Socio-Economic Rights and Accountability Project (SERAP) has dragged the<\/div>\n
\n
Independent National Electoral Commission (INEC) to court over the
\ncommission\u2019s \u201cfailure to put Ekiti vote buyers on trial and do something
\nabout the allegations of vote buying by both the All Progressives Congress
\n(APC) and the Peoples Democratic Party (PDP) during recent governorship
\nelection in Ekiti State.\u201d<\/p>\n

In the suit number FHC\/L\/CS\/1418\/18 filed last Friday at the Federal High
\nCourt, Ikoyi, Lagos, SERAP is seeking \u201can order for leave to apply for
\njudicial review and to seek an order of mandamus compelling INEC and its
\nChairman Professor Mahmood Yakubu to instruct security agencies to forward
\nto them reports of their investigations into allegations of vote buying
\nduring the governorship election in Ekiti State and to collaborate with
\nthe Independent Corrupt Practices and Other Related Offences Commission
\n(ICPC) and the Economic and Financial Crimes Commission (EFCC) to commence
\nprosecution of indicted persons.\u201d<\/p>\n

The suit followed the electoral commission\u2019s response to SERAP last week
\nsaying that while it had powers to prosecute alleged vote buyers, it
\nlacked the powers to arrest and investigate suspects. In the letter signed
\nby its Acting Secretary Okechukwu Ndeche INEC said while the Commission\u2019s
\nlegal officers or any legal practitioner appointed by it \u201ccan prosecute
\nalleged vote buying, other agencies must first arrest and investigate
\nsuspects before the Commission can act on the matter.\u201d<\/p>\n

The organization is also seeking an order compelling INEC and its Chairman
\nto \u201cprosecute anyone suspected to be involved and\/or complicit in the
\nalleged vote buying during the elections in Ekiti State, Anambra State,
\nEdo State and Ondo State.\u201d<\/p>\n

The suit filed on behalf of SERAP by its counsel, Timothy Adewale read in
\npart: \u201cTo date, INEC and its Chairman have failed, neglected and\/or
\nrefused to comply with the request by SERAP to prosecute alleged vote
\nbuyers. INEC has no reason whatsoever not to comply with SERAP\u2019s request,
\nas the commission has constitutional and statutory responsibilities to
\nprosecute bribery and undue influence in the context of elections and
\nother electoral offences, as well as conduct and ensure a free and fair
\nelection.\u201d<\/p>\n

\u201cBy virtue of Section 153(1)(f) and paragraphs 14 and 15 of the Third
\nSchedule to the 1999 Constitution of Nigeria (as amended) and Section 150
\nof the Electoral Act 2010 (as amended), INEC and its Chairman are under a
\nbinding legal obligation to prosecute indicted persons who are alleged to
\nhave participated or been involved in vote buying during elections and
\nother electoral offences to guarantee that the free participation of the
\npeople is ensured,\u00a0 as intended by Section 14 (2)(C) of the Constitution.\u201d<\/p>\n

\u201cINEC is failing in its duties to set machinery of justice in motion to
\nsee to the prosecution of those suspected to have violated electoral and
\nanti-corruption laws. We seek an order of mandamus to compel the
\ncommission and its Chairman them to perform such duties in the public
\ninterest and in the overall interest of transparency and accountability of
\nthe entire electoral process.\u201d<\/p>\n

\u201cMandamus is simply an order to compel the performance of a public duty in
\nwhich the person applying for the mandamus has sufficient legal interest.
\nSERAP by its mandates has sufficient legal interest as to the way and
\nmanner laws are being obeyed and statutory duties effectively performed in
\nNigeria. It is the right of any citizen or interested group to see that
\nthe law is enforced where there is an infraction of that right or a threat
\nof its being violated in matters affecting the public law and the society
\nwill be adversely affected by doing nothing.\u201d<\/p>\n

\u201cObedience to the rule of law by all citizens but more particularly those
\nwho publicly took oath of office to protect and preserve the constitution
\nis a desideratum to good governance and respect for the rule of law. In a
\ndemocratic society, this is meant to be a norm; it is an apostasy for
\ngovernment to ignore the provisions of the law and the necessary rules
\nmade to regulate matters\u201d.<\/p>\n

The suit is seeking the following reliefs:<\/p>\n

A.\u00a0 \u00a0 AN ORDER granting leave to the Applicant to apply for Judicial
\nReview and to seek an order of Mandamus directing and\/or compelling the
\n1st and 2nd Respondents to instruct security agencies to forward to them
\nreports of their investigations into allegations of vote buying by both
\nthe All Progressives Congress (APC) and the Peoples Democratic Party (PDP)
\nduring the governorship election in Ekiti State held on the 14th day of
\nJuly, 2018, and to collaborate with the Independent Corrupt Practices and
\nOther Related Offences Commission (ICPC) and the Economic and Financial
\nCrimes Commission (EFCC) and other appropriate anti-corruption agencies to
\nwithout further delay commence prosecution of indicted persons;
\nB.\u00a0 \u00a0 AN ORDER granting leave to the Applicant to apply for Judicial
\nReview and to seek an order of Mandamus directing and\/or compelling the
\nRespondents to prosecute anyone suspected to be involved and\/or complicit
\nin the alleged vote buying;
\nC.\u00a0 \u00a0AN ORDER of Mandamus directing and\/or compelling the Respondents to
\nprosecute anyone suspected to be involved and\/or complicit in the alleged
\nvote buying by both the All Progressives Congress (APC) and the Peoples
\nDemocratic Party (PDP) during the governorship election in Ekiti State
\nheld on the 14th day of July, 2018 and the elections in Anambra State, Edo
\nState and Ondo State;
\nD.\u00a0 \u00a0AND for such order or other orders as this Honourable Court may deem
\nfit to make in the circumstance.<\/p>\n

INEC\u2019s letter dated 20 August 2018 read in part: \u201cWe refer to your letter
\ndated 17th July 2018 wherein you requested that the Commission investigate
\nand prosecute alleged vote buying in the recently concluded governorship
\nelection in Ekiti State. The Commission wishes to inform you of the
\nconstraints posed by extant statutory provisions against your
\nwell-intended request.\u201d<\/p>\n

\u201cYou may also wish to note that it is not part of the constitutional
\nduties of the Commission to arrest and investigate suspects found to have
\ncontravened provisions of the Electoral Act or any other Law for the time
\nbeing in force. Section 150(2) of the Electoral Act 2010 (as amended) only
\nconfers powers on Legal Officers of the Commission or any other Legal
\nPractitioner appointed by it to undertake prosecution of offences
\ndisclosed under Act.\u201d<\/p>\n

SERAP had earlier warned INEC to \u201ctake steps within 14 days of the receipt
\nand\/or publication of the letter, failing which SERAP will institute legal
\nproceedings to compel you and the Independent National Electoral
\nCommission (INEC) to discharge your constitutional and statutory
\nresponsibilities in the public interest.\u201d<\/p>\n

No date has been fixed for the hearing of the suit.<\/p>\n<\/div>\n<\/div>\n
