Socio-Economic Rights and Accountability Project (SERAP) has dragged the<\/div>\n
\n
Federal Government and state governments to ECOWAS Court of Justice in
\nAbuja over \u201cthe frequent and repressive application of the Cybercrime Act
\nto harass, intimidate, arbitrarily arrest, detain, and unfairly prosecute
\nanyone found publishing views or facts perceived to be critical of the
\ngovernment at the federal and state levels and government officials.\u201d<\/p>\n

In the suit number ECW\/CCJ\/APP\/09\/19 filed last week at the ECOWAS Court,
\nSERAP is arguing that: \u201cThe Federal Government and several state
\ngovernments and their agents have trampled on the rights to freedom of
\nexpression and information of bloggers, journalists, activists, and social
\nmedia users through the repressive use and implementation of the vaguely
\nworded provisions of the Cybercrime Act.\u201d<\/p>\n

The suit filed on SERAP\u2019s behalf by its Solicitor Femi Falana, SAN states:
\n\u201cThe fundamental question for the court is whether the federal and state
\ngovernments, by using and applying the Cybercrime Act and other similar
\nlaws on cyberstalking and sedition to prosecute journalists, bloggers and
\nactivists over perceived critical views, violate the rights to freedom of
\nexpression and access to information. SERAP submits that, under
\ninternational freedom of expression jurisprudence, the answer is YES.\u201d<\/p>\n

The suit read in part: \u201cThe idea of a democracy is that the people are
\nencouraged to express their criticisms, even their wrong-headed
\ncriticisms, of elected government officials, in the expectation that this
\nprocess will improve the process of government. In circumstances of public
\ndebate concerning public figures in the political domain and public
\ninstitutions, the value placed by legal principles and jurisprudence upon
\nuninhibited expression is particularly high.\u201d<\/p>\n

\u201cThe systematic and persistent use of the Cybercrime Act and other similar
\nlaws on alleged cyberstalking to prosecute and imprison journalists,
\nbloggers and activists for their criticism of public officials runs afoul
\nof freedom of expression principles, namely: that criminal prosecutions
\nagainst journalists and bloggers is never an appropriate remedy for
\nalleged defamation of government officials, and that\u00a0 news reporting about
\ngovernment officials are matters of public interest, which should be
\naccorded heightened protection.\u201d<\/p>\n

\u201cSanctions for defamation should not be so large as to exert a chilling
\neffect on freedom of opinion, expression and media freedom; penal
\nsanctions, in particular imprisonment, should never be applied. This
\nimplies a free press and other media able to comment on public issues
\nwithout censorship or restraint and to inform public opinion. The public
\nalso has a corresponding right to receive output.\u201d<\/p>\n

\u201cSection 24 of the Cybercrime Act which provides for the offence of
\ncyberstalking has been severally used and applied by the Defendant and its
\nagents and several state governments across the country in molesting,
\nintimidating, harassing and witch-hunting anyone found publishing views or
\nfacts deemed critical of government and\/or government officials.\u201d<\/p>\n

\u201cThe vaguely worded offence of cyberstalking as stated in the Cybercrime
\nAct is accorded a wide interpretation that extends to factual and true
\nreports by activists, journalists, social media users and bloggers,
\nthereby leaving a chilling effect on the rights to freedom of expression
\nand information and media freedom and on citizens\u2019 participation in the
\nfight against corruption.\u201d<\/p>\n

\u201cThe abusive and repressive use of the vaguely worded provisions of the
\nCybercrime Act to stifle and muzzle perceived critics, journalists,
\nbloggers and other media practitioners is an affront and it is dangerous
\nto the rule of law and protection of the human rights of people.\u201d<\/p>\n

\u201cStories published online have been deemed \u2018offensive\u2019, \u2018obstructive\u2019,
\n\u2018insulting\u2019 or \u2018annoying\u2019 with actionable consequence under section 24 of
\nthe Act even when the stories are true, correct and factual. Some stories
\npublished through traditional media outlets (print and electronic) that
\nwere never sanctioned by the government have been sanctioned by the same
\ngovernment upon being republished through online platforms.\u201d<\/p>\n

\u201cSERAP chronologically highlights in this suit some of the high-profile
\ncases of harassment, intimidation, arrest, unlawful detention, prosecution
\nand imprisonment of journalists, bloggers, and activists for alleged
\ncyberstalking.\u201d<\/p>\n

SERAP is seeking the following reliefs:<\/p>\n

1.A DECLARATION that the actions of the Defendants and its agents and
\nseveral states of Nigeria in arbitrarily enforcing the provisions of the
\nCybercrime (Prohibition, Prevention, etc) Act 2015 particularly its
\nsection 24 to harass, intimidate, arrest, detain, prosecute and imprison
\njournalists, bloggers, and social media users, violate the rights to
\nfreedom of expression, information, opinion and privacy and media freedom,
\nguaranteed under Articles 6,8,9 and 24 of the African Charter on Human and
\nPeoples\u2019 Rights; Articles 7,9,17 and 19 of the International Covenant on
\nCivil and Political Rights to which Nigeria is a state party<\/p>\n

2. A DECLARATION that the provisions of the Cybercrime (Prohibition
\nPrevention, etc) Act 2015 are entirely inconsistent and incompatible with
\ninternational human rights standards and infringe on the rights to the
\nfreedom of expression, information and opinion guaranteed under the
\nAfrican Charter on Human and Peoples\u2019 Rights<\/p>\n

3. A DECLARATION that the continuing use and application by the Defendant
\nand its agents and several states in Nigeria of the Cybercrime is illegal
\nand unlawful, as it amounts to breaches of obligations to respect,
\nprotect, promote and fulfil the rights to freedom of expression and
\ninformation and media freedom<\/p>\n

4. AN ORDER directing the Defendant to immediately repeal and\/or amend the
\nCybercrime (Prohibition, Prevention, etc) Act 2015 in line with Nigerian
\nobligations under international human rights law<\/p>\n

5. AN ORDER directing the Defendant and\/or its agents and several states
\nof Nigeria to provide effective remedies and reparation, including
\nadequate compensation, restitution, satisfaction or guarantees of
\nnon-repetition that the Honourable Court may deem fit to grant to human
\nrights defenders, activists bloggers, journalists and other online and
\noff-line media practitioners that have been harassed, intimidated,
\nunlawfully arrested, detained, and unfairly prosecuted by the Defendant<\/p>\n

6. SUCH FURTHER orders the Honorable Court may deem fit to make in the
\ncircumstances of this suit.<\/p>\n
