{"id":64858,"date":"2019-02-17T16:34:11","date_gmt":"2019-02-17T15:34:11","guid":{"rendered":"http:\/\/pointblanknews.com\/pbn\/?p=64858"},"modified":"2019-02-17T16:34:11","modified_gmt":"2019-02-17T15:34:11","slug":"serap-blames-successive-govts-nass-for-2019-election-delay-threatens-to-sue","status":"publish","type":"post","link":"https:\/\/pointblanknews.com\/pbn\/news\/serap-blames-successive-govts-nass-for-2019-election-delay-threatens-to-sue\/","title":{"rendered":"\u00a0 SERAP blames successive govts, NASS for 2019 election delay, threatens to sue"},"content":{"rendered":"<div id=\"m-5065301860531359083\" class=\"mail-message expanded\">\n<div class=\"mail-message-header spacer\">Socio-Economic Rights and Accountability Project (SERAP) has asked<\/div>\n<div class=\"mail-message-content collapsible zoom-normal mail-show-images \">\n<div class=\"clear\">Nigerians to \u201chold successive governments since the return of democracy in<br \/>\n1999 and the leadership of the National Assembly responsible for the<br \/>\npatently unlawful postponement of the 2019 general elections scheduled to<br \/>\nhold yesterday but now to hold on Saturday.\u201d<\/p>\n<p>The organization said: \u201cGiven the increasing tendency to postpone<br \/>\nelections and the cumulative failures and corruption over the years, SERAP<br \/>\nwould, after the elections, pursue appropriate legal action against the<br \/>\ngovernment in power and the National Assembly leadership for the catalogue<br \/>\nof breaches of constitutional and international obligations, and seek<br \/>\neffective remedies for the citizens.\u201d<\/p>\n<p>In a statement today signed by SERAP deputy director Kolawole Oluwadare,<br \/>\nthe organization said: \u201cThe postponement of Nigeria\u2019s elections since 2007<br \/>\nshows a systemic failure of leadership at the highest level of government,<br \/>\nand suggests that our electoral process is deliberately skewed in favour<br \/>\nof politicians\u2019 interests, who continue to profit from the corruption and<br \/>\nimpunity that have characterised the process since 1999, and against those<br \/>\nof the citizens.\u201d<\/p>\n<p>According to the organization: \u201cCalling for the resignation of the<br \/>\nIndependent National Electoral Commission (INEC) Chairman, Professor<br \/>\nMahmood Yakubu rather than addressing the root causes of persistent<br \/>\npostponement of elections is a blatant attempt by politicians to scapegoat<br \/>\nthe electoral commission.\u201d<\/p>\n<p>The statement read in part: \u201cWhile the INEC leadership ought to<br \/>\nproactively push for reform of the electoral system, successive<br \/>\ngovernments and leadership of the National Assembly that have the legal<br \/>\nresponsibility but have remained largely impervious to revolutionary<br \/>\nchange of the electoral system, should be held to account for this<br \/>\nfundamental breach of public trust.\u201d<\/p>\n<p>\u201cFoisting outdated electoral system on Nigerians, and spending huge public<br \/>\nfunds to sustain it, seems in uneasy tension with constitutional<br \/>\nprovisions and Nigeria\u2019s international obligations including under the<br \/>\nInternational Covenant on Civil and Political Rights, African Charter on<br \/>\nHuman and Peoples\u2019 Rights, and African Charter on Democracy, Elections and<br \/>\nGovernance to which Nigeria is a state party.\u201d<\/p>\n<p>\u201cRather than prioritising genuine and comprehensive reforms of the<br \/>\nelectoral system that would upgrade and modernize our voting processes,<br \/>\nsuccessive governments and leadership of the National Assembly would seem<br \/>\nto prefer the status quo, presumably to undermine citizens\u2019 right to<br \/>\nparticipation and to continue to profit from the corruption and impunity<br \/>\nthat the current system and processes breed.\u201d<\/p>\n<p>\u201cIt is clear that the current electoral process is vulnerable to<br \/>\ncorruption but politicians would seem to have little incentive to<br \/>\ncomprehensively reform, upgrade and modernise it. It is unlikely that<br \/>\neither the federal government or the National Assembly would take the<br \/>\nsteps necessary to sort out our electoral system, and improve<br \/>\ntransparency, accountability and integrity of the electoral process.