recovered from some high-ranking public
\nofficials and private individuals.<\/p>\n

In her judgment delivered on 5th July 2017 Justice Shagari agreed with
\nSERAP that \u201cthe Federal Government has legally binding obligations to tell
\nNigerians the names of all suspected looters of the public treasury past
\nand present.\u201d Joined as Defendants in the suit are the Minister of
\nInformation Alhaji Lai\u00a0Muhammed\u00a0and the Federal Ministry of Information
\nand Culture.<\/p>\n

The same day that the judgment was delivered Mr Malami told reporters in
\nAbuja that government was in agreement with the ruling and would carry out
\nthe order as long as it does not amount to sub judice.<\/p>\n

Justice Shagari also granted the following reliefs:<\/p>\n

A DECLARATION\u00a0that by virtue of the provisions of Section 4 (a) of the
\nFreedom of Information Act 2011, the Defendants are under a binding legal
\nobligation to provide the Plaintiff with up to date information relating
\nto the following:<\/p>\n

To widely disseminate including on a dedicated website information
\nabout\u00a0the names of high ranking public officials from whom public funds
\nwere recovered since May 2015
\nThe circumstances under which stolen public funds were returned<\/p>\n

It would be recalled that the Ministry of Information last year published
\ndetails of the\u00a0recoveries, which showed that the Nigerian government
\nsuccessfully retrieved\u00a0total cash amount\u00a0N78,325,354,631.82,
\n$185,119,584.61, \u00a33,508,355.46 and \u20ac11, 250 between May 29, 2015 and May
\n25, 2016. Also released were recoveries under interim forfeiture, which
\nwere a combination of cash and assets, during the same period:
\nN126,563,481,095.43, $9,090,243,920.15, \u00a32,484,447.55 and \u20ac303,399.17.
\nAnticipated repatriation from foreign countries totalled: $321,316,726.1,
\n\u00a36,900,000 and \u20ac11,826.11. The ministry also announced that 239 non-cash
\nrecoveries were made during the one-year period. The non-cash recoveries
\nare \u2013 farmlands, plots of land, uncompleted buildings, completed
\nbuildings, vehicles and maritime vessels.<\/p>\n

Subsequently, SERAP issued an FOI request and gave the Minister of
\nInformation, Alhaji Lai Muhammed 14 days to disclose the names of all
\nsuspected looters.<\/p>\n

The request reads in part: \u201cWhile we believe that suspects generally are
\nentitled to be presumed innocent until proven guilty by a court of
\ncompetent jurisdiction, SERAP opposes blanket non-disclosure of names of
\nhigh-ranking public officials from whom some of the funds were recovered.\u201d<\/p>\n

\u201cSERAP insists that the public interest to know is greater than any other
\nlegitimate interest that the government might wish to protect. The
\nNigerian government has an obligation to balance whether the risk of harm
\nto the legitimate aim (that is secrecy of ongoing corruption investigation
\nand presumption of innocence) from disclosure of the names of public
\nofficials is greater than the public interest in accessing the
\ninformation.\u201d<\/p>\n

\u201cSERAP believes that the recoveries, specifically from high-ranking public
\nofficials (and not private individuals), are matters of public interest.
\nPublishing the names of those public officials will provide insights
\nrelevant to the public debate on the ongoing efforts to prevent and combat
\na culture of grand corruption in the country.\u201d<\/p>\n

\u201cThe gravity of the crime of grand corruption, the devastating effects on
\nthe socially and economically vulnerable sectors of the population, and
\nthe fact that recovery of huge funds from high-ranking public officials
\nentrusted with the public treasury raise a\u00a0prima-facie\u00a0case and therefore
\namount to exceptional circumstances that justify naming those high-ranking
\nofficials in the public interest.\u201d<\/p>\n

\u201cPublishing the names of public officials involved could go a long way in
\npreventing senior public officials from turning the public treasury into a
\nprivate cashbox. The public interest in publishing the names of the
\nhigh-ranking government officials from whom funds were received outweighs
\nany considerations to withhold the information, as there would be no
\nprejudice against those whose names are published as long as the
\ninformation is appropriately framed and truthful.\u201d<\/p>\n

\u201cWhile the government in some limited cases can legitimately place
\nrestrictions on the public\u2019s right to access certain information, attempts
\nof the Nigerian authorities to justify the total closure of information
\nrelated to the names of public officials from whom funds were recovered on
\nthe basis of \u201congoing criminal investigation\u201d and \u201cpresumption of
\ninnocence goes far beyond the limitations allowed under international law,
\nand would promote secret recoveries.\u201d<\/p>\n

\u201cThe information being requested is not related to detailed investigatory
\nactivities of anticorruption agencies regarding the recoveries so far
\nmade. Similarly, the mere fact that the information being requested is
\nrelated to ongoing investigation does not necessarily mean that the
\ninformation could not be disclosed. In addition, governmental agency has
\nthe obligation to prove that the disclosure of the names of public
\nofficials would disrupt, impede, or otherwise harm the ongoing or pending
\ninvestigations or presumption of innocence.\u201d<\/p>\n
