United States-Nigeria Law Group, an election observer, accredited by the
\nIndependent National Election Commission, INEC, has released a damning
\nelection assessment report of the 2019 election, accusing the All
\nProgressive Congress, APC, of deliberately creating hurdles to benefit it
\nelectoral fortunes and retain power at the center.<\/p>\n

The Observer group noted specifically that the President Muhammadu
\nBuhari-led administration, in both the Judiciary and INEC matters,
\nviolated the constitution of Nigeria, which guarantees their independence
\nfrom interference.<\/p>\n

From its findings, the group posited that while the electorate prepared
\nfor elections, it was as though the incumbent was \u201cpreparing a military
\noperation.\u201d<\/p>\n

In a statement signed by Mr. Emmanuel Ogebe and obtained by THISDAY at the
\nweekend, the Group said it observed conscious efforts to compromise the
\nelections and raised early warnings as well as concerns, which have now
\nbeen validated and proven by the resulting self-sabotaged elections.<\/p>\n

For example, it noted that INEC announced inconclusive elections in 6
\nstates out of which PDP was reportedly leading in all but one.
\n\u201cThis is highly suggestive and unsettling all by itself. However, there
\nare further indications that similar results in states in which the APC
\nwas leading were not declared inconclusive. Some states where a rerun was
\nillogical, because the mathematical probabilities could not conceivably
\nproduce a different outcome have still been scheduled for rerun.<\/p>\n

\u201cThe principle on cancelled votes versus margin of victory, which
\nostensibly informed the inconclusive declarations in state elections, was
\nnot uniformly applied in the presidential elections. So far the following
\nstates have been declared inconclusive \u2013 the most ever in Nigerian history
\n\u2013 Benue, Plateau, Adamawa, Sokoto, Kano and Bauchi states.<\/p>\n

\u201cIt is especially noteworthy that in the case of Kano State, the PDP was
\noverwhelming leading when the Deputy Governor seized and tore the results
\nof the last Local Government to be declared. This brazen act of brigandage
\nwas caught on video and is perhaps emblematic of how the election results
\noverall have been hijacked.\u201d
\nOn the postponement of the presidential and National Assembly elections
\nfrom February 16 to 23, the group said its investigations and analysis
\nindicated that the action was orchestrated by the ruling party based on
\nits dissatisfaction with judiciary pronouncements on cases affecting its
\ncandidates.<\/p>\n

According to the election observer group, the Buhari regime had shown
\nunambiguously its displeasure with both the Judiciary and INEC for not
\ndelivering its preferred outcomes.
\nIt further held that there was a clear pattern of desperation,
\nconstitutional violation and fabrication in the actions of the regime
\ntowards both key institutions that have a critical role in the elections.
\nThus, in this post-election report, the group detailed various instances
\nin which it said the incumbent president had shown intent and discernible
\nactions to undermine the elections.<\/p>\n

While enumerating several shortcomings of the 2019 election, the USNLG
\nexpressed grave concern at the brazen militarisation of the elections.
\nIt added that in furtherance of its partisan agenda in both the Judiciary
\nand INEC, the President Buhari-led APC administration fabricated a faux
\ncourt ruling on the basis of which it justified its unconstitutional acts.<\/p>\n

For instance, the USNLG report noted that: \u201cThe Buhari regime acting
\nostensibly on a private petition interfered with both the Judiciary and
\nINEC regarding the removal of CJN and election postponement respectively.\u201d
\nIt said the President\u2019s refusal to sign the electoral reforms into law
\nshowed clearly \u201cthe mens rea or criminal intent by the president not to
\nallow the conduct of credible elections from the word go.<\/p>\n

\u201cIndeed, the president is on record for having said following the passage
\nof the \u2018not-too-young to run\u2019 law, that it should be only after his
\nre-election. This Freudian slip cements the notion that he nixed the
\nelectoral reforms for the same self-perpetuation.
\n\u201cFor these and other reasons, it is transparently clear that the Buhari
\nregime had motive, opportunity, mens rea and actus reus (criminal intent
\nand culpable acts) and declared intent and discernible actions to
\nundermine the elections. In this respect, they were successful in
\npremeditated failure,\u201d it said.<\/p>\n

The election observer group therefore said it decided to share its report
\nfor the benefit of the electorate and the international community for the
\nsake of global democracy.
\nWith regards to the issue of malpractices and activities of compromised
\npoll officials, the observer group said it has firsthand report of what
\ntranspired in Benue State, for instance, on the eve of the rescheduled
\npresidential and National Assembly polls of February 16.<\/p>\n

\u201cWe gathered that out of a list of about 500 names submitted by a federal
\ninstitution to INEC as poll officials, a ruling party Senator selected
\nthose whom he deemed he could \u2018work with\u2019. In addition, the APC Senator
\ndoled out millions of naira, which was distributed to the INEC-trained
\npoll officials at a location in Makurdi, the Benue State Capital. The
\ntemporary poll officials were called by phone to come and collect the
\nserving Senator\u2019s cash in person from the said location.\u201d<\/p>\n

It also said that before the governorship election of March 9, a
\nuniversity professor was apprehended with election materials in Benue
\nState and his vehicle burnt by irate voters, thus reiterating the fact
\nthat it witnessed firsthand, the distribution of cash from the back of a
\nvehicle to political operatives for unknown purposes and particularly
\nstunned that the party functionaries were escorted by police.<\/p>\n

