{"id":62832,"date":"2018-07-04T15:57:00","date_gmt":"2018-07-04T14:57:00","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=62832"},"modified":"2018-07-04T15:57:00","modified_gmt":"2018-07-04T14:57:00","slug":"court-orders-national-assembly-to-begin-buharis-impeachment","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/exclusive\/court-orders-national-assembly-to-begin-buharis-impeachment\/","title":{"rendered":"Court orders National Assembly to begin Buhari\u2019s impeachment"},"content":{"rendered":"<p>Justice Maurine Adaobi Onyetenu of the Federal High Court, sitting in<br \/>\nOsogbo has ordered the National Assembly to immediately commence<br \/>\nimpeachment process against President Muhammadu Buhari.<\/p>\n<p>The judge gave the order on <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1260466311\"><span class=\"aQJ\">Wednesday, July 4, 2018<\/span><\/span> based on the suit<br \/>\nfiled by two Nigerians, Kanmi Ajibola, a lawyer and Sulaiman Adeniyi, a<br \/>\nhuman right activist urging the court to enforce the National Assembly to<br \/>\nimpeach President Buhari.<\/p>\n<p>The duo had three months ago written to both the lower and the upper<br \/>\nchambers of the National Assembly on the need to impeach President Buhari,<br \/>\nciting alleged constitutional breaches by the president and threatened<br \/>\nthat they will approach the court if they fail to act accordingly.<\/p>\n<p>But when the lawmakers refused, they headed for court and filed a suit at<br \/>\nthe Federal High Court, Osogbo asking for an order of mandamus to compel<br \/>\nboth the Senate and the House of Representatives to start the impeachment<br \/>\nproceedings of President Buhari.<\/p>\n<p>In the suit filed on Tuesday, June 19, 2018, they hinged their arguments<br \/>\non four grounds on why the National Assembly should impeach the Buhari.<\/p>\n<p>In the motion ex-parte, the duo claimed that in flagrant violation of the<br \/>\n1999 constitution, President Buhari contested election, won and was sworn<br \/>\nin as the president on the 29th day of May 2015 without possessing the<br \/>\nbasic constitutional requirement, which would have made him qualified for<br \/>\nthe contest of the election.<\/p>\n<p>They further alleged that the 4th respondent, which is President Buhari in<br \/>\nflagrant violation of section 137 (1) (j) of the 1999 constitution<br \/>\npresented a forged certificate to the Independent National Electoral<br \/>\nCommission (INEC) for the purpose of the 2015 presidential election that<br \/>\nbrought him to the office of the president<\/p>\n<p>\u201cIn the light of the 4th Respondent\u2019s placement to continue in the office<br \/>\nas the president, he has no certificate and basic requirement upon which<br \/>\nthis placement to continue in the office can be placed.\u201d<\/p>\n<p>Besides, they accused the president of treating the orders of the court<br \/>\nwith a great disdain and abuses the constitution of the Federal Republic<br \/>\nof Nigeria at will, particularly from the angle of the observance of the<br \/>\nFederal character as contained in section 14 of the constitution.<\/p>\n<p>\u201cThe 4th Respondent on the 29th day of May 2015, took an oath of office,<br \/>\namong others, to the effect that, he would rule in accordance to and<br \/>\nprotect the constitution of the Federal Republic of Nigeria, particularly<br \/>\nsection 14 (2) (b) which stipulates that the security and welfare of the<br \/>\npeople shall be the primary purpose of government.\u201d<\/p>\n<p>\u201cIn the contrary, the 4th Respondent has proved to be unable to guarantee<br \/>\nthe security of lives and properties of the citizens of the federal<br \/>\nRepublic of Nigeria in fulfillment of his oath of Office. The herdsmen<br \/>\nkillings of the innocent citizens under the 4th Respondent have been<br \/>\nuncountable, unbearable and unprecedented overheating figures in the<br \/>\nglobe.<br \/>\n\u201cThe 4th Respondent in contravention of the due process and sections 80<br \/>\nand 81 of the 1999 constitution spent about $496 Million on the purchase<br \/>\nof Tucano Jets without the approval of the National Assembly of the<br \/>\nFederal Republic of Nigeria as required by the law.<\/p>\n<p>\u201cThe 4th Respondent ordered to be withdrawn, money from the public fund of<br \/>\nthe Federation without the approval of the National Assembly or the<br \/>\nauthorization of its act and same used for the purchase of Tucano Jets.<br \/>\n\u201cThe 4th Respondent has committed several impeachable offences, that is,<br \/>\ngross misconduct.<\/p>\n<p>\u201cBy the provision of section 143 of the 1999 constitution, the 1st to 3rd<br \/>\nRespondents (The Senate President, the Speaker of the House of<br \/>\nRepresentatives and the National Assembly) have the statutory duty to<br \/>\nimpeach the 4th Respondent as the president and Commander in \u2013 Chief of<br \/>\nArmed Forces of the Federal Republic of Nigeria on gross misconduct.<\/p>\n<p>\u201cThe 1st to 3rd Respondents have closed their eyes to the gross misconduct<br \/>\nof the 4th Respondent.<\/p>\n<p>They told the court that as applicants in the matter, they have the right<br \/>\nand duty to compel the 1st and 3rd Respondents to perform their statutory<br \/>\nduty of impeachment against the 4th Respondent, having bothered on the<br \/>\nconstitution of the Federal Republic of Nigeria.<\/p>\n<p>Citing several constitutional authorities in the written address in<br \/>\nsupport of the motion ex-parte and with 44-paragraph affidavits, the duo<br \/>\nposed some questions by putting Nigeria side by side with some developed<br \/>\nnations.<br \/>\n\u201cCan the conduct of the 4th Respondent, particularly on the presentation<br \/>\nof a forged certificate, be condone in America or great Britain unchecked?<br \/>\n\u201cCan the 4th Respondent continue to benefits from his act of forgery and<br \/>\ninfraction of constitution?<\/p>\n<p>\u201cDefinitely, an American president cannot be genuinely accused of<br \/>\npresentation of a forged certificate and still be allowed to continue as<br \/>\nthe president, likewise the prime minister of the Great Britain\u201d, they<br \/>\nnoted.<\/p>\n<p>After moving the application before the, Barrister Ajibola urged the court<br \/>\nthat with all array of documents before the court, he was of the view that<br \/>\nthe National Assembly must perform its constitutional duties without fear<br \/>\nor favour.<\/p>\n<p>Justice Onyetenu in her ruling granted the application and ordered \u201cthat<br \/>\nthe National Assembly being the 1st,2nd and\u00a0 3rd respondents commence the<br \/>\nimpeachment of President Muhammadu Buhari\u201d.<br \/>\nFurther hearing of the matter has been fixed to <span class=\"aBn\" tabindex=\"0\" data-term=\"goog_1260466312\"><span class=\"aQJ\">October 30th, 2018<\/span><\/span>.<\/p>\n<div class=\"yj6qo\"><\/div>\n<div class=\"adL\"><\/div>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content --><!-- AddThis Related Posts generic via filter on the_content -->","protected":false},"excerpt":{"rendered":"<p>Justice Maurine Adaobi Onyetenu of the Federal High Court, sitting in Osogbo has ordered the National Assembly to immediately commence impeachment process against President Muhammadu Buhari.
