\nA prosecution witness, Olufemi Otulana, in the ongoing trial of a former
\nExecutive Secretary, National Health Insurance Scheme, NHIS, Dr. Martins
\nOluwafemi Thomas, on Tuesday, March 19, 2019, told Justice A.O. Faji of
\nthe Federal High Court sitting in Ikoyi, Lagos how the defendant’s company
\nfraudulently evaded tax over a period of time.<\/p>\n

Thomas was re-arraigned along with one Kabiru Sidi, a Bureau de Change
\noperator, on June 28, 2017, on an amended six-count charge bordering on
\nmoney laundering to the tune of $2,198,900.<\/p>\n

The first defendant, Thomas, was alleged to have conspired with his wife,
\nFunmi, to make a cash payment of $2,198,900 to one Ibitoye Bamidele at
\ntheir residence on 20, Lagos University Teaching Hospital, Idi-Araba,
\nLagos.<\/p>\n

The second defendant, Sidi was also said to have lied to an EFCC
\ninvestigator, Afeez Mustapha that he was the owner of the money that the
\nfirst defendant and his wife transacted with.<\/p>\n

At today\u2019s sitting, Otulana, who was led in evidence by the prosecuting
\ncounsel, M.K. Bashir told the court that he received a letter from the
\nExecutive Chairman, Federal Inland Revenue Service, FIRS, asking him to
\ncheck the tax status of the first defendant\u2019s company, Safe-line Agro
\nBusiness Limited.<\/p>\n

Otulana also told the court that investigation revealed that no returns or
\ntax payment was ever remitted.<\/p>\n

He said: \u201cAfter doing a look-up of TIN and a tax payment research into the
\ncompany since it was incorporated on February 3, 2013, I printed out the
\ninformation and sent it to the Executive Chairman.\u201d<\/p>\n

Bashir, thereafter, sought to tender the EFCC request letter and response
\nof the Executive Chairman, FIRS, report of investigation by the witness to
\nthe FIRS Chairman and the certificate of identification, through Otulana,
\nwho is the Head, Tax Controller, Medium and Small Tax Office, Ado Ekiti
\nBranch, Ekiti State.<\/p>\n

The documents were admitted in evidence by the court as exhibits G 1-7.<\/p>\n

When asked to explain his report on exhibit G and if it was in order for
\nthe defendant\u2019s company to have two TINS, the witness said: \u201cI realized,
\nthrough research and investigations, that the company had two TINs: one
\ndomiciled in Ado Ekiti Medium and Small Office and the other in Orile
\nMedium and Small Office.<\/p>\n

\u201cIn the Ado Ekiti TIN, the first defendant used the Company\u2019s RC number
\nand public tax payers\u2019 platform.<\/p>\n

\u201cIn the Orile TIN, he used the individual tax payers\u2019 platform, and a
\ndriver\u2019s licence number.<\/p>\n

\u201cHe used a different phone number, but the same address.<\/p>\n

\u201cWe discovered absence of physical file in both the Ado Ekiti and the
\nOrile Medium and Small Offices, as documents were never submitted by the
\nfirst defendant.<\/p>\n

\u201cWithout physical file, returns submitted cannot be filed, and movement or
\npayment cannot be done, he said.\u201d<\/p>\n

Consequently, Justice Faji adjourned the case to May 16, 27, and 30, 2019
\nfor the cross- examination of witness and continuation of trial.<\/p>\n<\/div>\n<\/div>\n
