The Independent National Electoral Commission (INEC) has said candidates
\nof the All Progressives Congress (APC) in Zamfara state can participate in
\nthe National Assembly, governorship and state House of Assembly elections
\nin the state.<\/p>\n
This was contained in a statement signed by Festus Okoye, Chairman of the
\nInformation and Voter Education Committee of INEC, issued on Friday.<\/p>\n
According to the commission, the decision is the result of a judgment by
\nthe Court of Appeal in Abuja on Thursday, which set aside the judgment of
\nthe Federal High Court in Abuja for \u201clack or want of jurisdiction on the
\npart of the lower court\u201d.<\/p>\n
The statement read: \u201cThe Independent National Electoral Commission (INEC)
\nhas consistently maintained that it will always obey court judgments and
\norders.<\/p>\n
\u201cIn the case of the All Progressives Congress (APC) in Zamfara State, the
\nFederal High Court, Abuja and the Zamfara State High Court issued
\nconflicting orders relating to the participation of the APC in the two
\nstrands of elections scheduled for 23rd February and 9th March 2019.<\/p>\n
\u201cWhile the former ruled that the APC, having failed to conduct party
\nprimaries cannot field candidates in the said election, the latter decided
\nthat it can field candidates having conducted valid party primaries.<\/p>\n
\u201cHowever, the Court of Appeal, Abuja Judicial Division on 21st February
\n2019 set aside the judgment of the Federal High Court, Abuja for \u2018lack or
\nwant of jurisdiction on the part of the lower court.\u2019 This in effect means
\nthat the Zamfara State High Court\u2019s decision that the APC can field
\ncandidates for the National Assembly, Governorship and State Assembly
\nelections is the only valid and subsisting order.<\/p>\n
\u201cConsequently, the Commission has today, in compliance with the said
\norder, restored the APC to the ballot in the National Assembly,
\nGovernorship and State House of Assembly elections scheduled for 23rd
\nFebruary and 9th March 2019.\u201d<\/p>\n
