Socio-Economic Rights and Accountability Project (SERAP) has urged the<\/div>\n
authorities of the University of Ibadan and Adekunle Ajasin University to<\/div>\n
\u201cimmediately reverse the patently illegal increases in fees, as the fees<\/div>\n
would stigmatize students that may be unable to pay, lead to a filtering<\/div>\n
out of such students and foreclose any realistic possibility that they<\/div>\n
will contribute in even the smallest way to the progress of our country.\u201d<\/div>\n
<\/div>\n
The organization said: \u201cThe universities ought to have carefully<\/div>\n
considered the effects of high fees on accessibility and the vision of<\/div>\n
education that they seek to achieve. The universities are advised to find<\/div>\n
solutions to their funding difficulties elsewhere. But if they fail to<\/div>\n
reverse these fees within 7 days of the publication of this statement,<\/div>\n
SERAP would take appropriate legal action to compel them to do so.\u201d<\/div>\n
<\/div>\n
While the University of Ibadan increased fees for students\u2019 professional<\/div>\n
training and accommodation, Adekunle Ajasin University increased school<\/div>\n
fees. The professional fees range from N75,000 to N100,000 per student,<\/div>\n
while accommodation fee in the hostel was raised from around N14,000 to<\/div>\n
N40,000 per student. AAUA increased school fees from about N35,000 to as<\/div>\n
high as between N120,000 and N200,000 per session.<\/div>\n
<\/div>\n
Reacting, SERAP in a statement today by its deputy director Timothy<\/div>\n
Adewale said: \u201cThe dramatic increases would have the effect of<\/div>\n
discriminating against disadvantaged students who may be unable to pay the<\/div>\n
new fees, and who are not granted any exemption, thereby creating a<\/div>\n
classification based on the economic and social status of their parents.<\/div>\n
The increases would also undermine the students\u2019 rights to education and<\/div>\n
equal protection guarantees.\u201d<\/div>\n
<\/div>\n
According to the organization: \u201cThe inability of the students or their<\/div>\n
parents to pay these fees would result in an absolute deprivation of a<\/div>\n
meaningful opportunity for the students to enjoy educational benefit.<\/div>\n
Increasing fees because the authorities are not adequately funding the two<\/div>\n
institutions is victimising the students over an issue they have neither<\/div>\n
control nor responsibility.\u201d<\/div>\n
<\/div>\n
The statement read in part: \u201cStudents that are unable to pay these fees<\/div>\n
may become disillusioned, gradually disassociate from the universities,<\/div>\n
and eventually drop out entirely. When a student is excluded from gaining<\/div>\n
the full benefits available in public school because of inability to pay<\/div>\n
fees, the effect is exclusion which naturally imposes a lifetime hardship<\/div>\n
on a discrete class of students not accountable for their disabling<\/div>\n
status.\u201d<\/div>\n
<\/div>\n
\u201cSERAP also urges the leadership of the National Assembly to come up with<\/div>\n
legislation that would: end arbitrary imposition of fees in our public<\/div>\n
schools; grant exemptions to students from disadvantaged background;<\/div>\n
ensure that our universities are adequately funded on an equitable basis<\/div>\n
to ensure the proper exercise of the rights to equal protection of law and<\/div>\n
education and redress inequalities in education provision.\u201d<\/div>\n
<\/div>\n
\u201cThe right to education is too important to be left to the budgetary<\/div>\n
circumstances of individual university or socio-economic status of parents<\/div>\n
and families. Any perceived financial hardship faced by the UI and AAUA<\/div>\n
cannot justify the violations of the students\u2019 constitutional guarantees<\/div>\n
of equal protection and Nigeria\u2019s international obligations to ensure<\/div>\n
equal access to the right to education. The right to education is not a<\/div>\n
commodity for sale.\u201d<\/div>\n
<\/div>\n
\u201cNigeria cannot continue to compete and prosper in the global arena when<\/div>\n
university students are chased away because they cannot afford to pay<\/div>\n
fees. And if Nigeria cannot compete, it cannot lead. If our students<\/div>\n
continue to face victimisation, discrimination and exclusion on the<\/div>\n
grounds of their socio-economic status, Nigeria will become a nation of<\/div>\n
limited human potential. It would be tragic if the authorities at UI and<\/div>\n
AAUA and the government of President Muhammadu Buhari allow this to<\/div>\n
happen.\u201d<\/div>\n
<\/div>\n
\u201cWhile the increases in fees may be financially necessary, they are<\/div>\n
illegal, as they amount to victimisation and discrimination of students<\/div>\n
from disadvantaged sectors of the population, contrary to the provisions<\/div>\n
of the African Charter on Human and Peoples\u2019 Rights and the International<\/div>\n
Covenant on Economic, Social and Cultural Rights both of which Nigeria has<\/div>\n
ratified.\u201d<\/div>\n
<\/div>\n
\u201cSERAP notes that section 12 of the University of Ibadan Act prohibits<\/div>\n
discrimination on grounds such as social and economic status. It provides<\/div>\n
that \u2018no person shall be subjected to any disadvantage in relation to the<\/div>\n
University\u2019.\u201d<\/div>\n
<\/div>\n
\u201cThe increases also violate the right of the students to equal protection<\/div>\n
of the law, as guaranteed by sections 17, 18 and 42 of the Nigerian<\/div>\n
Constitution of 1999 (as amended). Equal access to education is a human<\/div>\n
right and necessary for the enjoyment of other human rights. It is the<\/div>\n
very foundation of good citizenship. The opportunity of an education,<\/div>\n
where the state has undertaken to provide it, is a right which must be<\/div>\n
made available to all on equal terms, regardless of ability of parents to<\/div>\n
pay.\u201d<\/div>\n
<\/div>\n
\u201cNo students from disadvantaged sectors of the country have the means to<\/div>\n
change or control the financial status of their parents. Therefore, any<\/div>\n
denial of an educational opportunity to such students based on their<\/div>\n
inability to pay a fee would be grossly unfair and unconstitutional.\u201d<\/div>\n
<\/div>\n
\u201cEducation provides the basic tools by which individuals might lead<\/div>\n
economically productive lives to the benefit of all. The UI and AAUA<\/div>\n
cannot ignore the significant social costs that would be borne by our<\/div>\n
country when disadvantaged students are denied the means to absorb the<\/div>\n
values and skills upon which Nigeria\u2019s social order rests.\u201d<\/div>\n
