{"id":62380,"date":"2018-05-29T19:08:20","date_gmt":"2018-05-29T18:08:20","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=62380"},"modified":"2018-05-29T19:08:20","modified_gmt":"2018-05-29T18:08:20","slug":"court-orders-buhari-to-prosecute-lawmakers-over-alleged-stealing-of-n481bn-from-2016-budget","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/court-orders-buhari-to-prosecute-lawmakers-over-alleged-stealing-of-n481bn-from-2016-budget\/","title":{"rendered":"Court orders Buhari to prosecute lawmakers over alleged stealing of N481bn from 2016 budget"},"content":{"rendered":"<div dir=\"ltr\">A Federal High Court sitting in Lagos in a landmark judgement has ordered<\/div>\n<div dir=\"ltr\">President Muhammadu Buhari to \u201curgently instruct security and<\/div>\n<div dir=\"ltr\">anti-corruption agencies to forward to him reports of their investigations<\/div>\n<div dir=\"ltr\">into allegations of padding and stealing of some N481 billion from the<\/div>\n<div dir=\"ltr\">2016 budget by some principal officers of the National Assembly.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The Court also ordered President Buhari to \u201cdirect the Attorney General of<\/div>\n<div dir=\"ltr\">the Federation and Minister of Justice Abubakar Malami, SAN, and\/or<\/div>\n<div dir=\"ltr\">appropriate anti-corruption agencies to without delay commence prosecution<\/div>\n<div dir=\"ltr\">of indicted lawmakers.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The judgment was delivered yesterday by Justice Mohammed Idris following a<\/div>\n<div dir=\"ltr\">mandamus suit no: FHC\/L\/CS\/1821\/2017 brought by Socio-Economic Rights and<\/div>\n<div dir=\"ltr\">Accountability Project (SERAP).<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The Court also ordered President Buhari to \u201cdirect the publication of the<\/div>\n<div dir=\"ltr\">report of investigations by security and anti-corruption bodies into the<\/div>\n<div dir=\"ltr\">alleged padding of the 2016 budget.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">In the suit brought against the President of Nigeria and the Attorney<\/div>\n<div dir=\"ltr\">General of the Federation and Minister of Justice, Justice Idris further<\/div>\n<div dir=\"ltr\">held that President Buhari in the exercise of his executive powers has a<\/div>\n<div dir=\"ltr\">duty to ensure compliance with the provisions of article 22 of the African<\/div>\n<div dir=\"ltr\">Charter on Human and Peoples\u2019 Rights, holding further that Buhari is<\/div>\n<div dir=\"ltr\">\u201cexpected to use his executive powers for the public good of Nigeria.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Article 22 of the African Charter provides that, \u201cAll peoples shall have<\/div>\n<div dir=\"ltr\">the right to their economic, social and cultural development with due<\/div>\n<div dir=\"ltr\">regard to their freedom,\u201d and that \u201cStates shall have the duty,<\/div>\n<div dir=\"ltr\">individually or collectively, to ensure the exercise of the right to<\/div>\n<div dir=\"ltr\">development.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The Court also granted an order directing Buhari to \u201cUrgently halt alleged<\/div>\n<div dir=\"ltr\">attempt by some principal officers of the National Assembly to steal N40<\/div>\n<div dir=\"ltr\">billion of the N100 billion allocated by his government as \u2018zonal<\/div>\n<div dir=\"ltr\">intervention\u2019 in the 2017 budget.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">Buhari is also ordered \u201cto closely monitor and scrutinize the spending of<\/div>\n<div dir=\"ltr\">N131 billion (accrued from increased oil bench mark) allocated for<\/div>\n<div dir=\"ltr\">additional non-constituency projects expenditure, to remove the<\/div>\n<div dir=\"ltr\">possibility of corruption.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The Court held that \u201cSERAP, being a human rights non-governmental<\/div>\n<div dir=\"ltr\">organization has sufficient interest in the way and manner public funds<\/div>\n<div dir=\"ltr\">are being utilized in this country.