Adebayo Shittu, minister of communications, has taken the All Progressives<\/div>\n<\/div>\n

Congress (APC) to court for disqualifying him as a governorship aspirant.<\/p>\n

The APC screened Shittu out of the race for not presenting a National
\nYouth Service Corps (NYSC) scheme discharge certificate.<\/p>\n

According NAN, Shittu in the originating summons, argued that it was wrong
\nfor APC to disqualify him for not presenting the certificate.<\/p>\n

The minister said participation in the NYSC scheme was not a condition
\nprecedent to be satisfied before he was appointed a minister.<\/p>\n

Shittu is asking the court to determine \u201cwhether by the provision of
\nSection 2(1) of the National Youth Service Corps Decree No. 24 of 1973
\nand\/or any other provision of the Decree being the law in force as at 1978
\nwhen the Plaintiff graduated at the University of Ile-Ife (now Obafemi
\nAwolowo University, Ile-Ife) he was under any legal obligation to have
\nwarranted the plaintiff\u2019s participation in the National Youth Service
\nCorps in the absence of a call-up instrument duly served on the Plaintiff
\nby the National Youth Service Corps.<\/p>\n

\u201cWhether, by the combined reading of sections 176-183 of the constitution
\nof the federal republic of Nigeria [as Amended] and Article 20(iii) & (iv)
\nof the Constitution of the All Progressive Congress; it is a condition
\nthat the gubernatorial aspirant of the 1st Defendant (APC) and\/or any
\npolitical party for that matter in Nigeria must present the National Youth
\nService Corps Discharge\/Exemption Certificate;<\/p>\n

\u201dWhether it is ultra vires the powers of the 1st defendant to have
\ndisqualified the plaintiff from participating in its primary election for
\nnomination of the governorship candidate of the 1st defendant in Oyo State
\nfor the 2019 General Election on the ground that the plaintiff does not
\npossess National Youth Service Corps Discharge\/Exemption Certificate;<\/p>\n

\u201dWhether it does not amount to denial of fair hearing as enshrined in
\nsection 36(1) of the 1999 constitution of as amended for the 1st defendant
\nto have purportedly disqualified the plaintiff from contesting for
\ngovernorship election in Oys state under the platform of the 1st defendant
\nwithout availing the Plaintiff an opportunity to be heard on the
\nallegations that the plaintiff avoided the National Youth Service Scheme;
\nand<\/p>\n

\u201dWhether by the combined reading of the provisions of Sections 147(5),
\n65(1)(b) & (2), 66 (1) of the 1999 Constitution (as amended) and Section
\n12 of the National Youth Service Corps Act, Cap N84 laws of the federation
\nof Nigeria 2004, the plaintiff was qualified to have been appointed as a
\nMinister capable of holding the office, and\/or any other governmental
\noffice at any level notwithstanding the fact that he did not participate
\nin the National Youth Service Corps scheme.\u201d<\/p>\n

In an affidavit in personally swore to and filed by A.U. Mustapha, his
\ncounsel, Shittu said there was no \u201ccall-up instrument\u201d served on him when
\nhe graduated.<\/p>\n

\u201cI was liable but not obligated to have participated in the National Youth
\nService Corps Scheme both at the time I graduated from the said University
\nand as at the time I was called to the Nigerian bar,\u201d the affidavit read.<\/p>\n

\u201cI know as a fact that I was also not served any notice or notified in any
\nmanner to proceed to participate in the National Youth Service Corps
\nscheme.<\/p>\n

\u201cI know as a fact that participation in the National Youth Service Corps
\nprogramme is not one of the requirements to be satisfied under the 1st
\ndefendant\u2019s constitution to enable me participate in the primary election
\nfor Nominating the party flag bearer for the office of governor of Oyo
\nstate in the 2019 general election. A copy of the Constitution of the 1st
\nDefendant is hereby attached and marked as \u2018Exhibit SHITTU 8\u2019.<\/p>\n

\u201cI also know as a fact that under the Constitution of the Federal Republic
\nof Nigeria, 1999 (as amended) it is not a requirement for me to have
\nparticipated in National Youth Service Corps Scheme to be eligible for
\nparticipation in the 1st Defendant\u2019s primary election for Nomination of
\nits flag bearer in Oyo State for the 2019 General election.<\/p>\n

\u201cI know also as a fact that the Electoral Act 2010 [as amended] did not
\nmake participation in the National Youth Service Corps Scheme a condition
\nprecedent for contesting any elective office whatsoever. I know also that
\nparticipation in NYSC Scheme is not one of the requirements to enable me
\ntake part in primary election for nomination of the 1st defendant\u2019s flag
\nbearer for the office of governor of Oyo state in the 2019 General
\nelection.\u201d<\/p>\n<\/div>\n<\/div>\n
