Embattled former Secretary to the Government of the Federation (SGF)
\nBabachir David Lawal and National Intelligence Agency (NIA)
\nDirector-General Ayo Oke are to be prosecuted by the Economic and
\nFinancial Crimes Commission, EFCC.<\/p>\n
After the Presidency announced the officers\u2019 sack yesterday, there were
\ncalls that they be handed over to the anti-graft agencies.<\/p>\n
A statement issued by the Senior Special Assistant on Media and Publicity,
\nGarba Shehu, said President Muhammadu Buhari\u2019s position \u201cis that
\ninvestigation agencies which have already commenced the investigation of
\nthe two officers removed from office will go on with their work of
\ninvestigation without any interference or hindrance\u201d.<\/p>\n
\u201cThe President, who is fully conversant with the provisions of the
\nconstitution will not stop the investigation of anyone because he has no
\nsuch power under our laws. This is a decision of the Supreme Court,\u201d Shehu
\nsaid, adding: \u201cThe President under our laws can, through the Attorney
\nGeneral, enter a nolle prosequi to stop an ongoing trial. He may, upon
\nconviction, order a pardon.<\/p>\n
\u201cBeyond these, the President cannot order investigation agencies to not
\ninvestigate anyone and does not intend to do in this, or any other
\ncircumstance.<\/p>\n
\u201cBased on his wish and desire for a strict observance of the law, the
\nPresident expects the EFCC, ICPC and such agencies to proceed with ongoing
\ninvestigations..<\/p>\n
\u201cWhen and where they have reasonable grounds to charge former or serving
\nofficers to court.<\/p>\n