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">SERAP deputy director Timothy Adewale said: \u201cThis judgment confirms the<\/div>\n<div dir=\"ltr\">pervasive corruption in the budget process and the prevailing culture of<\/div>\n<div dir=\"ltr\">impunity of our lawmakers as well as the failure of the authorities to<\/div>\n<div dir=\"ltr\">uphold transparency and accountability in the entire budget process and<\/div>\n<div dir=\"ltr\">implementation. The judgement is an important step towards reversing a<\/div>\n<div dir=\"ltr\">culture of corruption in the budget process that has meant that many of<\/div>\n<div dir=\"ltr\">our lawmakers see the budget more as a \u2018meal ticket\u2019 to look after<\/div>\n<div dir=\"ltr\">themselves than a social contract to meet people\u2019s needs and advance<\/div>\n<div dir=\"ltr\">equity and development across the country.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cThis is a crucial precedent that vindicates the right to a transparent<\/div>\n<div dir=\"ltr\">and accountable budget process and affirms the budget as government\u2019s most<\/div>\n<div dir=\"ltr\">important economic policy document, which is central to the realization of<\/div>\n<div dir=\"ltr\">all human rights including the rights to health, water, and education. We<\/div>\n<div dir=\"ltr\">are now in the process of obtaining a certified copy of the judgment.<\/div>\n<div dir=\"ltr\">SERAP will do everything within its power to secure the full and effective<\/div>\n<div dir=\"ltr\">enforcement of this important judgment.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">It would be recalled that SERAP last year filed the suit after the<\/div>\n<div dir=\"ltr\">organization said it received \u201ccredible information from multiple sources<\/div>\n<div dir=\"ltr\">that the Department of State Services (DSS) and the Economic and Financial<\/div>\n<div dir=\"ltr\">Crimes Commission (EFCC) have completed investigations into the<\/div>\n<div dir=\"ltr\">allegations of padding of the 2016 budget, completed their reports, and<\/div>\n<div dir=\"ltr\">indicted some principal officers of the House of Representatives and the<\/div>\n<div dir=\"ltr\">Senate, and that the accounts of some of the principal officers containing<\/div>\n<div dir=\"ltr\">allegedly illicit funds have been frozen, and that the case files for the<\/div>\n<div dir=\"ltr\">prosecution of those indicted were ready.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">The suit filed on SERAP\u2019s behalf by its counsel Mrs Joke Fekumo read in<\/div>\n<div dir=\"ltr\">part: \u201cUnless the principal officers indicted in the alleged padding of<\/div>\n<div dir=\"ltr\">the 2016 budget are prosecuted and any stolen public funds recovered, the<\/div>\n<div dir=\"ltr\">Federal Government will not be able to stop padding of future budgets.<\/div>\n<div dir=\"ltr\">Alleged corruption in the budget process will not just melt away or simply<\/div>\n<div dir=\"ltr\">evaporate without addressing the fundamental issue of impunity of<\/div>\n<div dir=\"ltr\">perpetrators.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cAddressing alleged corruption in the budget process by pursuing<\/div>\n<div dir=\"ltr\">prosecution of indicted principal officers of the National Assembly will<\/div>\n<div dir=\"ltr\">provide an important opportunity for the Federal Government to reignite<\/div>\n<div dir=\"ltr\">the fight against corruption and fulfil a cardinal campaign promise, to<\/div>\n<div dir=\"ltr\">show that the Federal Government works on behalf of the many, and not the<\/div>\n<div dir=\"ltr\">few, as well as jumpstart economic activities and break the back of the<\/div>\n<div dir=\"ltr\">recession.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cPublishing the report of the investigation of the alleged padding of the<\/div>\n<div dir=\"ltr\">2016 budget, and prosecuting suspected perpetrators are absolutely<\/div>\n<div dir=\"ltr\">important to avoid another padding, which the Federal Government can ill<\/div>\n<div dir=\"ltr\">afford.\u201d<\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\">\u201cThe allegations of crime of budget padding against the indicted principal<\/div>\n<div dir=\"ltr\">officers of the National Assembly is a gross deprivation of the good<\/div>\n<div dir=\"ltr\">people of Nigeria\u2019s legitimate wealth and natural resources.