\u201d<\/p>\n<p>\u201cWe urge Nigerians to take more active role in the fight against<br \/>\ncorruption, including by putting pressure on the authorities at the<br \/>\nfederal and state levels and the National Assembly to comprehensively<br \/>\nreform, upgrade and modernize our electoral system and processes.<br \/>\nOtherwise, citizens\u2019 right to participate in the governance system will<br \/>\nremain a \u2018hollow right\u2019.\u201d<\/p>\n<p>\u201cGiven that the right to vote is considered a part of an individual\u2019s<br \/>\nfundamental right to political participation, persistent postponement of<br \/>\nelections in the country raises serious questions about the legitimacy and<br \/>\nintegrity of Nigeria\u2019s fledgling democracy.\u201d<\/p>\n<p>\u201cPersistent failure to upgrade and modernize the electoral system has<br \/>\neffectively relegated the right of participation to paper tiger status,<br \/>\nundermining the ability of citizens to genuinely participate in the fight<br \/>\nagainst corruption and to hold their leaders to account. Yet, a<br \/>\ntransparent, accountable and modernized electoral process is a<br \/>\nprerequisite to the effective exercise of citizenship in a democratic<br \/>\nsociety.\u201d<\/p>\n<p>\u201cNo right is more precious in a democratic country than that of having a<br \/>\nvoice in the election of those who represent us. That voice is not lost<br \/>\nwhen the electoral process is skewed in favour of politicians\u2019 interests<br \/>\nand against the Nigerian voters. Other rights, even the most basic, are<br \/>\nillusory if the right to vote is undermined by the collective failure to<br \/>\nupgrade and modernize the country\u2019s electoral processes.\u201d<\/p>\n<p>\u201cIt is time to push for revolutionary changes in how Nigeria conducts its<br \/>\nelections. The changes should effectively deploy modern technology, which<br \/>\nhas been successfully used in the business and other sectors in the<br \/>\ncountry. Such changes may include the introduction of a national system of<br \/>\nInternet voting, to innovative ideas on how to adapt the election systems<br \/>\nto facilitate participation by different sectors of the population, to<br \/>\nconform with twenty-first century elections.\u201d<\/p>\n<p>\u201cThe postponement is the by-product of a systemic and collective failure<br \/>\nby successive governments and National Assembly leadership to provide<br \/>\nNigerians with reliable, efficient and secured electoral system, which has<br \/>\ncontinued to undermine public confidence in elections as well as the<br \/>\npublic\u2019s right to vote and participate in their own government.\u201d<\/p>\n<p>\u201cSERAP would also deploy the Freedom of Information Act to seek<br \/>\ninformation on details of spending by INEC since 1999, as part of our<br \/>\ninitiatives to improve transparency and accountability of governmental<br \/>\noperations and promote respect for citizens\u2019 right to participate in the<br \/>\nprocesses of government and governance in the country.\u201d<\/p>\n<p>\u201cSERAP notes that postponement of general elections has become a recurring<br \/>\nfeature of the country\u2019s electoral process. For example, the 2007 general<br \/>\nelections witnessed late arrival of election materials from South Africa<br \/>\nin April of that year, contributing to denying millions of voters their<br \/>\nright to political participation.\u201d<\/p>\n<p>\u201cSERAP also notes that the 2011 general election suffered the same<br \/>\norganizational lapses, with the elections postponed for two days after it<br \/>\nhad commenced. In 2015, the government of former president Goodluck<br \/>\nJonathan postponed the election for six weeks on the pretext that it<br \/>\nneeded time to reclaim the local governments reportedly taken over by the<br \/>\nBoko Haram terrorist group.\u201d<\/p>\n<p>\u201cThe INEC on the morning of the elections shifted presidential and<br \/>\nNational Assembly elections to 23rd February, 2019.
