Socio-Economic Rights and Accountability Project (SERAP) has urged Governor<\/div>\n
Okezie Ikpeazu of Abia State to \u201cimmediately withdraw his illegal<\/div>\n
appointment of Justice Obisike Orji as the acting Chief Judge of the state<\/div>\n
and restore Justice Theresa Uzokwe, who was unlawfully removed by the State<\/div>\n
House of Assembly, back to her position as Chief Judge.\u201d<\/div>\n

The House of Assembly had on Friday passed a resolution suspending Justice<\/div>\n
Uzokwe as the state\u2019s chief judge. The speaker, Mr. Chikwendu Kalu, while<\/div>\n
reading the resolution, set up 8-man ad-hoc committee to investigate<\/div>\n
allegations of misconduct against the judge, and mandated Governor Ikpeazu<\/div>\n
to appoint an acting chief judge pending the completion of the<\/div>\n
investigation by the committee.<\/div>\n

<\/div>\n
But SERAP in a statement today by its deputy director Timothy Adewale said,<\/div>\n
\u201cRather than using their executive and legislative powers to promote good<\/div>\n
governance and abolish laws granting double emoluments and large severance<\/div>\n
benefits to former governors, the Abia State government is denigrating the<\/div>\n
judiciary and displaying contempt for the rule of law.\u201d<\/div>\n
<\/div>\n
<\/div>\n
<\/div>\n
According to SERAP, \u201cThe purported suspension of Justice Uzokwe violates<\/div>\n
sections 292(1)(a)(ii) and 21(d) Part 11 of the Third Schedule to the 1999<\/div>\n
Constitution of Nigeria (as amended), and amounts to a blatant attack on<\/div>\n
the integrity and independence of the judiciary. No judge anywhere in<\/div>\n
Nigeria can be removed without the involvement of the National Judicial<\/div>\n
Council (NJC), no matter the level of allegations of misconduct against<\/div>\n
that judge.\u201d<\/div>\n

<\/div>\n
<\/div>\n
The organization said, \u201cGovernor Ikpeazu must rescind his illegal<\/div>\n
appointment of a new chief judge, and the Abia State House of Assembly must<\/div>\n
withdraw the apparently politically motivated suspension of Justice Uzokwe<\/div>\n
without further delay. Doing so will be entirely consistent with the<\/div>\n
decision of the Supreme Court of Nigeria in the case of *Raliat<\/div>\n
Elelu-Habeed & anor v Attorney General of the Federation and Attorney<\/div>\n
General of Kwara State* (2012).\u201d<\/div>\n

<\/div>\n
<\/div>\n
The organization said, \u201cIf allowed to stand, the suspension of Justice<\/div>\n
Uzokwe would set a bad example to other state governments, and dangerously<\/div>\n
move them toward executive and legislative dominance and control over the<\/div>\n
judiciary. Should Ikpeazu and the House fail to restore Justice Uzokwe back<\/div>\n
to her position, SERAP will undertake appropriate legal action including<\/div>\n
before the NJC and the UN special procedure mechanisms, to seek justice and<\/div>\n
effective remedies in this matter.\u201d<\/div>\n

The statement read in part: \u201cThe suspension also infringes the<\/div>\n
constitutional principle of the separation of governmental powers.<\/div>\n
Constitutional guarantees are meant to protect the judiciary from the<\/div>\n
political caviling that removal power often engenders. The benefits of the<\/div>\n
integrity of the judiciary should never be supplanted by the temerity and<\/div>\n
excessiveness which political powers often breed.\u201d<\/div>\n

<\/div>\n
\u201cAn independent judiciary is the foundation upon which the entire structure<\/div>\n
of our constitution rests. The suspension of Justice Uzokwe is a serious<\/div>\n
threat to this independence, and any impression that this principle is<\/div>\n
being improperly eroded should be directly and speedily addressed.\u201d<\/div>\n

<\/div>\n
\u201cJustice Uzokwe would seem to be a victim of the government\u2019s plan to<\/div>\n
harass judicial officials in Abia State. Neither the House of Assembly nor<\/div>\n
Ikpeazu is constitutionally authorized to suspend Justice Uzokwe without<\/div>\n
the participation of the NJC.\u201d<\/div>\n

<\/div>\n
<\/div>\n
\u201cThe independence of the judiciary is a barrier to despotism and necessary<\/div>\n
to secure a steady, upright, and impartial administration of the laws. This<\/div>\n
independence ought to be promoted and protected by the Abia State<\/div>\n
government. Executive and legislative invasions of it should never be<\/div>\n
allowed to stand.\u201d<\/div>\n

<\/div>\n
<\/div>\n
\u201cA judge is in no sense under the direction of the government. The<\/div>\n
judiciary is in a place apart, and constitutionally independent. It is of<\/div>\n
supreme importance, not only that justice be done, but that litigants<\/div>\n
before the court and the public generally understand that it is being done<\/div>\n
and that the judge is beholden to no one but God, his\/her conscience, and<\/div>\n
the judicial oath.\u201d<\/div>\n

<\/div>\n
\u201cThe framers of our constitution sought to establish the judiciary’s<\/div>\n
independence and remove undue influence by both the executive and<\/div>\n
legislative branches by prescribing due process of law for removal of<\/div>\n
judges.\u201d<\/div>\n