The USNLG report stated that operatives of the Economic and Financial
\nCrimes Commission (EFCC) apprehended a vehicle loaded with currency in the
\ntrunk of a vehicle of a politician linked to the APC in February.<\/p>\n

While expressing its concern over President Buhari\u2019s actions and inactions
\nbefore, during and after the elections, the observer group said it was
\ndeeply concerned at the president\u2019s remarks that electoral malpractice
\nwould attract summary execution.
\n\u201cWe are gravely concerned at the brazen militarisation of these elections.
\nBuhari has gone beyond militarisation to martialisation of the election
\nprocess. We are more concerned at remarks attributed to the Chief of Army
\nStaff that, \u2018If Commander-in-Chief has given order to the Nigerian Army to
\nthat effect, rest assured that order will be totally and effectively
\nobeyed without any ifs or buts.\u201d
\nSpecifically, the election observer group lamented the military invasion
\nof Rivers State and described it as troublesome.<\/p>\n

\u201cThe military invasion and rampage in Rivers State is troublesome on
\nseveral levels not the least of which is: The ruling party APC was not
\neven a candidate in the elections yet the government interfered with
\nmilitary might to rig in the most ignoble and egregious way ever.<\/p>\n

\u201cThe wicked, oppressive and violent attacks on innocent civilians and
\ntheir homes and property in the formerly restive Niger Delta just for
\nelections, has the real propensity for re-igniting another armed
\ninsurrection in the region.<\/p>\n

\u201cIt is clear that the overarching objective of the coercive force is not
\nto install APC, which has no candidate but to uninstall PDP. Rivers State
\nhas been the key rallying point and resource base for the opposition and
\nthe military mission is to completely gut their capacity by stripping them
\nof power in Rivers State.\u201d<\/p>\n

The group noted that the military denial of involvement was not credible
\nin the least.
\n\u201cIt should be pointed out that electoral law places security under INEC
\nand not INEC under security. The army has denied that its personnel are
\nthe ones featured with arms in uniform perpetrating these atrocities. This
\nresponse is neither credible nor helpful as it implies there are fake
\nsoldiers on rampage and the real army is helpless to protect the citizenry
\nfrom them.\u201d<\/p>\n

Despite the pronouncements by the authorities on security readiness, the
\nobserver group noted that between the two elections, over 200 people were
\nslaughtered in non-voting massacres in Benue, Zamfara and Kaduna states.
\nIt said it was particularly disheartening that military forces were
\nmobilised to opposition states for the elections in numbers unseen in
\ninsecurity-plagued states showing a total lack of prioritisation and
\ncallous insensitivity to human lives.<\/p>\n

On the Security deployments to Rivers State during the election, the group
\nsaid the scenario resembled a war zone.<\/p>\n

It maintained that it was in possession of a bizarre video showing an INEC
\nofficial admitting that their office was besieged by the military and
\nresults of election officers confiscated, thereby preventing them from
\ncollating the election result.<\/p>\n

In addition, the group said: \u201cViral video footage showed soldiers overrun
\nthe home of the state Education Commissioner as well as charging through
\nhis kitchen chasing after female residents with guns drawn.<\/p>\n

\u201cOther videos show courageous women chanting and keeping soldiers from
\nbreaking in and stealing election results. Yet another video shows
\nprotesters singing Christian choruses, when the military opened fire on
\nthe harmless crowd, injuring several. In another, the military went to
\narrest a former militant but were prevented by members of his community,\u201d
\nthe group stated.<\/p>\n

In further confirmation of its position that officials of the ruling party
\nconivived to interfere in conduct of the election, the group said the
\nAttorney General of the Federation, Abubakar Malami had written to INEC
\nadvising it to comply with the judgment of the Court of Appeal by
\nadmitting the result of the APC Zamfara state primaries and also comply
\nwith the provisions of section 38 of the Electoral Act which empowers INEC
\nto postpone the election for the governorship, National and State Houses
\nof Assembly election. It said that the AGF actually admitted in writing
\nthat the APC needs \u201ca little time to catch up.\u201d<\/p>\n

Such an \u201d illicit motive could not be clearer nor more dubious \u2013 to score
\nan advantage for a political party\u201d, it said. According to the group, INEC
\npostponed the elections of February 16th and March 2nd after the Attorney
\nGeneral requested it whether or not the commission admits that. USNLG said
\nthat in further validation of its stand that the election postponement was
\ncontrived for the benefit of the incumbent party, INEC also allowed the
\nAPC in Zamfara State to field candidates in the rescheduled elections just
\nlike the AG illegally and fraudulently requested.<\/p>\n

Also the observer group said that just as was being feared, the death
\nthreats to members of the international community by the Kaduna state
\ngovernor, Mallam Nasiru El-Rufai was followed by restrictions on
\ninternational observers by the military who prevented them from monitoring
\nelections in Rivers State.
\n\u201cThe restraint of international observers is not only proof of the
\ngovernment\u2019s grand design to brazenly rig the elections but also that
\nresistance would have resulted in their return in \u201cbodyguards\u201d as earlier
\nwarned\u201d.<\/p>\n<\/div>\n<\/div>\n
